ORDER OF THE GOVERNMENT OF THE REPUBLIC OF MOLDOVA

About creation of the Automated information system "The state register of the bottled natural mineral water, drinking water and soft drinks"

(as amended on 11-02-2019)

For the purpose of gain of control of quality of the bottled natural mineral water, drinking water and the Government DECIDES: soft drinks

1. Create the Automated information system "The state register of the bottled natural mineral water, drinking water and soft drinks".

2. The customer of the Automated information system "The state register of the bottled natural mineral water, drinking water and soft drinks" is the Ministry of Health, work and social protection on behalf of subordinated organization - the National agency of public health, and general podryadchikomministerstvo of information development and organizations subordinated to it.

3. Approve:

Sanitary standards of use and sale of natural mineral waters according to appendix No. 1;

Sanitary standards on quality of drinking water according to appendix No. 2;

Regulations on soft drinks according to appendix No. 3;

Regulations on medicinal mineral waters according to appendix No. 4;

The form for information representation about turnover of the bottled natural mineral water, drinking water and soft drinks of local production and imported according to appendix No. 5.

4. Assign to the Ministry of information development and the National agency of public health development and deployment till October 1, 2007. Automated information system "The state register of the bottled natural mineral water, drinking water and soft drinks".

To the national agency of public health, and also the Ministry of information technologies and communications and the companies subordinated to it to develop and implement till January 10, 2010 changes in the mechanism of monitoring of quality of the bottled natural mineral water, drinking water and soft drinks by means of the www.moldapa.md web page.

9. Equip the National agency of public health with the following functions:

maintaining the Automated information system "The state register of the bottled natural mineral water, drinking water and soft drinks";

administration of the www.moldapa.md web page intended for information collection about the bottled natural mineral water, drinking water and soft drinks which turnover will take place in the market of the Republic of Moldova;

ensuring forming of the state information resources of accounting of sources of natural mineral water and the drinking water, turnover made, exported and the imported bottled natural mineral water, drinking water and soft drinks;

collection, accumulating, updating and data analysis about the economic agents who obtained licenses for mining and (or) production and pouring of mineral and natural drinking waters, sanitary authorizations for functioning in the field of production of the bottled natural mineral water, drinking water and soft drinks (accounting of the companies);

ensuring objectivity of results of checks of sources of mineral water, companies for pouring of natural mineral water and drinking water, to production and bottling of soft drinks;

provision of complete and reliable information to authorized bodies of public management according to the basic principles of creation of automated information system "The state register of the bottled natural mineral water, drinking water and soft drinks";

obtaining from physical persons and legal entities which make is imported or exported and place in the market the bottled natural mineral water, drinking water and soft drinks, information on turnover of the specified products.

Physical persons and legal entities which make or import and place butylated natural mineral water, drinking water and soft drinks in the market, provide to the National agency of public health information on turnover of the bottled natural mineral water, drinking water and soft drinks according to the form provided by appendix No. 5. Physical persons and legal entities which make butylated natural mineral water drinking water and soft drinks provide information once in 10 days, and importers of the this products after each import transaction.

13. To impose control over the implementation of this resolution on the Ministry of Health, work and social protection.

Appendix №2

to the Order of the Government of the Republic of Moldova of August 15, 2007 No. 934

Sanitary standards on quality of drinking water

I. General provisions

This Regulations regulate quality of drinking water for the purpose of protection of human health by exception of any type of infection of drinking water and ensuring quality of net and useful water with it.

2. The concepts used in this Regulations mean the following:

2.1. Drinking water is understood as the water intended for consumption by the person namely:

a) any type of water - natural or after processing, used for drink, cooking or in other house purposes, irrespective of its origin and from that, arrives it from distribution network, source, the reservoir or is poured in bottles or in other reservoirs;

b) the water of all types used in the food industry for production, processing, conservation or sales of products or substances intended for consumption by the person, except as specified, when the Ministry of Health, work and social protection and the Ministry of Agriculture and the food industry resolve use of water in the technological purposes if it is proved that the used water does not influence quality and purity of foodstuff in their final form;

c) water from local sources, such as wells, springs, etc., used for drink, cooking or in other house purposes. The Ministry of Health, work and social protection can make departure from values of parameters of quality, but without threat for human health.

2.2. Understand set of the pipelines, armature and equipment established between cranes for the water which is usually used for consumption by the person, and external distribution network but only in cases when it does not belong to duties of the supplier of water as the vendor and/or the supplier of water according to the current legislation as distributive system or internal installation.

3. This Regulations are not applied to:

a) to the natural mineral waters recognized by those competent authorities according to the current legislation;

b) to the medicinal drinking waters having the declared medicinal properties according to the law, resolutions and administrative actions extending to pharmaceutical products.

3.1. Exception from this Regulations is:

a) the water intended only for special use in cases when the Ministry of Health, work and social protection approves its use and quality, which is not making direct or indirect impact on health of consumers for whom it is made;

b) the drinking water arriving from the individual vendor of water delivering on average less than 5 m3 a day or servicing less than 50 people, except as specified, when production of water is part of business or state activity.

3.2. In these cases the territorial advanced centers of public health inform the population on these exceptions and on measures for protection of human health which should be undertaken in case of pollution of the water intended for consumption by the person. In cases when it is determined that quality of water can pose potential hazard for health, to the population the corresponding recommendations according to Sanitary standards and rules about supervision and monitoring of quality of drinking water shall be made.

II. Conditions of quality of drinking water

4. Drinking water shall be useful and net and answer the following conditions:

a) not contain microorganisms, parasites or substances which by the quantities or concentration can constitute potential danger for human health;

b) meet the minimum requirements provided in tables 1 A, 1 V and 2 appendices N1 to this Regulations;

c) observe provisions Article 5-8 and 10 of this Regulations.

5. Application of this Regulations shall not influence decrease in real quality of drinking water which can affect human health, or increase in level of pollution of the water used for production of drinking water directly or indirectly.

6. Quality of the drinking water intended for consumption by the person shall correspond to the values established for the parameters provided in the appendix N1 to this Regulations. As for the parameters provided in the table 3 of application N 1, of their value are installed for the purpose of quality evaluation of drinking water in programs of monitoring and for accomplishment of the obligations provided in Item of 8 this Regulations.

7. The Ministry of Health, work and social protection approves values of the additional parameters which are not included in appendix N 1, if it is necessary for protection of human health. These values shall meet requirements of the subitem and) item 4 of this Regulations

8. Quality of drinking water is corresponding in that case when the qualities of value established for parameters correspond to the appendix N1 to this Regulations in the following sampling points:

a) on output from the consumer's crane, in point of entry to the building and at street distribution columns in case of water inflow from distributive system;

b) in case drinking water is delivered in tanks in exit point from them;

c) in point in which water arrives in bottles or containers, in cases of butylated drinking water;

d) in point of selection of water for use in production process at the companies for production of food.

9. If in the cases provided in the subitem and) Item 4, mismatch of the parametrical values established according to the appendix N1 to this Regulations because of internal distributive system or ee contents came to light, it is considered that obligations of the vendor, and also the supplier were fulfilled, except as specified, when water is delivered directly to consumers, and the vendor and the supplier are responsible also for content of internal networks.

10. In the case provided in Item of 9 this Regulations arrive as follows:

a) vendors and suppliers of drinking water notify bodies of local public authority and/or owners on measures for recovery and content of network or the equipment for water processing which should be accepted for the purpose of decrease or elimination of risk of mismatch of parametrical values of quality of drinking water, along with informing territorial authorities of the National agency of public health (further - Gossanepidnadzor);

b) territorial authorities of Gossanepidnadzor inform consumers on additional measures which should be accepted in case of need, for warning of diseases.

III. Supervision and monitoring

11. Monitoring of quality of drinking water is provided with the vendor, the supplier and bodies of Gossanepidnadzor.

12. Vendors and suppliers of drinking water provide compliance of parameters of quality, financing of auditor monitoring and quality control of drinking water.

13. The territorial service of the state supervision of public health provides supervision and monitoring of quality of drinking water to be convinced that the water arriving to the consumer meets quality requirements and does not constitute potential danger for human health.
