In development of the order of the Promatomnadzor of May 11, 1998 and being guided N44 by the resolution of Council of Ministers of the Republic of Belarus of February 20, 1998 N280 "About Obligatory Declaring of Safety of Production Facilities of the Republic of Belarus" of PRIKAZYVAYU:

1. Approve and enact the enclosed "Procedure for examination of the declaration of safety of production facilities of the Republic of Belarus" since June 15, 1998.

2. To provide to chiefs of inspections, Expert service:

2.1. informing administrative and executive authorities, heads of the companies which are subject to declaring about this Procedure;

2.2. systematic control of the course of implementation of the Procedure for conducting examination of the declaration of safety.

3. To chiefs of Expert service, interregional inspections till July 1, 1998 to prepare and submit the list of the organizations to which the right of conducting examination of declarations of safety of production facilities can be granted for approval.

4. Assign the organization of examination of declarations of safety of production facilities to Expert service of Committee (Chekalov M. A.)

5. To impose control over the implementation of this order on vice-chairmen of Committee.

Procedure for examination of the declaration of safety of production facilities of the Republic of Belarus

1. General provisions

1.1. Procedure for examination of the declaration of safety of production facilities of the Republic of Belarus (further - the Procedure for examination) N280 "About Obligatory Declaring of Safety of Production Facilities of the Republic of Belarus" is developed in pursuance of the resolution of Council of Ministers of the Republic of Belarus of February 20, 1998.

1.2. This Procedure for examination is obligatory for the companies and the organizations of all patterns of ownership incorporating the production facilities which are subject to safety declaring (further - the companies which are subject to safety declaring), and also the organizations which are carrying out expertize of declarations of safety of production facilities of the Republic of Belarus.

1.3. The procedure for examination installs the purposes, system of the organization and conducting examination of the declaration of safety, the requirement to structure of the expert opinion.

1.4. Object of examination are declarations of safety of production facilities which are declared according to "Procedure for development of the declaration of safety of production facilities of the Republic of Belarus" (it is registered in the Register of state registration on May 26, 1998, reg. N2487/12) approved by the order of the Promatomnadzor of May 11, 1998 N44 according to the resolution of Council of Ministers of the Republic of Belarus of February 20, 1998 N280.

1.5. The purpose of examination is establishment of the completeness and accuracy of the information provided to declarations of safety of the designed or operating production facility regarding compliance of the security measures provided by the project or realized in case of operation to requirements of existing rules and rules of industrial safety, determination of extent of detection of dangers on production facility and sufficiency of the taken measures for ensuring industrial safety, protection of the population and the territories from technogenic emergency situations.

2. Carrying out ekapertiza

2.1. Expertize of the declaration of safety of production facility is carried out by Committee on supervision of safe operation in the industry and nuclear power (Promatomnadzor) or the specialized organizations accredited by the Promatomnadzor for accomplishment of expert evaluation of technical condition of the person under surveillance of the equipment and the organization of work on the prevention of accidents and industrial traumatism on persons under surveillance productions and objects.

2.2. Conducting examination of the declaration of safety by the organizations participating in its development including at separate stages is not allowed.

2.3. Expertize is carried out based on the agreement between the expert organization and the company which is subject to safety declaring.

The term of conducting examination shall not exceed 2 months from the date of the conclusion of the agreement on conducting examination.

2.4. The expert opinion executed according to the requirements provided in Sections 3 and 4 of this Procedure is result of examination.

2.5. In case of negative experimental testimony, the declaration of safety is subject to completion. In case of disagreement with conclusions of the expert opinion the director which is subject to safety declaring has the right to file in administration of the Promatomnadzor the corresponding petition.

Application is issued on the form of the company which is subject to safety declaring and signed by his head.

The set of the documents enclosed to the application shall include:

the declaration of safety of production facility approved by the head and certified by seal the company which is subject to safety declaring;

the expert opinion approved by the head and certified official by seal the expert organization which was carrying out expertize;

Results of consideration of the application are told the applicant no later than one month after receipt of the statement.

2.6. Control of activities of the expert organizations accredited by the Promatomnadzor is exercised in accordance with the established procedure by the Promatomnadzor.

3. Requirements to the expert opinion

3.1. The expert opinion shall be specific, objective, evidential and reasoned. Formulations of conclusions shall have unambiguous interpretation.

The analysis of Sections of the declaration of safety and the note shall be followed by references to specific requirements of regulating documents in the field of industrial safety, localization and liquidation of emergency situations, protection of the population and the territories against emergency situations and their effects;

3.2. When conducting examination all Sections of the declaration of safety with obligatory specifying of their numbers and names shall be analyzed;

3.3. The expert opinion shall contain the following information:

full name of the declaration of safety;

data on availability at the expert organization of the document on accreditation by its Promatomnadzor, on the right of conducting examination of the declaration of safety of production facility by it;
