1. Approve the enclosed Rules of stay of foreign citizens in the Republic of Tajikistan and Rules of transit of foreign citizens through the territory of the Republic of Tajikistan.

2. Under the Government of the Republic of Tajikistan in accordance with the established procedure to provide to the Ministry of Foreign Affairs of the Republic of Tajikistan, the Ministry of Internal Affairs of the Republic of Tajikistan, the State committee of homeland security of the Republic of Tajikistan, Customs Service strict observance by the accepting organizations and foreign citizens of the rights and obligations provided by the laws of the Republic of Tajikistan and the specified Rules.

Rules of stay of foreign citizens in the Republic of Tajikistan

I. General provisions

1. These rules are developed according to the Constitution of the Republic of Tajikistan, the Law of the Republic of Tajikistan "About legal status of foreign citizens in the Republic of Tajikistan" and determine procedure:

a) entry into the Republic of Tajikistan and departure from the Republic of Tajikistan of foreign citizens;

b) document creation on the residence right in the Republic of Tajikistan to the foreign citizens who are temporarily staying in the Republic of Tajikistan;

c) issues to foreign citizens of permissions to permanent residence and residence permits in the Republic of Tajikistan;

d) movement of foreign citizens on the territory of the Republic of Tajikistan;

e) accountability for abuse of regulations of stay, prolongation and reducing terms of stay, and also expulsion from the Republic of Tajikistan of foreign citizens;

Action of these rules extends also to persons without citizenship if other does not follow from the legislation of the Republic of Tajikistan.

2. The foreign citizens who are temporarily staying in the Republic of Tajikistan live in hotels or other living space (irrespective of its belonging to these or those types of housing facilities) at the choice, with the notification of the accepting organizations, permanent foreign missions, and also persons who invited them to the Republic of Tajikistan on private affairs.

The accepting organizations and persons who invited foreign citizens within 10 working days make their registration in law-enforcement bodies at the place of residence of the foreign citizen.

In case of change by foreign citizens of the place of the residence, the accepting organizations and persons who invited them in three-day time notify law-enforcement bodies on change of the residence of foreigners.

Citizens of the states specified in appendix to these rules are exempted from registration of the established identity documents, in law-enforcement bodies according to the principle of reciprocity for the terms provided in the called appendix.

3. The foreign citizens who are in the Republic of Tajikistan shall have in case of themselves the valid foreign passports or documents replacing them registered according to the procedure, established by these rules and to show them upon the demand of representatives of competent authorities.

The foreign citizen shall report about loss of the foreign passport or the document replacing it to immediately accepting organization and person who invited him to the Republic of Tajikistan, and the last in law-enforcement bodies which issue the reference corresponding about it.

4. The accepting organizations provide timely explanation to foreign citizens of the rights and obligations provided by these rules, exact accomplishment of the established precepts of law in the relations with foreign citizens keep the corresponding account of foreign citizens, and also bear responsibility for timely document creation on the right of stay them in the Republic of Tajikistan, movements on the territory of the republic and on departure from the Republic of Tajikistan after the stay term determined by it.
