About approval of the Procedure for coordination with the Cabinet of Ministers of Ukraine of privatization of objects of state-owned property

Cabinet of Ministers of Ukraine decides:

1. Approve the Procedure for the agreement with the Cabinet of Ministers of Ukraine for privatization of objects of state-owned property it (is applied).

2. To the Antimonopoly Committee and Fund of state-owned property to establish procedure for representation by bodies of the Antimonopoly Committee of the conclusions under the terms of privatization of enterprise monopolists in a month.

3. Recognize invalid:

Procedure for coordination with the Cabinet of Ministers of Ukraine of conditions of privatization of separate objects of state-owned property and fixing in state-owned property of blocks of shares of open joint stock companies

This Procedure regulates reconciliation procedure with the Cabinet of Ministers of Ukraine of conditions of privatization of separate objects of state-owned property (further - objects) and fixing in state-owned property of blocks of shares of the open joint stock companies (OJSC).

The decision on fixing in state-owned property of blocks of shares is made after creation of joint stock company.

I. Coordination with the Cabinet of Ministers of Ukraine of conditions of privatization

1. The state body of privatization in 5-day term from the date of obtaining from the commission on privatization of subject of the relevant documents (from the date of acceptance the decision on sale of shares of joint stock company created by corporatisation) sends draft copies of the plan of privatization (the plan share placing) object to body, authorized to manage state-owned property of object which is subject to privatization.

The body, authorized to manage state-owned property of object, in 10-day term from the date of receipt of documents sends to state body of privatization the conclusions concerning conditions of privatization of object.

2. The fund of state-owned property in 10-day term from the date of obtaining from the commission on privatization of subject of necessary documents of the companies which are privatized submits to the Cabinet of Ministers of Ukraine copies of such documents:

draft of the plan of privatization (plan share placing);

appraisal report of complete property complex;

technical data sheet of the parcel of land of state-owned property what is subject to sale of privatization by state body;

the conclusion of body, authorized to manage state-owned property of object, concerning privatization conditions;

the conclusion of the Antimonopoly Committee concerning conditions of privatization of enterprise monopolists in the nation-wide market of the corresponding goods recognized such in established about.

The procedure for provision of conclusions of the Antimonopoly Committee is established jointly by Fund of state-owned property and the Antimonopoly Committee.

The Antimonopoly Committee in 10-day term from the date of receipt of the relevant documents sends to state body of privatization the conclusions concerning conditions of privatization of object.

3. The decision on coordination of conditions of privatization of object (the draft of the plan of privatization or the plan of share placing) and changes to them (if it concerns change of method of placement and the number of the shares offered for realization) is accepted at cabinet meeting of Ukraine and is drawn up by the order.

The decision on modification of the plan of privatization (the plan of share placing) of object concerning implementation of shares which were not sold to any of the methods provided by the plan are accepted by state body of privatization.

5. The term of coordination with the Cabinet of Ministers of Ukraine of conditions of privatization of objects constitutes 20 calendar days from the date of representation of state-owned property of the relevant documents by Fund.

6. The state body of privatization in 10-day term from the date of coordination of conditions of privatization approves the plan of privatization (the plan of share placing) of object.

II. Fixing in state-owned property of blocks of shares of joint stock company

7. The decision on fixing of the block of shares which temporarily remain in state-owned property and also on early sale of the specified block of shares or its part is accepted in the form of the order of the Cabinet of Ministers of Ukraine.
