ORDER OF SERVICE OF FOREIGN INTELLIGENCE OF UKRAINE

About streamlining of payment terms of work of employees of Service of foreign intelligence of Ukraine

(as amended on 31-05-2017)

In pursuance of the resolution of the Cabinet of Ministers of Ukraine of 30.08.2002 No. 1298 "About compensation of workers based on the Single scale of charges of categories and coefficients on compensation of employees of organizations, institutions and the organizations of separate industries of the budget sphere" (with changes) and for the purpose of streamlining of payment terms of work of workers of general (end-to-end) professions and positions and workers whose professions and positions are carried to separate industries of the welfare sphere, in Service of foreign intelligence of Ukraine by PRIKAZYVAYU:

1. Approve Payment terms of work of workers of general (end-to-end) professions and positions and workers whose professions and positions are carried to separate industries of the welfare sphere in Service of foreign intelligence of Ukraine (are applied).

2. Determine that the Chairman of Service of foreign intelligence of Ukraine, his deputies, the rector of Institute of Service of foreign intelligence of Ukraine and chiefs 7, 8 and 9 services 4 managements 2 departments according to distribution of functional obligations in borders of the approved salary fund and in the procedure determined by the law:

a) establish to workers the specific sizes of official pay rates taking into account qualification requirements on post, surcharges and allowances to them in accordance with the terms of compensation of workers of general (end-to-end) professions and positions and workers whose professions and positions are carried to separate industries of the welfare sphere, in Service of foreign intelligence of Ukraine, approved by this order, based on motivated official reports of heads of the relevant divisions and in case of requirement of the relevant supporting documents;

b) perform awarding of workers according to their personal deposit in general results of work according to the procedure and on the conditions determined by the regulations on awarding approved by the Chairman of Service of foreign intelligence of Ukraine in coordination with trade-union body;

c) provide to workers financial support, including on improvement, in the amount no more than one official pay rate a year, except financial support on burial.

3. Surcharges, allowances, increases in official pay rates which amount and payment procedure are not provided by this order (for work in the mountain area, for work with classified documents and so forth), but are determined by the laws of Ukraine or acts of the Cabinet of Ministers of Ukraine, to perform according to these laws or acts.

4. The expenses connected with implementation of the payment terms of work of employees of Service of foreign intelligence of Ukraine determined and approved by this order which are financed from the budget to perform for the account and within the salary fund approved in estimates.

5. To the chief of Service of the mode, documentary providing and control of Management personnel of the Chairman to inform of the order of vice-chairmen of Service of foreign intelligence of Ukraine, heads of structural divisions and chiefs 7, of 8 and 9 services 4 managements 2 departments.

6. To heads of structural divisions and chiefs 7, of 8 and 9 services 4 managements 2 departments to organize acquaintance with the order of employees in part which concerns them.

Payment terms of work of workers of general (end-to-end) professions and positions and workers whose professions and positions are carried to separate industries of the welfare sphere, Service of foreign intelligence of Ukraine

1. General provisions

1.1. These Conditions are applied in case of calculation of the salary of professionals, specialists, division managers, technical employees, working, general to all divisions of Service of foreign intelligence of Ukraine, workers of the welfare sphere of Service of foreign intelligence of Ukraine (further - workers) to which education, science, health care and culture belong.

1.2. Compensation of workers is performed for actually worked time, proceeding from official pay rate (wage rate, the tariff charge), taking into account the extreme amount of surcharges, increases and allowances, stipulated by the legislation. The salary of the limiting worker is not limited to the sizes.

1.3. Changes of the sizes of official pay rates, increases, allowances which determine the salary of workers are carried out:

in case of change of the size of salary (tariff charge) of the worker of the I job grade;

in case of position assignment of the specialist of the corresponding qualification - from the date of the announcement of it the order of the Chairman of Service of foreign intelligence of Ukraine;

in case of assignment of honorary title. Day of assignment of honorary title is date of the Presidential decree of Ukraine;

in case of award of scientific degree - from the date of pronouncement by the Highest certifying commission of the decision on issue of the diploma;

in case of assignment of qualification category - from the date of the announcement of it the order of relevant organ (institution, organization) about approval of the solution of certifying commission;

in case of achievement during calendar month of years of service of continuous work which grants the right to the allowance for duration of continuous work, - since the beginning of the next month.

1.4. Determination of the size of the salary is carried out in all cases separately on the main position and in case of part-time job.

2. Procedure for determination of official pay rates of workers

2.1. The sizes of official pay rates (wage rates, the tariff charges) employees of Service of foreign intelligence of Ukraine are determined by job grades and coefficients on compensation of employees of Service of foreign intelligence of Ukraine (appendix 1) and to schemes of job grades (appendices 2-8) taking into account indicators and procedure for reference of divisions of Service of foreign intelligence of Ukraine to groups on compensation of leading employees (appendix 9).

2.2. Official pay rates of deputy managers of divisions of Service of foreign intelligence of Ukraine are established for 5-15 percent, - is 30-40 percent lower than assistants to heads, than the official pay rate of the corresponding head determined by the schemes of job grades approved by the order of the Chairman of Service of foreign intelligence of Ukraine.

2.3. Calculation taking into account increases in official pay rates (wage rates) determined by schemes of job grades of positions (professions) is performed in such procedure:

to workers who have the right to increase in official pay rates (wage rates) as a percentage official pay rates (wage rates) increase by increase percent, i.e. the new official pay rate (wage rate) is established;

in case workers have the right to increase in official pay rates (wage rates) as a percentage at the same time on several bases provided by work payment terms, the absolute amount of each increase is determined, proceeding from the size of official pay rate (wage rate), without other increase. The amount of these increases is applied;

in case official pay rates (wage rates) according to payment terms of work are paid to workers in the increased sizes, allowances and surcharges which are provided as a percentage are calculated from the neogenic, i.e. raised official pay rates (wage rates).

3. Allowances and surcharges

3.1. To workers are established:

1) allowances:

a) at the rate to 50 percent of official pay rate (wage rate, the tariff charge):

for high achievements in work;

for accomplishment of especially important work (for the term of its accomplishment);

for complexity, intensity in work.

The extreme size of the specified allowances for one worker shall not exceed 50 percent of official pay rate.

In case of untimely task performance, quality degradation of work and violation of labor discipline these allowances are cancelled or decrease;

b) for honorary titles of Ukraine, the USSR, the federal republics of the USSR "national" - in the amount of 40 percent, "deserved" - 20 percent of official pay rate (wage rate);

c) for sports ranks "honored trainer", "Honoured Master of Sports" - in the amount of 20 percent, "world class master of sports" - 15 percent, "Master of Sports" - 10 percent of official pay rate (wage rate).

Allowances for honorary and sports titles are established to workers if their activities for profile match available honorary or sports title. In the presence of two or more ranks of the allowance about one (highest) rank is established. Compliance of honorary or sports title to profile of activities of the worker on post is determined by the division managers of Service of foreign intelligence of Ukraine authorized by the Chairman of Service of foreign intelligence of Ukraine;

d) for knowledge and use in work of foreign language: one European - 10, one east, vengro-Finnish or African - 15, two and more languages - 25 percent of official pay rate (wage rate).

The allowance is not established to workers for whom requirements for holding the post provide knowledge of foreign language that is supported by the relevant document;

2) surcharges:

a) at the rate to 50 percent of official pay rate (tariff charge):

for accomplishment of obligations of temporarily absent workers;

for combination of professions (positions);

for expansion of zone of servicing or increase in amount of the performed works.

The specified types of surcharges are not established to division managers of Service of foreign intelligence of Ukraine and their deputies;

b) at the rate to 40 percent of the hour tariff charge (official pay rate) for work at night if higher size is not determined by the legislation, for each working hours from 10 o'clock in the evening to 6 o'clock in the morning.

The list of positions and divisions in which for work the specified surcharge is performed affirms the Chairman of Service of foreign intelligence of Ukraine in coordination with trade-union committee. It is not subject to annual reapproval, and in need of it changes and additions in the same procedure can be made;

c) for academic status:

professors - in extreme size of 33 percent of official pay rate (wage rate);

the associate professor, the senior research associate - in extreme size of 25 percent of official pay rate (wage rate).

The specified surcharge is established to workers if their activities for profile match available academic status. In the presence at the specified workers of two or more academic statuses surcharge is established on one (highest) rank;

d) for scientific degree:

doctors of science - in extreme size of 25 percent of official pay rate (wage rate);

the candidate of science - in extreme size of 15 percent of official pay rate (wage rate).

The specified surcharges are established to workers if their activities for profile match available scientific degree. In the presence at the specified workers of two scientific degrees surcharge is established on one (highest) scientific degree.

Compliance of academic status and scientific degree to profile of activities of the worker on post is determined by the division managers of Service of foreign intelligence of Ukraine authorized by the Chairman of Service of foreign intelligence of Ukraine.

The documents certifying availability of scientific degree and academic status shall meet regulations and the requirements, stipulated by the legislation;

ґ) for use in work of disinfectants (including to junior nurses), and also to workers who are busy with cleaning of toilets, - in the amount of 10 percent of official (monthly) pay rate;

e) for support of permanent combat readiness of troops (forces) at the rate to 50 percent of official pay rate (wage rate, the tariff charge).

The specified surcharge is established on principle place of employment (on main occupation (position)) the worker taking into account its contribution to results of work of division.

In case of inadequate accomplishment by the worker of the job responsibilities, violation of labor discipline, requirements of safe engineering, labor protection and so forth the amount of surcharge in month in which there were specified violations can be reduced or it can not be paid. The decision on reduction to the worker of the amount of surcharge or its nonpayment in specific month is drawn up by the order of the Chairman of Service of foreign intelligence of Ukraine, his deputies, the rector of Institute of Service of foreign intelligence of Ukraine or chiefs 7, of 8 and 9 services 4 managements 2 departments according to distribution of functional obligations based on the motivated official report of the division manager in which the worker works;

3) to drivers of vehicles:

allowances for classiness to drivers of the II class - 10 percent; to drivers of the I class - 25 percent of the established tariff charge for worked time;

surcharges for irregular working hours - in the amount of 25 percent of the tariff charge for worked time.

3.2. One-time remuneration in the amount of 50 percent of official pay rate within the salary fund is paid to the workers awarded with the Certificate of honor of the Cabinet of Ministers of Ukraine according to the decision of the Chairman of Service of foreign intelligence of Ukraine.

4. Payment procedure of work of workers of medical institutions (divisions) of Service of foreign intelligence of Ukraine

4.1. This Section determines procedure for calculation of the salary of workers of medical institutions (divisions) for Service of foreign intelligence of Ukraine, and also workers who are allowed in accordance with the established procedure to medical and pharmaceutical activities.

4.2. In states which part health and pharmaceutical workers are the name of position "doctor" is supplemented with the name of medical specialty on which the worker received the corresponding preparation and works on profession profile. For example: "therapist", "cardiologist".

4.3. Official pay rates (tariff charges) are determined by job grades of the Single scale of charges which are established to professionals, specialists depending on available qualification category based on certification and displayed in the tariff list.

4.4. For carrying out work on determination of official pay rates and the sizes of allowances of health and pharmaceutical workers as the order of the Chairman of Service of foreign intelligence of Ukraine the permanent tariff commission is created.

By results of work of the tariff commission the tariff list of workers is annually constituted (appendix 10) which is signed by all members of the commission and the Chairman of Service of foreign intelligence of Ukraine claims.

In case of ustraivaniye for work of health and pharmaceutical workers after approval of the tariff list tariffing is carried out not later than three days after acceptance for work with the subsequent inclusion them to the tariff list.

The approved sizes of the salary appear the order of the Chairman of Service of foreign intelligence of Ukraine.

4.5. The next certification of persons who hold positions of health and pharmaceutical workers is performed based on the legislation on procedure for carrying out certification of doctors, pharmacists, average medical and pharmaceutical personnel.

4.6. In case of determination of official pay rates of heads of institutions (divisions) of health care and their deputies - doctors (pharmacists) the sizes of their official pay rates cannot be lower than those which are provided by this Procedure for doctors (pharmacists) of division managers, and in case of absence in institutions of divisions - not below the official pay rates provided for doctors (pharmacists) of the corresponding qualification.

4.7. The amount of surcharges to workers of medical institutions (divisions) of Service of foreign intelligence of Ukraine for work at night, combination of positions (professions) and other payments is determined by the orders of the Chairman of Service of foreign intelligence of Ukraine, his deputies, the rector of Institute of Service of foreign intelligence of Ukraine or chiefs 7, 8 or 9 services 4 managements 2 departments issued based on motivated official reports of the corresponding heads of medical institutions (divisions) of Service of foreign intelligence of Ukraine for the account and within the salary fund.

4.8. Procedure for determination of education

4.8.1. Education of health and pharmaceutical workers, and also the workers allowed in accordance with the established procedure to medical and pharmaceutical activities is established in case of the conclusion with them the employment contract based on diplomas, certificates, certificates, certificates about the termination of educational institutions according to the List of the highest and average special educational institutions, preparation and receipt of rank in which grant the right to be engaged in medical and pharmaceutical activities, to No. 195 approved by the order of the Ministry of Health of Ukraine of 25.12.92 (with changes), or based on the certificates of education issued by the relevant educational institutions (rates) or archives.

4.8.2. Recovery of the lost education documents is performed according to the procedure, stipulated by the legislation.

4.9. Increase in official pay rates

4.9.1. To heads of institutions of health care, pharmaceutical institutions and their deputies from among doctors and pharmacists the official pay rate which answers job grade on group on compensation raises with qualification category in "the organization and management of health care" or "the organization and management of pharmacy":

to heads and their deputies (doctors, pharmacists) on specialties "organization and management of health care" and "organization and management of pharmacy" which have: the highest qualification category - on 44,9 of percent of the tariff charge of the worker of the I job grade; the first qualification category - on 31,9 of percent of the tariff charge of the worker of the I job grade; the second qualification category - on 24,1 of percent of the tariff charge of the worker of the I job grade;

to heads from among specialists with basic and incomplete higher medical education and to the chief nurses who have: the highest qualification category - on 28,3 of percent of the tariff charge of the worker of the I category; the first qualification category - on 18,4 of percent of the tariff charge of the worker of the I job grade; the second qualification category - on 8,7 of percent of the tariff charge of the worker of the I job grade.

In case of appointment of the doctor (pharmacist) to position of the head of institution of health care or its deputy from among doctors to it increase in official pay rate with qualification category on medical specialty which it had within three years from the date of appointment to executive position remains.
