Regulations on procedure for development, production, designing, construction (installation), acquisition, operation in the territory of the Republic of Tajikistan and import from abroad radio-electronic means and high-frequency devices

1. This Provision determines procedure for development, production, designing, construction (installation), acquisition, operation in the territory of the Republic of Tajikistan and import of radio-electronic means and high-frequency devices from abroad.

2. Requirements of this provision are obligatory for all legal entities and physical persons in the territory of the Republic of Tajikistan, the river, air, space and other objects which are under jurisdiction of the Republic of Tajikistan, in their time spent in international waters and airspace, in the international territories and in space, the radio-electronic means and high-frequency devices performing development, production, designing, construction (installation), acquisition, operation and import from abroad, except for radio-electronic means and high-frequency devices the held for use and operated bodies of the Ministry of safety and the Ministry of Defence of the Republic of Tajikistan.

3. The procedure for development, production, designing, construction (installation), acquisition, operation and import from abroad of the radio-electronic means and high-frequency devices intended for bodies of national defense and safety and operated by them is determined by separate provision.

4. Action of this provision extends to radio-electronic means, irrespective of capacity and the assignments working at frequencies below 3000 GHz and the high-frequency devices working at frequencies over 12 kHz and lower than 3000 GHz. As radio-electronic means are considered also set of professionally prepared details (mounting set) if details can be collected in radio-electronic means without tool or by means of protozoa or the tools delivered together with details.

5. Development of radio-electronic means and high-frequency devices is performed on permission of bodies of the State inspectorate of communication of the Ministry of Communications of the Republic of Tajikistan.

Bodies of the State inspection of communication of the Ministry of Communications of the Republic of Tajikistan in permission to development:

- radio-electronic means establish the range of working frequencies, requirements to the parameters determining electromagnetic compatibility, to use of signals of identification and condition of use of radio-electronic means and working frequencies;

- high-frequency devices establish the range of frequencies, requirements for restriction of radiations, conditions of use of high-frequency devices and frequencies.

Permission of bodies of the State inspectorate of communication is not required if radio-electronic means or high-frequency devices are developed according to state standards or other regulating documents, like general technical requirements, which normirovana of the requirement and parameters concerning use of the ranges of frequencies, ensuring electromagnetic compatibility of radio-electronic means, conditions of their use and application of signals of identification.

6. Production (production) of radio-electronic means and high-frequency devices is performed on specifications or other specifications and technical documentation coordinated with bodies of the State inspectorate of communication. In case of approval these bodies are established obligatory for the vendor or intermediaries of delivery condition (sale) of radio-electronic means and high-frequency devices.

7. Designing, construction (installation) of stationary radio-electronic means is performed on permission of bodies of the State inspectorate of communication of the Ministry of Communications of the Republic of Tajikistan.

The choice of the parcels of land for construction stationary or temporary expansion of transportable radio-transmitting stations by means of single radio transmitters of 1 kW and more and the radio-receiving stations working in the range of frequencies below 30 MHz is performed in the zones which are taken away for placement according to the radio-transmitting and the radio-receiving stations.

In selection process of the parcel of land the customer, or according to its order the project organization performs examination of electromagnetic compatibility of projectible radio-electronic means with the operating and earlier designed radio-electronic means and wire high-frequency transmission systems.

Withdrawal of the parcels of land for construction stationary and temporary expansion of transportable radio-electronic means is performed in the presence at the customer of the permission for construction of radio-electronic means or use of the parcel of land for temporary expansion of transportable radio-electronic means.

8. Acquisition (sale), and such transfer by legal entity or physical person to permanent or temporary use of radio-electronic means to other legal entities or physical persons is performed on permission of bodies of the State inspectorate of communication. This procedure extends also to sale or transfer of the radio-electronic means intended or which are under authority of the Ministry of Defence of the Republic of Tajikistan and the Ministry of safety of the Republic of Tajikistan, to other legal entities or physical persons.

The list of separate types (types) of radio-electronic means, acquisition (sale) of which does not require permission of state bodies, is established and published by these bodies.

Radio-electronic means, acquisition (sale) of which it is performed on permission of bodies of the State inspectorate of communication, can be offered in declarations or advertizing booklets only provided that on them it is indicated the need of receipt of permission of bodies of the State inspectorate of communication to their acquisition and operation.

9. Acquisition on import and import to the territory of the Republic of Tajikistan of radio-electronic means and high-frequency devices (including being part of other equipment or vehicles) is made on permission of bodies of the State inspectorate of communication.
