1. Approve the enclosed Rules of maintaining the state register of sites of pollution.

1. Rules of maintaining the state register of sites of pollution (further - Rules) are developed according to the Ecological code of the Republic of Kazakhstan of January 9, 2007 and determine procedure for maintaining the state register of sites of pollution.
2. The state register of sites of environmental pollution (further - the register) is databank in which data on types and origin of sites of pollution, amounts and concentration of pollutants on them, accessory of sites of pollution and measures for their liquidation are collected.
3. The organization of maintaining the register is performed by authorized body in the field of environmental protection at the expense of budgetary funds. The register consists from central and territorial registers.
4. The register is kept based on the register passport of the site of pollution (further - the register passport).
5. On each site of pollution by the user of nature the register passport is constituted and it is represented in the relevant territorial authority of environmental protection.
6. Concerning the Rules of sites of pollution by users of nature which are available on Date of Introduction in action register passports as of December 31, 2007 are constituted and go to territorial authority of environmental protection no later than March 10, 2008.
7. The register passport of the new site of pollution is constituted by the user of nature within three months after its identification.
8. The register passport (according to appendix 1 to these rules) includes:
1) registration number;
2) schematic card of location of the site of pollution and its geographical coordinates;
3) type of economic and other activity or the natural phenomenon as a result of which the site of pollution was formed;
4) the user of nature in whose property (ownership) there is territory of placement of the site of pollution;
5) category of lands;
6) parameters of the site of pollution;
7) placement specifications;
8) chemical composition (name, amount and concentration of pollutants);
9) possible ways of migration of pollutants;
10) degree of study of the site of pollution;
11) climatic characteristics of the territory of arrangement of the site of pollution;
12) the realized actions for localization and recultivation of the site of pollution.
9. The register passport is signed by the officials who constituted and registered the document with indication of surname, initials and post.
10. The register passport is accepted, registered, registered and stored in territorial authority of environmental protection.
11. Registration of sites of pollution is drawn up within one month from the date of receipt of the register passport from the user of nature.
12. In case of discrepancy of the provided register passports to requirements of Rules, they are not registered and within five calendar days from the date of their receipt to territorial authorities of environmental protection return to the user of nature to completion in time, not exceeding ten calendar days from the date of refusal in registration.
13. The registered register passports are entered in the register which is drawn up according to appendix 2 to these rules.
14. The copy of the registered register passport is issued to the user of nature.
15. The data of the register passport specified in subitems 4), 6), 8), 12) of Item 8 of these rules are updated by the user of nature annually and no later than March 10 go to territorial authority of environmental protection.
16. Maintaining the territorial register includes:
1) registration of sites of pollution by entering of the corresponding record into the territorial register;
2) completing on areas and storage of register passports;
3) information support of state bodies and other interested persons;
4) updating (updating) of the territorial register, including exception of the site of pollution of the register with indication of date and the bases for exception.
17. Registration number is assigned to each site of pollution. The registration number excluded from the territorial register is not appropriated to new sites of pollution.
18. The exception of sites of pollution of the territorial register is carried out based on submission by the user of nature of the project on liquidation of pollution and the act of the performed works on this site coordinated with territorial authority of environmental protection.
19. Territorial authorities of environmental protection represent the territorial register on the electronic medium to the central executive body in the field of environmental protection (daleetsentralny executive body) no later than May 10 annually, in case of identification of new sites of pollution information is provided no later than ten calendar days after modification and amendments of the territorial register.
20. Maintaining the central register is performed by the central executive body.
21. Maintaining the central register includes:
1) centralized information collection about sites of pollution;
2) updating (updating) of the central register;
3) information support of state bodies and other interested persons.
22. Changes and amendments in the central register are made by the central executive body based on written information, arrived from territorial authorities of environmental protection.
23. Control of timely entering of register passports into the register, accuracy of the information, and also the analysis, accounting, systematization, storage of register passports of sites of pollution and creation of the automated system of their processing are performed by territorial authorities of environmental protection.
