About state regulation of production, turnover and consumption of tobacco raw materials and tobacco products

 For the purpose of strengthening of the state control of production, turnover and consumption of tobacco raw materials and tobacco products, production, turnover and use of electronic systems of smoking, liquids for electronic systems of smoking, systems for consumption of tobacco, creation of conditions for protection of public health, protection of economic interests of the state and according to part three of article 101 of the Constitution of the Republic of Belarus I decide:

1. Approve Regulations on state regulation of production, turnover and consumption of tobacco raw materials and tobacco products, productions, turnover and use of electronic systems of smoking, liquids for electronic systems of smoking, systems for consumption of tobacco it (is applied).

2. Determine that:

in case of production of the goods which are not tobacco products, electronic systems of smoking, systems for tobacco consumption, imitation of appearance of tobacco products and (or) use of names of types of tobacco products in names (additional names) of such goods and also wholesale, retail trade by such goods;

advertizing of liquids for electronic systems of smoking, except for the advertizing posted on the websites of their producers and importers in national segment of the global computer Internet;

rendering the free (sponsor's) aid in type of tobacco products, electronic systems of smoking, liquids for electronic systems of smoking, systems for tobacco consumption;

2.2. control is exercised for:

compliance with law, regulating production and turnover of tobacco products, turnover of tobacco raw materials, - the Ministry of Taxes and Tax Collection, inspectorates of the Ministry of Taxes and Tax Collection for areas, Minsk, areas, the cities and areas in the cities;

turnover of tobacco products, electronic systems of smoking, liquids for electronic systems of smoking, systems for tobacco consumption - the Ministry of anti-monopoly regulation and trade within control of compliance with law in the field of trade, public catering, consumer services, consumer protection, about advertizing, regional, city (including Minsk city), district executive committees, local administrations within control in the field of trade, public catering, consumer services of the population, consumer protection, advertizing activities.

3. On the websites of the organizations - tobacco product manufacturers, the organizations - customers of tobacco products and importers of tobacco products in national segment of the global computer Internet information on type and the name of tobacco product, its physical, chemical and other consumer properties, the name of the manufacturing organization (for the organizations - customers and importers of tobacco products), and also the image of consumer packaging of tobacco products is placed.

4. In the shops and pavilions having the floor space of 1000 and more sq.m since January 1, 2020 sale of tobacco products, electronic systems of smoking, liquids for electronic systems of smoking, systems for consumption of tobacco is performed through commodity departments which procedure for creation is determined by the Ministry of anti-monopoly regulation and trade.

5. Use for storage and sale of tobacco products in shops and pavilions of the equipment placed over control and cash nodes is forbidden since January 1, 2022.
