About approval of the Regulations on procedure for appointment and payment to the working mothers of monthly allowance for child care before achievement of age of two years by it

In pursuance of the resolution of the Cabinet of Ministers of the Republic of Uzbekistan of January 25, 2002 N33 "About Measures for Program Implementation of Targeted Support of Socially Vulnerable Segments of the Population for 2002-2003" is decided:

1. Approve the enclosed Regulations on procedure for appointment and payment to the working mothers of monthly allowance for child care before achievement of age of two years by it.

2. Declare invalid:

The regulations on payment procedure of monthly allowance on child care before achievement of age by it two years approved on July 8 by the Ministry of Labour of N640/03-1 and the Ministry of Finance of the Republic of Uzbekistan N12-02-29/338 (reg. N489 of 4.09.98).

The resolution on modification of the Regulations on payment procedure of monthly allowance on child care before achievement of age by it two years approved on May 10 by the Ministry of Labour and Social Protection of the population N 5 and the Ministry of Finance of the Republic of Uzbekistan N40 (reg. N489-1 of 17.05.01).

3. This resolution becomes effective after ten days from the moment of its state registration in the Ministry of Justice of the Republic of Uzbekistan.

Regulations on procedure for appointment and payment to the working mothers of monthly allowance for child care before achievement of age of two years by it

This Provision is developed in pursuance of the Presidential decree of the Republic of Uzbekistan of January 25, 2002 of NUP-3017 "About Strengthening of Targeted Support of Socially Vulnerable Segments of the Population" and resolutions of the Cabinet of Ministers of the Republic of Uzbekistan of January 25, 2002 N33 "About Measures for Program Implementation of Targeted Support of Socially Vulnerable Segments of the Population for 2002-2003", Resolutions of the President of the Republic of Uzbekistan of December 12, 2007 of NPP-744 "About the forecast of the main macroeconomic indicators and parameters of the Government budget of the Republic of Uzbekistan for 2008 and determines payment procedure to the working mothers of monthly allowance by child care before achievement of age of two years by it.

This Provision does not extend to mothers working in the budget sphere.

1. The monthly allowance on child care before achievement of age of two years (further hereinafter is referred to as - child care allowance) by it is granted and paid to persons, as a rule mother, the father, the adoptive father, the guardian or other relatives (further "persons replacing mother") who are actually performing leaving for by the child born, adopted, accepted under guardianship before achievement of age of two years by it.

2. The child care allowance is paid monthly, irrespective of number of children for whom leaving and working life of person receiving benefit in sizes is performed:

since February 1, 2002 - 170 percent from the minimum wage established in the Republic of Uzbekistan;

since 2003 - 200 percent from the minimum wage established in the Republic of Uzbekistan.

3. The child care allowance is granted to mothers (persons replacing mother) since month of the request for purpose of benefit, but not earlier than day of the end of maternity leave.

The benefit for incomplete month is paid in the share pro rata to number of calendar days of stay of mother (person replacing mother) in leave in this month.

4. If leaving is performed behind two and is paid by the children who were more born, adopted or accepted under guardianship, then child care allowance in unary size up to achievement of two-year age by the younger child.

If during the child care leave before achievement of two-year age by it mother has the right to maternity leave to the second child, then is paid for this period one or the other benefits at the choice of mother.

5. Working (the student with the separation from production serving) the child care allowance is granted to mothers (persons replacing mother) on place of employment (studies, services). The basis for purpose of benefit is the decision of administration of the company, organization, organization.

6. The working mothers (person replacing mother) have the right to simultaneous receipt of child care allowance and the salary during work on the terms of part-time or under the agreement with the employer at home.

7. For purpose of child care allowance the following documents are submitted:

a) statement for purpose of child care allowance;

b) copy of the certificate of birth of the child.

Persons receiving child care allowance instead of the child's mother in addition submit the document testimonial of absence of mother - the death certificate of mother of child(children), the reference issued by judicial authorities about deprivation of mother of the parent rights or other documents confirming impossibility of receipt of child care allowance by child(children) mother.

8. Allowance payment on child care is performed for current month.

9. The child care allowance is paid to the persons receiving child care allowances, occupied on seasonal works based on the employment contract (contract) during accomplishment of seasonal works in the place of accomplishment of seasonal works, and upon termination of season (during off-season) - self-government institutions of citizens at the place of residence taking into account needs in accordance with general practice. In case of execution of an employment agreement about work in the next season allowance payment on child care is resumed on place of employment since the month appointed for appearance to work.

10. Allowance payment on child care stops in cases:

a) execution to the child for whom leaving, age of two years is performed;

b) placements of the child to specialized agencies (the house of the baby) on complete state providing;

c) death of the child;

d) departure of family with the child on the permanent residence out of limits of the Republic of Uzbekistan.

About the circumstances attracting the termination of allowance payment on child care, the receiver of benefit shall report to the bodies performing allowance payment.
