According to the subitem 4 of item 4 of the Regulations on Head department of public service of Ukraine approved by the resolution the Cabinet of Ministers of Ukraine of 26.09.2007 of N 1180, for the purpose of proper application of the legislation concerning procedure for calculation of years of service of public service of former employees and faces of the private and the commanding structure of law-enforcement bodies which are in public service, PRIKAZYVAYEM:

1. Approve the Technique concerning transfer (inclusion) in years of service of public service of the periods of work (service) of former employees and faces of the private and the commanding structure of law-enforcement bodies which is applied.

2. Of Ukraine to provide to Glavgossluzhbe explanations concerning transfer (inclusion) in years of service of public service of the periods of work (service) of former employees and faces of the private and the commanding structure of law-enforcement bodies.

3. To submit to legal management of Glavgossluzhby of Ukraine this order on state registration to the Ministry of Justice of Ukraine in the procedure established by the legislation.

Technique concerning transfer (inclusion) in years of service of public service of the periods of work (service) of former employees and faces of the private and the commanding structure of law-enforcement bodies

1. General provisions

1.1. The technique concerning transfer (inclusion) in years of service of public service of the periods of work (service) of former employees and faces of the private and the commanding structure of law-enforcement bodies (further the Technique) is developed according to the Laws of Ukraine "About public service", "About general structure and number of the Ministry of Internal Affairs of Ukraine", "About militia", the Procedure for calculation of years of service of public service approved by the resolution of the Cabinet of Ministers of Ukraine of 03.05.94 of N283 (further - the Procedure), other regulatory legal acts, for the purpose of provision of the practical employee assistance of personnel services concerning procedure for calculation of years of service of public service to the former faces of the private and the commanding structure and employees of law-enforcement bodies which are in public service.

1.2. Years of service of public service of former employees and faces of the private and the commanding structure of law-enforcement bodies which are in public service are calculated according to Procedure.

1.3. The years of service of public service calculated according to Procedure are applied according to Item 5 of the resolution of the Cabinet of Ministers of Ukraine of 03.05.94 of N283 to establishment by the government employee (in this case to the former faces of the private and the commanding structure and employees of law-enforcement bodies which are in public service) length-of-service allowances, provisions of additional paid leaves and award of pension according to article 37 of the Law of Ukraine "About public service".

1.4. Documents for transfer (inclusion) in years of service of public service of the period of work (service) in law-enforcement bodies are the service record, the copy of the record of service from the personal record of face of the private and the commanding structure and, in case of impossibility based on the filed documents of calculation of years of service, - also the reference of personnel service of law-enforcement body in which worked the former employee or face of the private and the commanding structure of law-enforcement bodies, including other documents which according to the current legislation confirm length of service (served). In case of reorganization of law-enforcement body, such reference is issued by body, being his legal successor, and in case of liquidation the organaspravka is issued by the Industry Public Records Office Ministry of Internal Affairs of Ukraine or its bodies on places.
