About approval of the Regulations on the Ministry of protection of the surrounding environment of Ukraine

Cabinet of Ministers of Ukraine decides:

1. Approve Regulations on the Ministry of protection of the surrounding environment of Ukraine which are applied.

2. To the ministry of protection of the surrounding environment of Ukraine:

submit in three-months time proposals on reduction of acts of the Cabinet of Ministers of Ukraine in compliance with this resolution;

bring own regulatory legal acts into accord with this resolution.

3. This resolution becomes effective since November 20, 2006.

Regulations on the Ministry of protection of the surrounding environment of Ukraine

1. The ministry of protection of the surrounding environment of Ukraine (Ministry for Protection of the Environment and Natural Resources) is the central executive body which activities go and coordinated by the Cabinet of Ministers of Ukraine.

Ministry for Protection of the Environment and Natural Resources is the main (leader) body in system of the central executive bodies concerning protection of the surrounding environment, rational use, reproduction and protection of natural resources, implementation of the state control of use and protection of lands, ecological safety, reserved case, the address with waste, forming, preserving and uses of ecological network, geological studying and ensuring rational use of subsoil.

2. Ministry for Protection of the Environment and Natural Resources in the activities is guided by the Constitution and the laws of Ukraine, and also the presidential decrees of Ukraine and resolutions of the Verkhovna Rada of Ukraine adopted according to the Constitution and the laws of Ukraine, acts of the Cabinet of Ministers of Ukraine, this Provision.

3. The main objectives of Ministry for Protection of the Environment and Natural Resources are:

ensuring realization of state policy in the sphere of protection of the surrounding environment, rational use, reproduction and protection of natural resources (the earth, subsoil, surface and underground water, atmospheric air, the woods, animal and flora and natural resources of territorial waters, the continental shelf and special (sea) economic zone of Ukraine), the address with waste (except the treatment of radioactive waste), dangerous chemicals, pesticides and agrochemicals, ecological and in limits of the competence of radiation safety, development of mineral resources, reserved case, forming, preserving and uses of ecological network, geological studying of subsoil;

implementation of management and regulation in the sphere of protection of the surrounding environment, rational use, reproduction and protection of natural resources, geological studying of subsoil, providing ecological and in limits of the competence of radiation safety, the organization of protection and use of the territories and objects of natural and reserved fund of Ukraine, forming, preserving and use of ecological network;

implementation of the state control of observance of requirements of the legislation on protection of the surrounding environment, rational use, reproduction and protection of natural resources, in particular behind use and protection of lands, ecological and in limits of the competence of radiation safety, protection and use of the territories and objects of natural and reserved fund, forming, preserving and use of ecological network, concerning the address with waste (except the treatment of radioactive waste), dangerous chemicals, pesticides and agrochemicals, and also ensuring implementation of the state geological control.

4. Ministry for Protection of the Environment and Natural Resources according to the tasks assigned to it:

1) prepares offers on forming of state policy in the sphere of protection of the surrounding environment, rational use, reproduction and protection of natural resources, the address with waste (except the treatment of radioactive waste), dangerous chemicals, pesticides and agrochemicals, ecological and in limits of the competence of radiation safety, reserved case, forming, preserving and use of ecological network, geological studying of subsoil;

2) takes part in project development of the State program of economic and social development of Ukraine, the Government budget of Ukraine, the Program of activities of the Cabinet of Ministers of Ukraine;

3) according to the legislation forming of national ecological network, providing ecological and in limits of the competence of radiation safety, rational use, reproduction and protection of natural resources, geological studying and rational use of subsoil provides development and accomplishment of state programs concerning protection of the surrounding environment, renders assistance to development of regional programs for the specified questions and coordinates their accomplishment;

4) takes part in limits of the powers in implementation of actions for adaptation of the legislation of Ukraine to the European Union law;

5) forming, preserving and use of ecological network, geological studying of subsoil realizes single scientific and technical policy in the sphere of protection of the surrounding environment, rational use, reproduction and protection of natural resources, ecological and in limits of the competence of radiation safety, reserved case, takes part in forming of national system of scientific and technical information, acts as the customer of research works on the questions which are within its competence;

6) is coordinated by implementation by executive bodies of actions for the questions which are within the competence of Ministry for Protection of the Environment and Natural Resources;

Organizes 7) according to the legislation and carries out the state environmental assessment, examination of programs, plans and projects on geological studying of subsoil;

8) organizes carrying out monitoring of the surrounding environment, the geological circle and mineral resources in limits of the powers, provides forming and functioning of ecological, geological and other information systems;

9) is provided by maintaining the state inventories of plant and animal life, takes part in maintaining the state water inventory;

10) provides maintaining the state stock balance of minerals, the state inventories of fields and shows of minerals, forming of the State fund of mineral deposits of Ukraine and the State fund of subsoil, conducting state examination and assessment of inventories of minerals, transfer of the reconnoitered mineral deposits for industrial development;
