About approval of the Regulations on the Ministry of defense industry of the Azerbaijan Republic, structure of the ministry and numerical limit of workers

For the purpose of ensuring activities of the Ministry of defense industry of the Azerbaijan Republic I decide:

1. Approve "Provision on the Ministry of defense industry of the Azerbaijan Republic" it (is applied).

2. Approve "Structure of the Ministry of defense industry of the Azerbaijan Republic".

3. Approve "Numerical structure on the state of the office of the Ministry of defense industry of the Azerbaijan Republic".

4. Charge to the Ministry of defense industry of the Azerbaijan Republic in a month:

4.1. create Research institution of the Ministry of defense industry of the Azerbaijan Republic;

4.2. create based on the Ministry of the Baku aviation Scientific and production enterprise production association "Iglim" placed under authority, based on Avia-Agregat Production association - the Avia-Agregat plant, based on Telemekhanika Production association - the Telemekhanika plant, based on the Science and production association "Neft-gazavtomat"nauchno-proizvodstvennoye predpriyatiye Neftgazavtomat, based on the Science and production association "Senayedzhikhaz" the Senayedzhikhaz Scientific and production enterprise, based on Radiogurashdyrma Production association - the Radiogu-rashdyrma plant, based on Nord Scientific and production association - the Dalga Scientific and production enterprise, based on the Science and production association "Stator" the Automatic transfer lines Scientific and production enterprise.

5. Charge to the Cabinet of Ministers of the Azerbaijan Republic in a month:

5.3. resolve other issues following from this Decree.

6. This Decree becomes effective from the date of its publication.

Regulations on the Ministry of defense industry of the Azerbaijan Republic

I. General provisions

1. The ministry of defense industry of the Azerbaijan Republic (further - the Ministry) is the central executive body performing according to the activities determined by the legislation and this Provision state policy and regulation in the sphere of defense, radio electronics, instrument making (further - the sphere of defense industry).

2. The ministry in the activities is guided by the Constitution of the Azerbaijan Republic, the laws of the Azerbaijan Republic, decrees and orders of the President of the Azerbaijan Republic, decisions and orders of the Cabinet of Ministers of the Azerbaijan Republic, international treaties which the Azerbaijan Republic, and this Provision joined.

II. Activities of the Ministry

7. Activities of the Ministry are:

7.1. participates in forming of single state policy in the sphere of defense industry and provides implementation of this policy;

7.2. provides development of the sphere of defense industry;

7.3. prepares according to the state order according to the procedure, stipulated by the legislation, the draft of the State program by the defensive order on military equipment, weapon, the engineering equipment, spare parts, ammunition and other products of defensive value and represents it to the Cabinet of Ministers of the Azerbaijan Republic;

7.4. according to the approved State program by the defensive order within the competence provides creation, production, enhancement, repair, utilization, import export of products of defensive value;

7.5. makes offers on forming of the government budget according to the current legislation about necessary financial resources for implementation of the State program by the defensive order;

7.6. performs in the accepted procedure equipment of the Armed forces and other military connections formed according to the legislation, weapon, military equipment, ammunition and other means.

7.7. performs international cooperation in the sphere of defense industry according to the procedure, established by the legislation;

7.8. performs activities in other directions determined by the legislation.

III. Obligations of the Ministry

8. According to the activities established by this Provision the Ministry carries out the following obligations:

8.1. performs within the competence normative regulation in the sphere of defense industry;

8.2. based on the approved State program by the defensive order within the competence carries out purchases according to the Law of the Azerbaijan Republic "About public procurements", on purchase of defense products, to order placement (performance of works, rendering services, carrying out research and development works, creation, production and regulation of products), signs contracts;

8.3. performs according to the procedure, stipulated by the legislation, import - commodity export (works, services, results of intellectual activities), used in defense industry, including goods (works, services) of dual purpose, raw materials, materials, the equipment and scientific and technical information;

8.4. coordinates activities of other executive bodies in connection with the sphere of defense industry;

8.5 provides implementation of international treaties which participant is the Azerbaijan Republic within the competence;

8.6. exercises the state control in the sphere of defense industry on the questions carried to its powers;

8.7. According to requirements of the Law of the Azerbaijan Republic "About licenses and permissions" on the questions connected with activities of the Ministry, the conclusion about issue of licenses or permissions, their duplicates and amendments, their renewal, suspension, recovery or cancellation, and also issue of permissions to the corresponding types of activity and control of observance of allowing conditions;
