About approval of criminalistic requirements and test methods of civil and office weapon and cartridges to it, Rules of issue of the conclusions on compliance to criminalistic requirements of civil and office weapon and cartridges to it

According to the Law of the Republic of Kazakhstan of December 30, 1998 "About the state control of turnover of separate types of weapon" the Government of the Republic of Kazakhstan DECIDES:

1. Approve enclosed:

1) Criminalistic requirements and test methods of civil and office weapon and cartridges to it;

2) Rules of issue of the conclusions on compliance to criminalistic requirements of civil and office weapon and cartridges to it.

2. This resolution becomes effective after ten calendar days after the first official publication.

Criminalistic requirements and test methods of civil and office weapon and cartridges to it

Section 1. Criminalistic requirements to fire, alarm, gas, electric, pneumatic weapon, cartridges to it, and also to products, structurally similar to weapon

1. General provisions

1. These criminalistic requirements are developed according to the Law of the Republic of Kazakhstan of December 30, 1998 "About the state control of turnover of separate types of weapon" based on the analysis of regulating documents on standardization of production of civil and office weapon and cartridges to it, and also generalization of criminalistic practice, and establish the special technical requirements imposed to the civil and office weapon and cartridges to it which are in circulation in the territory of Kazakhstan for the purpose of their identification and exception of possibility of illegal alteration.

These criminalistic requirements do not extend to the civil and office weapon and cartridges to it made only for export without sales right in the territory of the Republic of Kazakhstan, according to requirements of the legislation of importing countries, to test cartridges, held for use only in the technological purposes at manufacturers of weapon and cartridges, and also to electric weapon.

2. General criminalistic requirements to fire, alarm, gas, electric, pneumatic weapon

2. Fire, alarm, gas, electric, pneumatic weapon with dulny energy over 7,5 of Joules (further - J) and caliber more 4, of millimeter (further - mm) shall have the marking designation (series, number) individualizing it executed mechanically (blow, pressure) or with use of the high-concentrated power sources, including the laser, on depth mm 0,2 suffices.

3. Fire, alarm, gas weapon shall form on shot sleeves the traces of details and mechanisms of weapon containing the complex of signs sufficient for its identification.

4. Features of details and mechanisms of alarm, gas and pneumatic weapon shall not provide possibilities of their interchangeability with details and mechanisms of military, civil and office firearms.

5. Alarm and gas weapon without irreversible changes of design, shall not provide possibilities of production of shot with inelastic bullet and shot shell as a result of which the specific kinetic energy of more 0,5 of Joules on square millimeter (further - J/mm 2) (the minimum energy criterion of porazhayemost of the person accepted in forensic medicine) is reported to shell.

3. Additional criminalistic requirements to fire cut and smooth-bore weapon

6. The cut civil firearms (except for sports) shall have difference in one of parameters of the channel of trunk (quantity, the direction, width, step of lots) from the fighting firearms made under one type of the boss.

Differences on width of lots shall be at least 0,2 of mm between fields, and differences on step of lots shall provide differences of tilt angle of lots at least 1 degree between fields. Differences shall provide possibility of their differentiation in traces with the existing criminalistic methods.

7. The cut firearms shall have distinction between the models made under one type of the boss on traces on sleeves.

8. The multiply charged repeating smooth-bore firearms made at the different companies under one type of the boss shall have distinction between models on interposition of traces of ejector and reflector, and also traces of other details participating in the sledoobrazovaniye mechanism on sleeve.

9. Cut long-barreled weapon, shall not be made under cartridges to guns and revolvers, except for mm 5,6 caliber cartridges.

10. Cut or smooth-bore weapon shall not have in the design of the muffler of sound, and also the devices or special devices intended for installation of the muffler of sound of shot and night sights.

11. The long-barreled weapon having folding design which allows to make its length less than 800 mm or length of trunk or trunk with receiver less than 500 mm in the put provision shall not provide capability of production of shots.

12. Cut weapon, cut inserts to trunk of smooth-bore weapon, and also short-barreled weapon, shall form traces of the channel of trunk on vystrelyanny bullets.

4. Additional criminalistic requirements to fire acormose, alarm and gas weapon

13. Fire acormose weapon without irreversible changes of design shall not provide possibilities of production of shots with bullet and shot shells as a result of which the specific kinetic energy of more 0,5 of J/sq.m is reported to shells.

14 Alarm weapon shall not have possibilities of production of shots gas cartridges without entering of irreversible changes into weapon design.

15. Alarm and gas weapon shall have the weakened fixture of trunk to frame for the purpose of difficulty of their alteration in fire.

5. Additional criminalistic requirements to pneumatic weapon

16. Pneumatic weapon shall have caliber of no more 4,5 of mm.

17. Pneumatic hunting weapon shall have kinetic energy no more than 25 J, sports no more than 35 J.

6. Criminalistic requirements to structurally similar to weapon to products

18. Products, structurally similar to weapon, shall not provide, without irreversible changes of design, possibility of their use as firearms and production of shots with the shells having specific kinetic energy of more 0,5 of J/mm2.

19. Products, structurally similar to weapon, shall not be made of military cut firearms, by means of its alteration and reduction in condition, unsuitable to firing.
