About approval of the Regulations on payment procedure of use of radio-frequency range in the Republic of Uzbekistan

According to article 11 of the Law of the Republic of Uzbekistan "About radio-frequency range" and for the purpose of rational use of radio-frequency resource of the republic the Cabinet of Ministers decides:

1. Approve the Provision "About Payment Procedure of Use of Radio-frequency Range in the Republic of Uzbekistan" according to appendix and enact since January 1, 2002.

2. Determine that use of radio-frequency range by state governing bodies, legal entities and physical persons for own needs without the right of provision of services of communication, and also the operators providing distribution of the state teleradio programs is performed on free basis.

3. To impose control of execution of this resolution on the First Deputy Prime Minister of the Republic of Uzbekistan Tulyaganov K. N.

Provision "About Payment Procedure of Use of Radio-frequency Range in the Republic of Uzbekistan"

I. General provisions

1. This Provision is developed according to article 11 of the Law of the Republic of Uzbekistan "About radio-frequency range" and establishes, the basic principles and payment terms for use of radio-frequency range for legal entities and physical persons which have and use radio-electronic funds for the territories of the Republic of Uzbekistan for communication services provision.

2. The payment for use of radio-frequency resource is installed separately on each permission to use of radio-frequency range.

3. Permission to the right to use of radio-frequency range acquired in the procedure established by the legislation cannot be transferred to other legal entities and physical persons.

4. The basis for collection of payment for use of radio-frequency range are permissions of the Ministry of development of information technologies and communications of the Republic of Uzbekistan (further - the Ministry) on the operation of radio-electronic means and high-frequency devices with fixing of radio frequencies issued based on decisions of Republican council on radio frequencies.

5. Rates for services in examination of electromagnetic compatibility, registration and operation of radio-electronic means and high-frequency devices are free and affirm the Center of electromagnetic compatibility.

Conducting examination on electromagnetic compatibility of the radio-electronic means used for the purpose of ensuring defense and safety of the country is performed by radio-frequency bodies on free basis.

II. Calculation of payment for use of radio-frequency range

6. The amount of payment depends on width of the used band of frequencies, the territory serviced by radio-electronic means, and also the value of the used bands of frequencies.

7. According to recommendations of the Sector of radio communication of the International Telecommunication Union (annual payments are determined by MSE-RSM.2012) by formula:

In - band width of frequencies in MHz;

G - the coefficient considering the serviced geographical zone;

Е - the coefficient considering the commercial value of the used radio-frequency range;

T - the minimum size of the salary established in the Republic of Uzbekistan.

The existing administrative-territorial division of the republic is accepted to the serviced geographical zone, at the same time for one region (The Republic of Karakalpakstan, areas) G = 1 is accepted. The coefficient = 3 is applied to the city of Tashkent.

8. When calculating payment the band width of frequencies and the territory specified in permissions of the Ministry and the operating level of basic settlement value is used.

III. Introduction of payment for use of radio-frequency range

9. The payment for use of radio-frequency range is entered by users to the Ministry quarterly, in time no later than the 15th day of the first month of quarter, based on the made-out bills.

The specified payment is distributed as follows:

50 percent go to the Government budget;

50 percent go to the special account of the Ministry in authorized bank for cost recovery of the Management committee and to monitoring of use of radio-frequency range.

The ministry transfers the corresponding amounts into the Government budget no later than 3 days from the date of their receipt.
