About measures for improvement of maintaining hunting economy in the territory of the Republic of Tajikistan

For the purpose of streamlining of hunting and improvement of maintaining hunting economy in the territory of the Republic of Tajikistan, the Government of the Republic of Tajikistan decides:

1. Approve the enclosed Regulations on hunting and hunting economy in the territory of the Republic of Tajikistan.

2. Resolve Forestry and landscape production association of the Republic of Tajikistan acquisition of hunting weapon, ammunition and hunting equipment for the state forest protection, employees of hunting farms, reserves, customers, societies of hunters and fishers according to the legislation of the Republic of Tajikistan.

4. Recognize invalid the resolution of Council of Ministers of the Tajik SSR of December 31, 1975 as No. 360 "About streamlining of hunting and hunting economy in the Tajik SSR" and the resolution of Council of Ministers of the Republic of Tajikistan of June 14, 1994 No. 340 "About responsibility for causing damage illegal getting of objects of fauna".

To the ministry of conservation of the Republic of Tajikistan together with Forestry and landscape production association of the Republic of Tajikistan to bring "Regulations on hunting and hunting economy in the territory of the Republic of Tajikistan" to data of the interested ministries, departments, the organizations, the companies, hukumat of areas, the cities and areas.

Regulations on hunting and hunting economy in the territory of the Republic of Tajikistan

1. General provisions

1.1. The hunting economy of the Republic of Tajikistan is industry of the national economy which task includes protection and reproduction of wild animals and birds, rational use of the state hunting fund, and also increase in productivity of hunting grounds.

1.2. Hunting tracing for the purpose of production, prosecution and production of the wild animals and birds who are in condition of natural freedom is recognized.

Stay in hunting grounds with firearms, traps and other tools of hunting, and also with dogs and hunting birds, or with the got products of hunting is equated to hunting production.

1.3. Hunting grounds are the land and water areas (except lands of settlements) which serve as the habitat of wild animals and birds or can be used for maintaining hunting economy. They are subdivided into grounds:

- assigned to the state, public and cooperative entities, organizations and the organizations for maintaining hunting economy;

- not assigned to users;

- closed for hunting (zones around settlements and industrial centers, the place of mass rest, resort and green areas, reserves);

- wildlife areas and national parks where the mode of maintaining hunting economy is regulated by regulations on them.

1.4. The common directorship behind maintaining hunting economy in the Republic of Tajikistan is performed by Forestry and landscape production association of the Republic of Tajikistan.

1.5 The state control of maintaining hunting economy and observance of rules and terms of hunting for the territories of the Republic of Tajikistan is performed by the Ministry of conservation of the Republic of Tajikistan and Forestry and landscape production association of the Republic of Tajikistan.

1.6. The state accounting of number of wild animals and birds in the territory of the Republic of Tajikistan is carried out every three years using aircraft and other accounting methods by the organizational working group into which representatives of the Ministry of conservation of the Republic of Tajikistan, Forestry and landscape production association of the Republic of Tajikistan, Academy of Sciences of the Republic of Tajikistan, societies of hunters and fishers of the Republic of Tajikistan and other interested organizations enter.

1.7. The wild animals and birds belonging to subjects to hunting, living in the territory of the republic in condition of natural freedom, and also acclimatized and reakklimatizirovanny in hunting grounds, constitute the state hunting fund.

Protection, reproduction and use of the state hunting fund in the republic is regulated by the legislation of the Republic of Tajikistan, this Provision, other regulations, and also the rules and instructions approved by the Ministry of conservation of the Republic of Tajikistan and Forestry and landscape production association of the Republic of Tajikistan which are not contradicting this Provision.

1.8. For the purpose of involvement of broad masses of hunters to active participation in protection and increase in inventories of hunting fauna, implementation of cultural and mass work among hunters and the correct organization of hunting economy, hunters of the Republic of Tajikistan unite in volunteer societies of hunters and fishers.

The hunters serving in the Ministries of Defence, internal affairs and homeland security unite in the military and hunting societies organized under these ministries.

The hunter can be the member only of one society of hunters and fishers.

1.9. Members of society of hunters and fishers shall participate in holding biotechnical actions and in work on improvement of hunting-fishing farms, and also fight actively against poaching.

1.10. For the purpose of increase in role of the public in protection of fauna, suppression of poaching and abuses of regulations and terms of hunting under Forestry and landscape production association of the Republic of Tajikistan the public okhotinspektion which is acting on the basis of the Provision approved by Forestry and landscape production association of the Republic of Tajikistan is created.

2. Procedure for provision of the right of maintaining hunting economy

2.1. Provision of the right of maintaining hunting economy to the companies, organizations and the organizations is performed on the basis of the conclusion of environmental assessment, including okhotekonomichesky inspection of the territory, the schematic map of the organized economy with drawing and the description of borders and nature of the hunting grounds this on accounting of number of wild animals in hunting grounds, the project of development of the hunting ground for the next three years.

According to the Law of the Republic of Tajikistan of July 24, 1994. "About protection and use of fauna" the lessee pays the rent to the lessor for provision of hunting ground which amount is established by agreement of the parties.

2.2. The right of maintaining hunting economy is provided to the state, cooperative, public entities, organizations, and the organizations by bodies of forest and hunting economy.

2.3. The companies, organizations and the organizations which are granted the right of maintaining hunting economy have the privilege after the expiration of the term established by the contract for further maintaining hunting economy in these grounds on condition of observance and accomplishment by them of all complex of the necessary actions provided by the agreement.
