For the purpose of ensuring control of observance of security measures, assessment of sufficiency and efficiency of actions for the prevention and liquidation of emergency situations on industrial facilities of the Republic of Kazakhstan the State committee of the Republic of Kazakhstan on emergency situations decides:

1. Approve the enclosed Regulations on the declaration of safety of industrial facility of the Republic of Kazakhstan.

2. To akims Almaty, East Kazakhstan, Jambyl and Almaty to organize development by the companies, organizations, organizations irrespective of patterns of ownership of the declaration of safety of industrial facilities during 1998-1999, to akims of other areas of the republic taking into account the accumulated experience to carry out this work in 1999-2001.

3. Charge to Department of the prevention of emergency situations together with Department on state supervision of emergency situations, safe operation in the industry and to mountain supervision to prepare and in coordination with the interested central and local executive bodies to submit for approval "Procedure for development of the Declaration of safety of industrial facility" and "The list of industrial facilities which activities are connected with the increased risk of emergence of emergency situations". Regulations on the Declaration of safety of industrial facility of the Republic of Kazakhstan

1. Declaring of safety of industrial facility of the Republic of Kazakhstan which activities are connected with the increased danger of production (further - industrial facility) is performed for the purpose of ensuring control of observance of security measures, assessment of sufficiency and efficiency of actions for the prevention and liquidation of emergency situations on industrial facility.

2. The declaration of safety of industrial facility of the Republic of Kazakhstan (further - the declaration) is the document determining possible nature and scales of emergency situations on industrial facility and actions for their prevention and liquidation.

3. The declaration shall characterize safety of industrial production at stages of its commissioning, operation and conclusion from operation and to contain:

data on location, climatic conditions, placement and number of personnel of industrial facility;

the main characteristics and features of engineering procedures and products made on industrial facility;

risk analysis of origin on industrial facility of emergency situations of technogenic and natural nature, including determination of sources of dangers, assessment of conditions of development and possible effects of emergency situations, including emissions in the environment of hazardous substances;

the characteristic of control systems behind safety of industrial production, data on amounts and content of organizational, technical and other actions for the prevention of emergency situations;

data on creation and maintenance in readiness of the local warning system of personnel of industrial facility and population about emergence of emergency situations;

the characteristic of actions for creation on industrial facility, preparation and to maintenance in readiness of forces and means according to the prevention and liquidation of emergency situations, and also actions for training of workers of industrial facility in methods of protection and actions in emergency situations;

the characteristic of actions for protection of personnel of industrial facility in case of emergency situations, operations procedure of forces and means according to the prevention and liquidation of emergency situations;

data on necessary amounts and the nomenclature of reserves of material and financial resources for liquidation of emergency situations;

data on procedure for compensation of damage physical and legal in case of accident, the name and the address of the insurer, type of insurance and the maximum extent of insured responsibility;

procedure for informing the population and local executive bodies in the territory of which the industrial facility, about the emergency situations predicted and arisen on industrial facility is located.

4. The declaration is developed by the companies, organizations and the organizations irrespective of their form of business (daleeorganization) for the designed and operating industrial facilities.

5. The procedure for development of the declaration is determined by the State committee of the Republic of Kazakhstan on emergency situations in coordination with the interested central and local executive bodies.

6. The declaration affirms the head of the organization which part the industrial facility is. Person who approved the declaration bears responsibility for completeness and reliability of information provided in it.

7. The declaration is constituted in five copies and it is represented in the State committee of the Republic of Kazakhstan on emergency situations (three copies) and local executive body in the territory of which the declared industrial facility is located. The declaration is presented in the stitched form.

The first copy of the approved declaration is stored in the organization which approved the declaration.

8. The declaration shall be specified in case of change of the safety requirements determined by existing rules and rules or the data on industrial facility provided in the declaration, but at least once in five years.

9. The state committee of the Republic of Kazakhstan on emergency situations will organize examination of declarations and makes explanations on application of this provision.

10. The list of industrial facilities is considered by local executive bodies and is submitted for approval in the State committee of the Republic of Kazakhstan on emergency situations.
