Regulations on expertize of industrial safety on the hazardous production facilities connected with transportation of dangerous substances by rail

I. Field of application

1.1. The regulations on expertize of industrial safety on the hazardous production facilities connected with transportation of dangerous substances by rail establish requirements to procedure for expertize of industrial safety and registration of experimental testimony.

1.2. The provision is developed taking into account industry specifics and according to the Federal Law of 21.07.97 N116-FZ "About Industrial Safety of Hazardous Production Facilities" (The Russian Federation Code, 1997, N 30, the Art. 3588); The Regulations on the Federal inspectorate for mining and industry of Russia approved by the order of the Government of the Russian Federation of 3.12.2001 N841 (The Russian Federation Code, 2001, N 50, the Art. 4742); the order of the Government of the Russian Federation of 17.07.98 N779 "About Federal Executive Body, Specially Authorized in the field of Industrial Safety" (The Russian Federation Code, 1998, N 30, the Art. 3775); The Rules of expertize of industrial safety approved by the resolution of Gosgortekhnadzor of Russia of 6.11.98 N 64, registered by the Ministry of Justice of the Russian Federation of 8.12.98, registration N1656.

1.3. The provision is intended for the organizations performing examination of industrial safety on the hazardous production facilities connected with transportation of dangerous substances by rail.

1.4. Fulfillment of requirements of provision is obligatory in case of expertize of industrial safety:

- the project documentation on production, reconstruction, modernization, preservation and liquidation of hazardous production facilities (the objects connected with transportation of dangerous substances);

- the engineering devices applied on hazardous production facilities (the railway vehicles and containers intended for transportation of dangerous goods, the container and packaging used in case of transportation, etc.);

- buildings and constructions on hazardous production facilities (railroad side tracks, shipping places and unloadings of dangerous substances);

- the documents connected with operation of hazardous production facilities (The instruction about procedure for servicing and the organization of movement on siding of the company and other regulating documents regulating safety of transportation of dangerous substances on hazardous production facility).

Expertize of industrial safety is carried out in the organizations:

- the dangerous substances performing transportation, including loading (unloading) of dangerous substances in (from) cars and containers;

- having own (leased) railroad side tracks intended for transportation of dangerous substances on hazardous production facility;

- having own (leased) railway vehicles and containers intended for transportation of dangerous substances.

II. General provisions

2.1. The regulations on expertize of industrial safety on the hazardous production facilities connected with transportation of dangerous substances by rail establish requirements to procedure for conducting examination, registration and approval of experimental testimony.

2.2. Examination of industrial safety on the hazardous production facilities connected with transportation of dangerous substances by rail is carried out:

- at the initiative of the organizations

- after the happened accident on objects of examination;

- on specifying of bodies of Gosgortekhnadzor of Russia.

2.3. Expertize of industrial safety is carried out by the organizations having the license of Gosgortekhnadzor of Russia.

III. Procedure for conducting examination

3.1. All process of conducting examination shall be documented.

Process of conducting examination consists of the following stages:

- preliminary stage;

- the request, the schedule, the agreement or other documents determining conditions of conducting examination;

- examination process;

- experimental testimony issue.

3.2. Preliminary stage.

3.2.1. In case of the appeal of the customer to the expert organization for expertize of industrial safety the expert organization carries out preliminary stage of negotiations with the customer.

3.2.2. The preliminary stage of negotiations is carried out for informing the customer on procedure for conducting examination, and also for discussion of the questions concerning conducting examination including:

- content and course of examination;

- preparation for conducting examination on site;

- creation of the schedule.

3.2.3. Preliminary negotiations are documented by the expert responsible for negotiation.

3.3. Conditions of conducting examination.

3.3.1. Expertize is carried out based on the request of the customer or other documents according to the conditions approved by the expert organization and the customer.

3.3.2. Documents for conducting examination are constituted after carrying out preliminary negotiations.

3.3.3. In documents:

- contracting parties are determined;

- objects of examination are determined;

- the list of the materials and documents necessary for conducting examination of object provided by the customer of the expert organization is determined;

- consent to fulfill the requirements obligatory for conducting examination, in particular on acceptance of the expert or group of experts and payment of expenses on carrying out process of examination irrespective of its results is confirmed by the customer;

- terms of conducting examination are determined.

3.3.4. The term of conducting examination is determined by complexity of object of examination and, as a rule, shall not exceed three months from the moment of the beginning of conducting examination.

3.3.5. The expert organization starts conducting examination only after receipt of set of required materials and documents in full, accomplishment by the customer of other conditions stipulated in the request or other documents establishing conditions of conducting examination.

3.4. Examination process.

3.4.1. Process of examination includes:

- matching of materials and documentation, necessary for conducting examination of object;

- assignment of experts;

- conducting examination.
