About approval of Rules of preparation of regulatory legal acts of federal executive bodies and their state registration

For the purpose of further enhancement of work on preparation of regulatory legal acts of federal executive bodies and their state registration the Government of the Russian Federation decides:

1. Approve the enclosed Rules of preparation of regulatory legal acts of federal executive bodies and their state registration.

Determine that methodical instructions for yuridiko-technical registration of regulatory legal acts of federal executive bodies are approved by the Ministry of Justice of the Russian Federation.

2. To federal executive bodies:

provide timely acceptance of regulatory legal acts in pursuance of the Federal constitutional Laws, the Federal Laws, decrees and orders of the President of the Russian Federation, resolutions and orders of the Government of the Russian Federation;

in 10-day time to send the regulatory legal acts requested according to item 4 of this resolution to the Ministry of Justice of the Russian Federation;

exclude direction cases for execution of the regulatory legal acts which did not undergo state registration and are not published in accordance with the established procedure;

perform measures for strengthening of legal services and increase in efficiency of their activities;

Determine that heads of federal executive bodies bear the personal responsibility for non-compliance with requirements of this resolution.

3. To the Ministry of Justice of the Russian Federation:

generalize practice of state registration of regulatory legal acts of the federal executive bodies affecting the rights, freedoms and obligations of man and citizen establishing legal status of the organizations or having interdepartmental nature and to annually provide in the Government of the Russian Federation the relevant information, including on regulatory legal acts which state registration it is refused;

submit offers on rules of codification of regulatory legal acts of federal executive bodies within 2-month term.

4. The Ministry of Justice of the Russian Federation has the right:

perform check of works on selection of the regulatory legal acts which are subject to state registration in federal executive bodies;

request acts of federal executive bodies for the purpose of conducting legal examination regarding need of their state registration;

perform conducting legal examination of acts of the federal executive bodies placed in public sources of information, in case of non-presentation of the specified acts in the Ministry of Justice of the Russian Federation;

transfer data on the regulatory legal acts applied without state registration and also on the acts recognized by the Supreme Court of the Russian Federation not corresponding to the legislation to mass media;

involve in case of need highly qualified specialists and scientists as non-staff experts to preparation of the conclusions in the regulatory legal acts of federal executive bodies provided on state registration, or to conducting legal examination regarding need of state registration of the specified acts.

Compensation of non-staff experts is made at the expense of the means of the federal budget provided to the Ministry of Justice of the Russian Federation.

4.1. Idea of cancellation or change of the regulatory legal act adopted by federal executive body contradicting the Constitution of the Russian Federation and the legislation of the Russian Federation goes the Ministry of Justice of the Russian Federation to federal executive body and is performed by federal executive body from the date of obtaining in a month.
