3. Create the working group of the Commission and approve its structure (appendix N 3).

Procedure for carrying out competitive selection of the exchange for order placement on oil supply and oil products

1. General provisions

1.1. This Procedure determines conditions of carrying out competitive selection of the exchange for order placement on oil supply and oil products (further - Tender).

Tender is open.

The participant Konkursa in this Procedure is understood as the exchange allowed in accordance with the established procedure to participation in Konkurs.

1.2. The organizer Konkursa is the Ministry of Economic Development and Trade of the Russian Federation (further - the organizer Konkursa) concluding with the participant Konkursa declared as the winner, the Agreement on interaction between the Ministry of Economic Development and Trade of the Russian Federation and the exchange on order placement on oil supply and oil products.

2. Procedure for the organization and carrying out Tender

2.1. For carrying out Tender the Commission headed by the chairman is created.

The commission chairman holds commission sessions, declares the winner Konkurs.

2.2. Commission:

- makes the decision on date of Tender;

- determines terms of the beginning of giving and end of order taking for participation in Tender;

- considers requests for participation in Tender:

- makes the decision on Konkurs's results, including on determination of the winner Konkurs;

- sends to the winner Konkursa the notification on recognition by his winner.

2.3. For the solution of the operational issues connected with the organization of Tender under the Commission the working group is created.

2.4. Working group:

- accepts and registers requests for participation in Tender;

prepares and posts on the official site the Ministry of Economic Development of the Russian Federation on the Internet - www.economy.gov.ru the notification on carrying out Tender (further - the notification on carrying out Tender), and also information on its results;

- prepares and submits the Commissions the materials necessary for selection of the exchange;

- carries out organizational work on the conclusion with the winner Konkursa Soglasheniya, the stipulated in Item 1.2 presents of the Procedure.

2.5. Date of Tender is the date specified in the notification on carrying out Tender.

2.6. Application is considered by the Commission as the consent of the corresponding participant Konkurs to take part in Konkurs according to conditions of this Procedure and on its results to sign the Agreement, the stipulated in Item 1.2 presents of the Procedure.

2.7. For participation in Tender of the exchange shall provide to the Commission before the expiration specified in the notification on carrying out Tender, sealed envelopes without specifying of other data except mark "On carrying out competitive selection of the exchange for order placement on oil supply and oil products" in which there shall be following documents:

2.7.1. The bid constituted in any, written form in Russian, with appendix of the list of documents, being in envelope.

2.7.2. The extract from the Unified State Register of Legal Entities or the copy certified in accordance with the established procedure.

2.7.3. The copies of constituent documents of the exchange certified in accordance with the established procedure.

2.7.4. The copy of the balance sheet on the last reporting date with mark of tax authority.

2.7.5. The copy of audit opinion certified in accordance with the established procedure by results of check of activities of the exchange for the last accounting year.

2.7.6. The reference from tax authority confirming absence at the exchange, overdue debt on tax and other obligatory payments in budgets of all levels for the last accounting period or the copy certified in accordance with the established procedure.

2.7.7. The copy of the license (licenses) for the organization of stock exchange trading certified in accordance with the established procedure.

2.7.8. Information on availability (absence) for the last calendar year applied by federal executive body in the field of the financial markets in the procedure for sanctions for violation of the law established by the legislation of the Russian Federation.

2.7.9. The document on the property right or the lease agreement on the room for the organization of tendering.

2.7.10. Rules and regulations of the exchange.

2.7.11. Data on availability at the exchange of the equipment, including the remote terminals, licensed technical means and the software intended for carrying out the electronic exchange biddings and provision of information on trade results.

2.7.12. Data on the organization of calculations following the results of the biddings.

2.7.13. Information on work experience of the exchange, including on the traded goods and tools and their amounts for the last calendar year (on months).

2.7.14. Data on availability at the exchange of qualified personnel.

2.7.15. Offers of the exchange on the organization of oil trade and oil products (technology, rules and regulations, accreditation system, technical supply, etc.).

2.7.16. Offers of the exchange on the size of sales charge and other exchange charges for tendering by oil and oil products.

2.7.17. Offers of the exchange on the volume of investment which it is ready to select for development of section of oil and (or) oil products.

2.8. Participants of Tender can withdraw the registered request by the written notice of working group.

2.9. Bids in sealed envelope are sent by mail to the organizer Konkursa to the address: 125993, Moscow, Ulitsa 1-ya Tverskaya Yamskaya, 1, 3 or surrender on receipt to the secretary of working group. The envelope is registered with indication of date and time of obtaining.
