Chapter 1. General provisions

Article 1. Coverage of this Law

This Law establishes the legal basis of state policy in the field of pricing in the Republic of Belarus, scope of open and regulated pricing, the right, obligation and responsibility of subjects of pricing.

Article 2. Legislation of the Republic of Belarus on pricing

The legislation of the Republic of Belarus on pricing consists of this Law and other acts of the legislation.

Features of pricing in spheres of natural monopolies are determined by the legislation of the Republic of Belarus on natural monopolies.

If international treaties of the Republic of Belarus establish other rules, than those which contain in this Law then are applied rules of international treaties.

Article 3. Basic concepts and their determinations

For the purposes of this Law the following basic concepts and their determinations are applied:

the price – monetary value of cost of commodity unit;

rate – monetary value of cost of work item, service;

pricing – process on establishment and use of the prices (rates);

free price (rate) – the price (rate) developing under the influence of the demand and supply in the conditions of free competition;

price regulation (rates) – impact on processes of establishment and use of the prices (rates) from the subjects of pricing performing price regulation (rates);

regulated price (rate) – the price (rate) established by the subjects of pricing performing price regulation (rates);

fixed price (rate) – the regulated price (rate) in firmly expressed cash size;

marginal price (rate) – the regulated price (rate) which size is limited upper and (or) lower to limits;

the limiting allowance (discount, markup) – the restriction to the price set by the subjects of pricing performing price regulation (rates);

the limiting standard rate of profitability – the established limiting indicator of benefit-cost ratio expressed as a percentage;

price indexation (rate) – change of level of the price (rate) by application of coefficient to the price (rate) according to the procedure, established by the legislation;

declaring of the prices (rates) – registration of the prices (rates) by legal entities, the individual entrepreneurs included in the State register of the business entities holding dominant position in the goods markets in the state bodies determined by the legislation.

Article 4. Subjects of pricing

Subjects of pricing in the Republic of Belarus are:

President of the Republic of Belarus;

state bodies (organizations) performing price regulation (rates);

legal entities, not being state bodies (organizations) performing price regulation (rates) (further - legal entities);

individual entrepreneurs;

other physical persons having the right according to the legislation to perform the certain types of activity which are not carried by legal acts to business activity on goods (works, services) which regulated prices (rates) are applied (further - physical persons).

Article 5. Basic principles of pricing

The basic principles of pricing are:

determination of bases of state policy in the field of pricing;

combination of free and regulated prices (rates);

establishment of regulated prices (rates) for goods (works, services) at the level providing to subjects of managing covering of economically reasonable costs and receipt of profit, sufficient for expanded reproduction, taking into account subsidies and other measures of the state support;

Article 6. Scope of free prices (rates)

In the Republic of Belarus on goods (works, services), except as specified, provided by this Law, free prices (rates) are applied.

Chapter 3 Price regulation (rates)

Article 7. Scope of regulated prices (rates)

Regulated prices (rates) in the Republic of Belarus are applied on:

the goods made (implemented) in the conditions of natural monopolies the services rendered (provided) by subjects of natural monopolies, relating to spheres of natural monopolies;

separate goods (works, services) which specific list is established by the President of the Republic of Belarus or according to its order Council of Ministers of the Republic of Belarus.

Article 8. Methods of price regulation (rates)

The president of the Republic of Belarus, state bodies (organizations) performing price regulation (rates) within the powers conferred to them by the legislation perform price regulation (rates) by establishment:

fixed prices (rates);

marginal prices (rates);

limiting allowances (discounts, markups);

the limiting standard rates of profitability used for determination of the amount of the profit which is subject to inclusion in the regulated price (rate);

procedure for establishment and use of the prices (rates);

price indexation (rates);

declaring of the prices (rates).

State bodies (organizations) performing price regulation (rates), the decision on the choice of specific method of price regulation (rates) proceeding from state interests and the developing social and economic situation in the republic according to the procedure established by the legislation having the right to make.

Chapter 4. State regulation in the field of pricing

Article 9. Powers of the President of the Republic of Belarus in the field of pricing

President of the Republic of Belarus:

determines single state policy in the field of pricing;

determines the inventory (works, services), the prices (rates) for which are regulated;

determines state bodies (organizations) performing price regulation (rates) taking into account provisions of this Law;

performs price regulation (rates) for separate goods (works, services);

authorizes Council of Ministers of the Republic of Belarus on approval of inventories (works, services), the prices (rates) for which are regulated by separate state bodies (organizations) performing price regulation (rates);

performs other powers in the field of pricing according to the Constitution of the Republic of Belarus, this Law and other legal acts.

Article 10. State bodies (organizations) performing price regulation (rates)

State bodies (organizations) performing price regulation (rates) are:

Council of Ministers of the Republic of Belarus;

republican state body concerning economy to which according to the legislation functions of price regulation (rates) are assigned;
