Rules of sports and amateur fishing and production of other water organisms in reservoirs of the Republic of Moldova

Art. 1. Sports and amateur fishing, production of other water organisms for private consumption is allowed to physical persons for a fee in all fishery reservoirs, except for reserves, fish nurseries, pond fisheries, with observance of statutory rules of fishery and water use.

In a number of reservoirs and on the sites determined by Service of fish conservation, fishing is allowed only to members of societies of fishers based on the relevant agreement signed between societies and Service of fish conservation.

Art. 2. Protection of fish resources and other water organisms, regulation of their trade, implementation of measures for reproduction of fish inventories, issue of permissions to the fishing right, and also the state control of observance of these rules is exercised by Service of fish conservation.

Art. 3. Catch of fish and other water organisms from fishery reservoirs is performed only according to the subscriptions issued to physical persons and legal entities by Service of fish conservation for a fee.

In case of systematic failure to carry out of terms of the contract about work of fishers by society on the organization of sports and amateur fishery and work on protection and reproduction of fish inventories on reservoirs the signed agreements can be cancelled by Service of fish conservation.

In case of violation by amateur fishers of requirements of the Regulations on protection of fish inventories and these rules paid subscriptions are cancelled, and violators are brought to the administrative responsibility.

Art. 4. Fishing sport competitions are held according to the procedure, established republican and district societies of fishers, other volunteer sports societies. Places and terms of competitions are coordinated with Service of fish conservation.

Art. 5. The societies of fishers which signed the relevant agreements with Service of fish conservation shall:

5.1. To strictly observe Regulations on protection of fish resources and regulation of fishery in fishery reservoirs of the republic, the Rule of sports and amateur fishery and the Instruction for use.

5.2. Fulfill agreement obligations, concluded with Service of fish conservation.

5.4. Perform accounting of the means used by societies on actions for protection and reproduction of fish inventories.

5.8. Take part in carrying out certification of reservoirs.

5.9. Organize on a voluntary basis groups of assistance of fish conservation to Service on fight against illegal fishing, on the prevention of other violations of these rules, to identification of cases of pollution of reservoirs the industrial drains, agricultural chemicals, mineral and organic fertilizers used in coastal zones, adjacent to reservoirs, to be directly involved in identification of causes of death of fish, sources of pollution of reservoirs, about all cases of death of fish or emergence of the conditions able to lead to mass death of fish, to immediately report Service of fish conservation.

Note: the rights of public inspectors can be granted to members of societies of hunters and fishers, directors and specialists of fisheries.

5.10. Represent to Service of fish conservation of the data on use of reservoirs, and also about expenditure material and money on carrying out fish-breeding and meliorative works on forms and to the terms coordinated with Service of fish conservation.

5.11. Carry out among the population and members of societies work on explanation of the Regulations on protection of fish inventories and these rules.

5.12. Designate borders of the used sites of reservoirs special signs on the sample established by Service of fish conservation.

Art. 6. The citizens who are engaged in sports and amateur fishing shall:

6.1. Follow these rules, Regulations on protection of fish inventories and the fishery mode established on the visited reservoir (the site of reservoir).

6.2. Support proper sanitary condition on sites, not leave garbage and other waste on ice and coast of reservoirs, not to allow pollution of reservoirs.

6.5. Care for preserving green plantings on coast of reservoirs.

Art. 7. The service of fish conservation is granted the right in accordance with the established procedure:

7.1. Check fulfillment of requirements of these rules by physical persons and legal entities.

7.2. Require from official and individuals of explanations concerning violation of these rules.

7.3. Check overland and water vehicles, fishing tools, fish and other water organisms on places of fishing, warehouses, places of acceptance, fish processing and commercial enterprises.

7.4. Postpone in coordination with Icthyological council the date of prohibition on fishing up to 20 days in this or that party depending on hydroweather conditions.

7.5. Resolve societies of fishers in necessary cases catching of fish from zamorny reservoirs, under control of Service of fish conservation, trade tools of fishing with use of the caught fish for stocking of other reservoirs or delivery in retail chain stores.

In necessary cases from the reservoirs used by societies in coordination with the last to attract the fishing organizations to catching of fish.

7.6. Resolve sports and amateur fishing in the places prohibited for trade fishery and in the period of fishing prohibition with use of limited quantity of tackles for sports and amateur fishing, except for spawning areas, zimovalny holes and ways of migration of fishes.

7.7. Determine borders of spawning sites and zimovalny holes, and also dates of freeze-up and raspaleniye of ice by hydrometeorological service materials.

Art. 8. It is forbidden:

8.1. Make acclimatization, stocking and cultivation of new types of fish without approval of Service of fish conservation, Icthyological council.

8.2. Apply the new tackles and methods of fishing which are not provided by these rules without the permission of Service of fish conservation.

8.3. Hold fishing competitions during spawning of fish.
