1. Approve the enclosed Rules of the handling of scrap and waste of ferrous metals and their alienation.

2. Determine that control of observance of these rules is exercised the Ministry of Internal Affairs of the Russian Federation, the Ministry of natural resources of the Russian Federation and executive bodies of subjects of the Russian Federation within the competence.

3. To federal executive bodies of the Russian Federation to bring the regulations into accord with these rules.

Rules of the handling of scrap and waste of ferrous metals and their alienation

I. General provisions

1. These rules determine procedure for the address (acceptance, accounting, storage, transportation) and alienation of scrap and waste of ferrous metals in the territory of the Russian Federation.

2. Physical persons perform alienation of scrap and waste of ferrous metals with indication of the basis of emergence of the property right on such scrap and waste.

3. Legal entities and individual entrepreneurs perform the handling of scrap and the waste of ferrous metals formed at them in production process and consumption or acquired by them and their alienation if there are documents confirming their property right to the specified scrap and waste.

II. Requirements to the organization of acceptance of scrap and waste of ferrous metals

4. The legal entity and the individual entrepreneur performing acceptance of scrap and waste of ferrous metals shall provide availability on each object for acceptance of the specified scrap and waste in the place of the following information, available to review:

a) for the legal entity - the name and the primary state registration number (PSRN), phone number, for the individual entrepreneur - the primary state registration number of the individual entrepreneur (PSRNIE), surname, name, middle name (in the presence), phone number;

b) for legal entities - data on person responsible for acceptance of scrap and waste of ferrous metals;

c) schedule of work;

d) conditions of acceptance and price of scrap and waste of ferrous metals.

5. On objects for acceptance of scrap and waste of ferrous metals, except information specified in item 4 of these rules the following documentation shall be and be shown upon the demand of monitoring bodies:

a) the license obtained according to Regulations on licensing of activities for procurement, conversion and realization of scrap of ferrous metals or its copy certified by the licensing body which granted the license;

b) ceased to be valid

c) documents on the available equipments and devices, and also documents on carrying out their checkings and testing;

d) instructions about procedure for carrying out radiation control of scrap and waste of ferrous metals and their checks on explosion safety;

e) the instruction about operations procedure in case of detection radioactive scrap and waste of ferrous metals;

e) the instruction about operations procedure in case of detection of explosive objects.

III. Procedure for acceptance and accounting of scrap and waste of ferrous metals

6. Acceptance of scrap and waste of ferrous metals is carried out on the net weight determined as difference between weight gross and the mass of the vehicle, container and contamination.

7. Acceptance of scrap and waste of ferrous metals is performed in case of presentation by person who is handing over scrap, the identity document. In case of delivery of scrap and waste of the ferrous metals which are not belonging to person who is handing over these scrap and waste except the identity document presentation of the relevant power of attorney from the owner of the specified scrap and waste is necessary.

8. The legal entity and the individual entrepreneur accepting scrap and waste of ferrous metals shall provide in accordance with the established procedure carrying out radiation control and implementation of incoming inspection of each batch of the specified scrap and waste on explosion safety.

Control is exercised by persons who had the corresponding training and certification.

8(1). The legal entity and the individual entrepreneur accepting scrap and waste of ferrous metals shall provide:

a) availability on each object for acceptance of scrap and waste of ferrous metals of the controller of scrap and waste of metal 2 categories;

b) availability on each object for acceptance of scrap and waste of ferrous metals:

persons responsible for carrying out radiation control of scrap and waste of ferrous metals;

persons responsible for monitoring procedure of scrap and waste of ferrous metals on explosion safety (assignment of responsibility for carrying out radiation control and control of explosion safety as like as two peas is allowed);

c) availability on each object for acceptance of scrap and waste of ferrous metals of the platform with the hard not destroyed moisture resistant surface intended for storage of scrap and waste of ferrous metals, and also the equipment for carrying out radiation control and weighing of scrap and waste of ferrous metals according to the established requirements;

d) availability on one at least from objects for acceptance of scrap and waste of ferrous metals within the territory of the subject of the Russian Federation of one unit of any of the following types of the equipment:

press for packaging of scrap of ferrous metals;

press scissors;

installation for crushing and sorting of lightweight scrap;

equipment for sorting or crushing of shaving;

poppet for scrap metal breakdown.

9. Accounting of scrap and waste of ferrous metals is conducted by person designated by the head of the legal entity performing acceptance of the specified scrap and waste or the individual entrepreneur.

10. Acceptance of scrap and waste of ferrous metals is performed with obligatory creation on each batch of scrap and waste of the acceptance report in form according to the appendix N1.

The acceptance report is drawn up or in 2 copies on paper (the 1st copy is transferred to person which is handing over scrap and waste of ferrous metals, the 2nd copy remains at person performing acceptance), or in the form of the electronic document with use of the strengthened qualified digital signature.

The specified acts are documents of the strict reporting and shall have end-to-end numbering.
