2.1. Provide submission of this order in accordance with the established procedure on state registration in the Ministry of Justice of Ukraine.

1.1. These Rules establish the main requirements to civil courts of all types and assignments concerning the prevention of pollution of inland waterways of Ukraine (further - VVPU) oil, hazardous substances, remaining balance of dangerous chemicals which are transported by bulk and in packaging, oil-containing, drain waters and garbage.
1.2. Action of these Rules extends to vessels irrespective of patterns of ownership which are on VVPU in operation, under repair, process of upgrade or construction.
1.3. Normative references
In case of development of these Rules the following regulatory legal acts were used:
Water code of Ukraine;
The law of Ukraine "About transportation of dangerous goods";
The regulations on the state sanitary and epidemiological surveillance approved by the resolution of the Cabinet of Ministers of Ukraine of 22.06.99 of N1109.
1.4. Terms and reducings
The terms used in these Rules are used in the following values:
the ballast contaminated - ballast water mix (with oil or other pollutants) which is formed in the crude ship tanks (petrotanks) after acceptance of water-ballast in them;
VVPU - the navigable waters passing across water areas of the rivers, lakes, water storage basins and belonging to the category of inland waterways of Ukraine;
segregated ballast - the ballast water accepted in the tank which is completely separated cargo and fuel systems and is intended only for transportation of ballast waters;
the incinerator - the ship burning unit of solid and liquid domestic and production wastes;
reception facility - inshore or floating facility for acceptance from courts of any kinds of pollution for the purpose of their transfer on cleaning, utilization, destruction, etc.
The shipping register of Ukraine (further - the Register) - national classification society which belongs to the sphere of management of the Ministry of Transport and Communications of Ukraine;
PROGRAM STATUS WORD - vessels of the swimming mixed "river sea".
2.1. Requirements of these Rules are obligatory for captains, crews and passengers of all courts, including small ships, managements and personnel of shipping companies, ports, industrial enterprises, technical sections of waterways, shipping hydraulic engineering constructions, subjects of river transport which activities are connected with operation and servicing of courts of river fleet on VVPU, their repair, upgrade, and also project development and construction of new courts.
2.2. Actionees of complex of organizational and technical actions for the prevention of pollution of VVPU from the vessel are his captain, the commander, the skipper (further - the captain).
The captain answers for:
explanation to crew and realization on the vessel of the requirements concerning the prevention of pollution of VVPU;
observance of provisions of these Rules, other regulatory legal acts on protection of the surrounding environment;
publication of the relevant orders;
check of knowledge by crew of operation of ship technical means and procedures concerning providing the prevention of pollution of VVPU.
The captain makes decisions concerning protection of the VVPU water circle against pollution by the ship-generated garbage and dumpings.
The ship master shall inform the shipowner on materiel failures and operating disturbances which can entail pollution of VVPU and require assistance of the shipowner for their elimination.
The boat team shall be guided by these Rules, instructions, orders of the captain concerning providing nature protection requirements, to treat responsibly the tasks concerning the prevention of pollution of the water circle.
2.3. Control over the implementation of requirements of these Rules in courts is exercised by territorial subdivisions of specially authorized state bodies:
The main state inspectorate of Ukraine for safety of navigation of the Ministry of Transport and Communications of Ukraine (except the fleet of fish industry, naval vessels of armed forces and courts of the State Border Service);
The state inspectorate for safety of navigation of the State committee of fishery of Ukraine - as for the fleet of fish industry;
State ecological inspection of the Ministry of protection of the surrounding environment of Ukraine;
The main sanitary and epidemiologic management of the Ministry of Health of Ukraine (The public sanitary and epidemiologic service on water transport).
2.4. Authorized officers of specially authorized state bodies have the right:
stop, visit and inspect vessels and other floating crafts for the purpose of clarification of the reasons and circumstances of dumping or loss of substances, unhealthy people and the VVPU live resources, and mixes which contain these substances over the established regulations, to perform correctness of registration in ship's papers of transactions with these substances and mixes, and also to give instructions about elimination of the revealed violations.
The ship master shall promote accomplishment of control functions by the above-stated service employees.
2.5. The organization of fulfillment of requirements of these Rules and complex of the organizational and technical actions directed to the prevention of pollution from ship is assigned to the shipowner.
3.1. The technical advice behind inland navigation vessels and the nature protection equipment installed on them performs the Register, behind courts of the swimming mixed "river sea" - the classification society elected by the shipowner.
3.2. Frequency of survey of the equipment, the systems, devices and devices intended for the prevention of pollution of VVPU from courts is established according to the requirements of the Register provided by the Regulations on the Shipping register of Ukraine approved by the resolution of the Cabinet of Ministers of Ukraine of 08.06.98 of N 814, and the international documents ratified by Ukraine, rather technical instructions for inland navigation vessels.
The ship master shall observe the specified terms and beforehand prepare the nature protection equipment for the next survey, and also declare all accidents, incapacitation or replacement of the equipment which arose during the period after implementation of the last survey by classification society.
3.3. Direct supervision of technical condition of the nature protection equipment of inland navigation vessels, fuel replenishment tankers, courts collectors, treatment floating plants and the correct operation, servicing, repair is provided by technical services which are created by management of the shipowner taking into account tasks and specifics of the company (shipping company, port, the technical site of way, industrial enterprise).
4.1. Vessels and all other watercrafts (further - vessels) which are operated on VVPU, shall be equipped with systems and tanks for collection and accumulation oil-containing and drain waters, and also variable trash bins.
In courts less than 25 m long and courts with total power of all internal combustion engines less than 220 kW it is allowed to accumulate oily (podslanevy) waters in engine-room hold.
4.2. On VVPU from the courts of oil, hazardous substances, remaining balance of load, garbage contaminated and normative purified waters are not resolved dumping. Exception is the isolated water-ballast, procedures of acceptance and which dumping are determined by subitem 4.10 and Section 8 of these Rules.
4.3. 4.4. Depending on type and purpose of the vessel, and also type of pollutants of transaction of delivery of ship-generated liquid and solid wastes are registered:
in special magazines:
1) oil record book;
part I - Transactions in the engine-room (for all courts);
part II - Cargo and ballast operations (for tankers);
2) cargo record book - for vessels which transport hazardous liquid substances in bulk;
in machine, ship or dispatching magazines with obligatory specifying:
1) pollutant type;
2) transaction essences;
3) time of the beginning and end of transaction;
4) coordinates or name of port of carrying out transaction;
5) quantities of hazardous substances which was processed, into CBM;
6) numbers or designations of ship cargo, fuel, lubricant and other tanks according to the technical documentation which is available on the vessel.
The ship master shall receive from the operator of port reception facilities or from the ship master accepting ship-generated liquid and solid wastes, the receipt or the reference where the number of the overloaded waste is specified. Receipts or references are stored onboard the vessel which hands over waste, together with the magazine of registration of transactions with ship-generated liquid and solid wastes within two years.
The requirements stated above extend to all passenger carriers; not passenger self propelled vessels with capacity of propulsion unit of 55 kW and more (except small ships); self and dumb boats with a gross tonnage of 80 register tons (further - the register. r) more; means of floating mechanization, technical fleet, stoical fleet (maintenance barges, bunkerbaza, guardships, floating restaurants).
4.5. Transactions with oil in courts of the swimming mixed "river sea" (further - SSP) - oil tankers with a gross tonnage of 150 the register. t and more, dry cargo vessels with a gross tonnage of 400 register. t are subject to logging of oil operations also more which have the international certificate about the prevention of pollution by oil.
4.6. Transactions with oil on inland navigation vessels, cabotage SSP, vessels of the technical, port and office and auxiliary fleet are subject to logging of oil operations (part 1) or in the engineer's, ship or dispatching log.
