1. Approve Regulations on rules of carrying out tender with candidates for acceptance for work in prosecutor's office it (is applied).

2. Recommend to the Attorney-General of the Azerbaijan Republic to resolve the issues following from this Decree within the powers.

3. This Decree becomes effective from the date of publication.

Regulations on rules of carrying out tender with candidates for acceptance for work in prosecutor's office

1. General provisions

1.1. This provision establishes according to provisions of the Law of the Azerbaijan Republic "About prosecutor's office" rules of carrying out tender with candidates for acceptance for work in prosecutor's office (further - candidates).

1.2. For the purpose of clarification of preparation, level of knowledge, general outlook of each candidate wishing to be employed in prosecutor's office, its suitability and compliance of position of the prosecutor, the investigator or the field investigator in the conditions of publicity, as transparent methods according to the international requirements competition is held. Tender consists of qualification examinations (test examination and written examination) and interview.

1.3. In the presence in bodies of prosecutor's office of the corresponding vacant established posts at least once a year competition in connection with employment is announced.

1.4. Persons meeting the requirements of the Law of the Azerbaijan Republic "About prosecutor's office" are allowed to tender.

1.5. Persons which are passing to work into prosecutor's office from judicial and law enforcement agencies, and also from the positions connected with coordinating, legislative or organizational support of activities of law enforcement agencies, or having academic degree on the corresponding specialty, can be exempted from qualification examinations. In this case with them the interview is conducted.

2. Contest committee and its organization

2.1. For carrying out tender in the Prosecutor General's Office the contest committee as a part of 7 people is created (further - the commission). After consideration on board of the Prosecutor General's Office the structure of the commission where the chairman, the vice-chairman, the responsible secretary and other members enter, affirms the Attorney-General of the Azerbaijan Republic.

2.2. The commissions can be involved authoritative lawyers, scientists, experts and specialists.

2.3. If necessary the commission carries out in connection with the questions carried to its competence, meeting with participation at least two thirds of her members. Members of the commission are notified on time, the place of meeting and the questions submitted for discussion in advance.

2.4. Decisions on the questions considered on commission sessions are accepted by open voting, at the same time the chairman votes the last, and by a majority vote, and are signed by all members of the commission participating in meeting. 3. Carrying out tender

3.2. For the purpose of ensuring holding qualification examinations in accordance with the established procedure the State examination center and other structures can be involved in examination.
