About realization of some provisions of the Law of Ukraine "About obligatory national pension insurance"

Cabinet of Ministers of Ukraine decides:

1. Approve the Procedure for calculation and payment of the amounts of the insurance premiums for obligatory national pension insurance which are not paid during the period from January 1, 2004 to December 31, 2006 concerning persons who did not acquire (will not acquire) pension entitlement for long service according to the Law of Ukraine "About provision of pensions of persons discharged from military service and some other persons", and persons discharged from military service who expressed desire to receive pension according to the procedure and on the conditions provided by the Law of Ukraine "About obligatory national pension insurance" it (is applied).

2. To the Ministry of Finance to provide according to the budget requests of the Pension fund of Ukraine in the bill on the Government budget of Ukraine for the corresponding year of means, necessary for fulfillment of requirements of the Procedure approved by this resolution.

3. This resolution becomes effective from the date of publication.

Procedure for calculation and payment of the amounts of the insurance premiums for obligatory national pension insurance which are not paid during the period from January 1, 2004 to December 31, 2006 concerning persons who did not acquire (will not acquire) pension entitlement for long service according to the Law of Ukraine "About provision of pensions of persons discharged from military service and some other persons", and persons discharged from military service who expressed desire to receive pension according to the procedure and on the conditions provided by the Law of Ukraine "About obligatory national pension insurance"

1. According to this Procedure calculation and payment of the amounts of insurance premiums for obligatory national pension insurance (further - the amounts of insurance premiums) concerning persons who served in the Armed Forces, other military forming, law-enforcement bodies and other bodies created according to the laws of Ukraine that grants the right to award of pension for long service according to the Law of Ukraine "About provision of pensions of persons discharged from military service and some other persons" (further - the Law) and who is performed:

did not acquire pension entitlement for long service according to the Law at the time of achievement of the retirement age established by the Law of Ukraine "About obligatory national pension insurance";

will not acquire pension entitlement for long service according to the Law owing to deprivation of military or special ranks, dismissal from service in connection with condemnation for the intentional crime committed with use of the official capacity or for making of corruption action;

discharged from military service which acquired the right to pension according to the Law of Ukraine "About provision of pensions of persons discharged from military service and some other persons" and expressed desire to receive pension according to the procedure and on the conditions provided by the Law of Ukraine "About obligatory national pension insurance".

2. The amounts of insurance premiums are estimated for every month of service separately proceeding from the amounts of cash cover which were added to person for the corresponding periods of service.

The amounts of insurance premiums are calculated based on the references issued by military units, military commissariats and other representatives on it bodies about the added amount of cash cover in form which is established by board of the Pension fund of Ukraine.

3. The amount of insurance premiums which is subject to payment concerning persons specified in paragraphs the second and fourth Item 1 of this Procedure is calculated management of the Pension fund of Ukraine in areas, the cities and areas in the cities (further - management) in the place of residence to which person addressed to destination pensions, and concerning persons specified in paragraph three of Item 1 of this Procedure - management on the last duty station of person.

Sv - the size of insurance premium calculated proceeding from the size established on the date of charge of payments (income) during the period from January 1, 2004 to December 31, 2006 according to the paragraph to the second Item 1 and to the paragraph to third item 4 of article 4 of the Law of Ukraine "About collection on compulsory national pension insurance" taking into account article 101 of the Law of Ukraine "About the Government budget of Ukraine for 2006".

5. Head departments of the Pension fund of Ukraine in the Autonomous Republic of Crimea, areas, Kiev and Sevastopol generalize information of managements concerning calculation of the amounts of insurance premiums from June 1 till May 31 and till June 15 of year which comes behind reporting, give it to the Pension fund of Ukraine in form which affirms its board.

6. Based on information provided from head departments the Pension fund of Ukraine creates the budget request and sends it to the Ministry of Finance.

7. Expenses on payment of the amounts of insurance premiums are performed according to the law.
