Rules of the direction of funds (part of means) of the maternity (family) capital for education by child(children) and implementation of other expenses connected with education by child(children)

1. These rules establish procedure and terms of the direction of means (part of means) of the maternity (family) capital (further - means) on education by child(children) in any organization in the territory of the Russian Federation having the right to rendering the corresponding educational services (further - the organization), at the individual entrepreneurs performing educational activities according to the Federal Law "About Education in the Russian Federation" based on the license for implementation of educational activities (further - the individual entrepreneur), and also on other expenses connected with education by child(children) and determine procedure for submission of the documents necessary for the direction of funds for the specified purposes.

2. Funds can be allocated:

on payment of paid educational services;

on payment of other expenses connected with education provided by Items 6 and 8 (1) these rules.

3. The order the funds allocated for education by child(children) in the organization or at the individual entrepreneur is performed by person who received in accordance with the established procedure the state certificate on the maternity (family) capital (further the certificate), by giving in territorial authority of Fund of pension and social insurance of the Russian Federation of the statement for the order means.

The persons who received the certificate, left on the permanent residence of the territory of the Russian Federation and not taking confirmed with registration residences and places of stay in the territory of the Russian Federation submit the application for the order means directly to Fund of pension and social insurance of the Russian Federation.

4. Funds are allocated for payment rendered by the organization or the individual entrepreneur of paid educational services by territorial authority of Fund of pension and social insurance of the Russian Federation according to the agreement on rendering paid educational services signed by person who received the certificate and the organization or the individual entrepreneur by non-cash transfer to the account (personal account) of the organization or the individual entrepreneur specified in the agreement on rendering paid educational services.

5. In case of the direction of funds for payment of the paid educational services rendered by the organization person who received the certificate along with the statement for the order means represents the agreement on rendering paid educational services (the copy of the agreement certified by the specified organization).

In the presence of the agreement on information exchange signed between the organization and territorial authority of Fund of pension and social insurance of the Russian Federation, person who received the certificate specifies in the statement for the order means of the data, provided by the agreement on rendering paid educational services.

In the case specified in the paragraph the second this Item, Fund of pension and social insurance of the Russian Federation, its territorial authorities send inquiry of data concerning the data provided in the agreement on rendering the paid educational services necessary for decision on satisfaction (refusal in satisfaction) statements for the order means, to the organization with which the relevant agreement on information exchange is signed.

6. Funds can be allocated for payment of use of premises and utilities in the hostel provided by the organization by the student for training.

7. In case of the direction of funds for payment of use of premises and utilities in the hostel to the application for the order means enclose the following documents:

a) the employment contract of premises in the hostel (with indication of the amount and terms of introduction of payment);

b) the reference from the organization confirming the fact of accommodation of child(children) in the hostel.

8. Funds are allocated for payment of use of premises and utilities in the hostel by territorial authority of Fund of pension and social insurance of the Russian Federation according to the employment contract of premises in the hostel by non-cash transfer to accounts (personal accounts) of the organizations specified in the employment contract of premises in the hostel.

8(1). Funds can be allocated for payment of content of child(children) and (or) supervision and child care (children) in the organization or at the individual entrepreneur, realizing educational programs of preschool education and (or) educational programs of the primary general, main general and secondary general education.

8(2). In case of the direction of funds for payment of content of child(children) and (or) supervision and child care (children) in the organization or at the individual entrepreneur, realizing educational programs of preschool education and (or) educational programs of the primary general, main general and secondary general education, to the application for the order means enclose the contract between the organization or the individual entrepreneur and person who received the certificate including obligations of the organization or the individual entrepreneur on content of child(children) and (or) supervision and child care (children) in the organization or at the individual entrepreneur and calculation of the size there are payments for content of child(children) and (or) supervision and child care (children) in the organization or at the individual entrepreneur.
