About approval of the Procedure and conditions of payment of the disposable monetary assistance in case of death (death), wound (contusion, injury or mutilation) or disability of employees of personnel structure of prospecting bodies

According to article 21 of the Law of Ukraine "About prospecting" the Cabinet of Ministers of Ukraine decides bodies of Ukraine:

1. Approve the Procedure and conditions of payment of the disposable monetary assistance in case of death (death), wound (contusion, injury or mutilation) or disability of employees of personnel structure of prospecting bodies which is applied.

2. Determine that:

in cases which occurred inclusive till December 31, 2007 the amount of the monetary assistance is calculated from official pay rate, salary on military rank, percentage length-of-service allowance and the monthly allowance in the amount of 100 percent of cash cover (salaries of cash cover and length-of-service allowance) according to the legislation on the last position which the employee of personnel structure held on the date of working capacity loss, and person discharged from military service - on the date of dismissal;

the procedure and conditions of payment of the disposable monetary assistance in case of death (death), wound (contusion, injury or mutilation) or disability of the military personnel which does not belong to personnel structure of prospecting bodies are determined in accordance with general practice.

Procedure and conditions of payment of the disposable monetary assistance in case of death (death), wound (contusion, injury or mutilation) or disability of employees of personnel structure of prospecting bodies

1. This Procedure determines conditions and the payment mechanism of the disposable monetary assistance (further - the monetary assistance) in case of death (death), wound (contusion, injury or mutilation) which happened during accomplishment of service duties, or disability of employees of personnel structure of prospecting body, and also former employees of divisions of the Ministry of Defence of Ukraine, Service of homeland security of Ukraine, the Security Service of Ukraine, Border troops of Ukraine to whom implementation of intelligence activities before entry into force of the Law of Ukraine "About prospecting bodies of Ukraine" which list is determined according to the Ministry of Defence, Service of foreign intelligence, Administration of State frontier service in coordination with the Ministry of Finance (further - employees of personnel structure), during service or not later than in three months after dismissal from service or after the termination of this term, but as a result of disease or accident was assigned, which took place during service and are connected with accomplishment of service duties.

2. In case of death (death) of the employee of personnel structure during accomplishment of service duties the monetary assistance is paid to family of the died (dead), and in case of its absence - to parents and dependents in the amount of ten-year cash cover (earnings) of the died (dead) on the last position which he held on the date of approach of event.

Persons who have the right to the monetary assistance in case of death (death) of the employee of personnel structure during accomplishment of service duties are determined according to the legislation.

The monetary assistance is paid by equal shares to all persons having the right to its obtaining. In case of refusal one of persons from the monetary assistance its share is regularly distributed between other persons who have the right to such help.

3. The monetary assistance is paid to employees of personnel structure in case:

1) the wound (contusion, injury or mutilation) caused during accomplishment of service duties (without establishment of group of disability), in the amount of which is determined depending on extent of loss of working capacity in percentage terms before 36-month cash cover (earnings);

2) disability which came during service or not later than in three months after dismissal from service, in the amount of:

48-month cash cover (earnings) - to disabled people of the I group;

42-month cash cover (earnings) - to disabled people of the II group;

36-month cash cover (earnings) - to disabled people of III group;

3) disability which came during service or not later than in three months after dismissal from service as a result of the disease or accident connected with accomplishment of service duties or the disability which came after the termination of this term after dismissal from service as a result of disease or accident which took place during service and are connected with accomplishment of service duties, in the amount of:

60-month cash cover (earnings) - to disabled people of the I group;

54-month cash cover (earnings) - to disabled people of the II group;

48-month cash cover (earnings) - to disabled people of III group.

In case of establishment of group of disability which grants the right to the monetary assistance in the bigger size it is paid taking into account earlier paid amount.

4. The amount of the monetary assistance is calculated from official pay rate on the last position which the employee of personnel structure held on the date of working capacity loss, and person discharged from military service - on the date of dismissal.

5. The size of earnings of the serving personnel structure for calculation of the amount of the monetary assistance is determined proceeding from official pay rate by the last position which he held on the date of working capacity loss, and person dismissed from public service - on the date of dismissal.

6. The amount of the monetary assistance in case of death (death), wound (contusion, injury or mutilation) or disability of the serving personnel structure to family members, parents, dependents of the died (died) employee, serving personnel structure or to person dismissed from public service decreases by the amount paid by Social Insurance Fund from labor accidents and occupational diseases in such cases.

7. For payment of the monetary assistance in case of death (death) of the employee of personnel structure members of his family, and in case of their absence - parents and dependents give to organization, institution, the organization or military unit (further - organization) in the last place of service:

the statement from each full age family member, and in case of availability of minor children - from other of parents of the child, guardians or custodians, each of parents and dependents of the died (dead) about payment of the monetary assistance;

copy of the document on circumstances of death (death);

copy of the death certificate;
