About regulatory legal acts concerning ensuring implementation of the Law of Ukraine "About the special mode of innovative activities of technology parks"

For the purpose of ensuring realization of provisions of the Law of Ukraine "About the special mode of innovative activities of the technology Cabinet of Ministers of Ukraine parks decides:

1. Approve enclosed:

Regulations on procedure for consideration and approval of priority activities of the technology park;

Procedure for consideration, examination and state registration of projects of technology parks.

Regulations on procedure for consideration and approval of priority activities of the technology park

1. This Provision determines procedure for consideration by Presidium of National academy of Sciences and approval of MON of priority activities of the technology park.

2. The technology park files to Presidium of National academy of Sciences such documents (in duplicate):

the letter of appeal about consideration of the list of priority activities of the technology park;

the list of priority activities of the technology park (further - the list);

explanatory note with detailed reasons for reference of the offered directions to priority, feasibility of their development and the forecast of results of their realization;

notarially attested copy of the certificate about state registration of the technology park;

the copy of constituent documents - for the technology park - the legal entity; the notarized copy of cooperation agreement and the copy of constituent documents of each member of the technology park - for the technology park - group of legal entities.

3. The explanatory note to the list shall include:

comparative analysis of condition of developments which are performed in these directions in the world and in Ukraine, their relevance and tendencies of development;

reasons for availability of sufficient scientific, technical and technology capacity of the technology park or its basic organization for the declared priority activities;

indicators of competitiveness of scientific and technical and innovative products of the technology park in the domestic and foreign market and calculations of potential amounts of its consumption;

the forecast of social and economic, budget and ecological results of activities of the technology park behind the priority activities declared to them.

4. After check of completeness of the documents noted in Item 2 of this Provision (further - documents), the Presidium of National academy of Sciences registers their receipt and issues to the technology park the written confirmation of the fact of receipt of documents from it.

4-1. The presidium of National academy of Sciences within 20 days processes documents and prepares conclusion concerning feasibility of approval of the list with the formulation in case of availability of specific notes and sends it to the technology park.

5. The technology park in case of receipt of the conclusion with notes of presidium of National academy of Sciences finishes the list and sends it in MON together with documents and the copy of the conclusion of presidium of National academy of Sciences.

6. MON in three-day time considers documents and submits them for consideration of the Commission on the organization of the activities of technology parks and innovative structures of other types formed by the resolution of the Cabinet of Ministers of Ukraine of August 9, 2001 N961 (The Official Bulletin, 2001, N 32, of the Art. 1483) (further - the Commission).

7. The commission considers the documents submitted by MON within 30-day term after their receipt and MON provides recommendations concerning approval of the list.

8. Taking into account recommendations of the Commission of MON approves the list in five-day time or returns documents to the technology park on completion with the formulation of notes in case:

the park does not provide documents or in the submitted documents data according to requirements of Items 2 and 3 of this Provision are not displayed;

in documents false information is found;

the priority directions offered by the park it activities do not answer the main authorized activities of the technology park - the legal entity, to the main authorized activities of members of the technology park - groups of legal entities, to the priority directions of development of science and technology determined by the Law of Ukraine "About the priority directions of development of science and technology" and the priority directions of innovative activities determined by the Law of Ukraine "About the priority directions of innovative activities in Ukraine";

scientific, technical, technology, personnel, potential and financial and economic production of the park is insufficient for realization of the priority directions offered them it activities.

9. The technology park has the right after completion of the list repeatedly to give it together with documents for consideration of presidium of National academy of Sciences.

10. Changes and additions are made to the approved list according to the procedure, determined by this Provision.

Procedure for consideration, examination and state registration of projects of technology parks

1. This Procedure determines the procedure of consideration, examination and state registration of projects of technology parks (further - the project).

2. In this Procedure terms are used in such value:

the contractor of the project - the technology park, his participant, joint business which directly implement the project of the park;

equipment, the equipment - machines (except the vehicles intended for transportation of people and/or load, the special equipment installed on them or mechanisms, and also all types of cars, tractors, motorcycles, other motorized vehicles), mechanisms, devices, devices, held for use in engineering procedure during project implementation;

delivery products - products which represent details of equipment (equipment) or their set have constructive integrity, are made on sets of design and technology documentation, intended for application as a part of equipment (equipment), do not perform independent functions without connection with other details, do not undergo change in the course of their application as a part of equipment (equipment) and held for use during project implementation;
