Chapter 1. General provisions

Article 1. The main terms used in this Law and their determinations

For the purposes of this Law the following main terms and their determinations are used:

refining of precious metals (further if other is not established, - refining) - process of purification of the extracted precious metals of impurity and the accompanying chemical elements with bringing content of precious metals to the values conforming to requirements of state standards of the Republic of Belarus, and (or) the specifications operating in the territory of the Republic of Belarus and (or) the international standards of quality received by the London association of participants of the market of precious metals (LBMA) and participants of the London market of platinum and palladium (LPPM);

bank ingots - the ingots of the affined gold, silver, platinum and palladium conforming to requirements of state standards of the Republic of Belarus, and (or) the specifications operating in the territory of the Republic of Belarus and (or) the international standards of quality received by the London association of participants of the market of precious metals (LBMA) and participants of the London market of platinum and palladium (LPPM);

the state monopoly for approbation and branding the state assay brand of the Republic of Belarus - the exclusive right of the state exercised by authorized state body on carrying out approbation and branding the state assay brand of the Republic of Belarus of jewelry and other products from the precious metals and gemstones (further, if is not established other, - jewelry and other products) made in the Republic of Belarus and (or) imported into the Republic of Belarus for realization;

the state assay brand of the Republic of Belarus - the sign of the sample established by the Ministry of Finance applied on the jewelry and other products made of precious metals, and certifying test of the precious metal containing in such products;

activities with precious metals and gemstones - set of the transactions with precious metals and gemstones performed by subjects of legal relationship in this sphere;

diagnostics of gemstones - determination of parameters and characteristics of gemstones, including for their classification and (or) cost determination which results are drawn up documentary;

gemstones - natural diamonds, emeralds, rubies, sapphires and alexandrite, and also natural pearls in the crude (natural) and processed type, unique amber educations. The materials of artificial origin having characteristics (properties) of gemstones cannot be carried to gemstones;

precious metals - gold, silver, platinum and metals of platinum group (palladium, iridium, rhodium, ruthenium and osmium) which can be in any condition, type (including in the native and affined type), and also in raw materials, alloys, semifinished products, chemical compounds, materials, products (products), including jewelry and other products, coins, scrap and waste;

use of precious metals and gemstones - use of precious metals and gemstones in financial, production, scientific, welfare and other purposes;

scrap and waste of precious metals - products (products) from precious metals and their alloys, its parts which became useless or lost the consumer properties and (or) functional purpose, the unrecoverable scrap which arose in production process of such products (products) and also the remaining balance of raw materials, materials, semifinished products containing the precious metals formed in production process and (or) consumption and used mainly for extraction of precious metals;
