This Law governs the relations arising in case of traffic in weapons in the territory of the Republic of Belarus, is directed to protection of life and health of citizens of the Republic of Belarus, foreign citizens and stateless persons (further if other is not determined, - citizens), property, ensuring public safety, environmental protection and natural resources, strengthening international cooperation in fight against crime and illegal distribution of weapon.
Provisions of this Law extend also to the relations arising in case of turnover of ammunition to weapon.
In this Law the following basic concepts are applied:
weapon – the devices and objects which are structurally intended for defeat of live or other purpose, and also giving of signals by pyrotechnic structures;
the firearms – weapons which are produced by shot are intended or can be easily adapted for production of shot or acceleration of bullet or shell due to energy of explosive;
components and components of firearms – any elements or spare components which are specially intended for firearms and necessary for its functioning including trunk, the case or receiver, lock or drum, axis of lock or breechring, and also any device intended or adapted for reduction of the sound made by shot;
fire acormose weapon – weapon in which as trunk the boss's sleeve is used;
cold weapon – the weapon intended for defeat of the purpose by means of the muscular strength of the person in case of direct contact of this weapon with object of defeat;
throwing weapon – weapon in which for throwing of the striking element the muscular strength of the person or the mechanical device are used;
pneumatic weapon – weapon in which for throwing of the striking element energy compressed is used, the liquefied or cured gas;
sports weapon – the weapon which is structurally intended for sports activities;
hunting weapon – the weapon intended for amateur and trade hunting;
gas weapon – weapon in which as the striking element substances tear or irritant action are used;
alarm weapon – the weapon which is structurally intended only for giving of light, smoke or sound signals by pyrotechnic structures;
light arms – the military weapon intended for group use by several persons constituting calculation: single, easel, portable antiaircraft and large-caliber machine guns, anti-tank guns, shoulder, subbarrelled and easel launchers, recoilless tools, portable anti-tank and surface-to-air missile missile systems, caliber mortars less than 100 mm;
small arms – the barreled weapon of caliber less than 20 mm intended for throwing of bullet, fraction or case-shot;
ammunition – the devices and objects which are directly intended for defeat of the purpose, accomplishment of the tasks promoting its defeat and the containing explosive, pyrotechnic or throwing charges or their combination;
the boss – ammunition in which the metayemy element, propellant powder and means of initiation are united in single whole by means of sleeve;
firearms of traumatic action – the fire short-barreled or acormose weapon intended for defeat of the live purpose at distance by metayemy element of the traumatic boss and not intended for causing death to the person;
the traumatic boss – cartridge in which as metayemy element the traumatic shell which is not intended for causing death to the person is used;
traffic in weapons and ammunition – production, realization (including sale (further – realization)), transfer to ownership, acquisition, collecting, exhibiting, accounting, storage, carrying, transportation, transportation, transfer, use, withdrawal, destruction, and also import of weapon, its components and components, ammunition to it (further if other is not determined, – ammunition) on the territory of the Republic of Belarus and export out of its limits;
production of weapon and ammunition – research, development, testing, production, repair of weapon, its components and components, ammunition. Also alteration of any objects as a result of which they acquire properties of weapon belongs to production of weapon;
antiquarian weapon and ammunition – all types of weapon and ammunition made until the end of 1899;
historical weapon and ammunition – all types of weapon and ammunition made until the end of 1945;
marking of weapon – set of conventional signs (letters, words, figures, geometrical figures and any images), applied by the producer to weapon surface, allowing to determine the country where weapon, his manufacturer, individual number of unit of weapon was made;
the subject which striking action is based on use of combustible substances – the subject combining glass or other reservoir, the combustible substance and adaptation providing ignition of combustible substance (sank down).
