About approval of the Procedure for transportation by patients who go en route through the territory of Ukraine, drugs and psychotropic substances

According to article 22 of the Law of Ukraine "About drugs, psychotropic substances and precursors" the Cabinet of Ministers of Ukraine decides:

1. Approve the Procedure for transportation by patients who go en route through the territory of Ukraine, drugs and psychotropic substances which is applied.

2. To the Ministry of Foreign Affairs report to the governments of foreign states about approval of the Procedure noted in Item 1 of this resolution.

3. This resolution becomes effective since January 1, 2008.

Procedure for transportation by patients who go en route through the territory of Ukraine, drugs and psychotropic substances

1. This Procedure determines conditions of transportation by foreigners and stateless persons which go en route through the territory of Ukraine (further - patients), drugs and the psychotropic substances included in tables II and III of the list of drugs, psychotropic substances and precursors (further drugs and psychotropic substances) approved by the resolution of the Cabinet of Ministers of Ukraine of May 6, 2000 N770 (The Official Bulletin of Ukraine, 2000, N 19, Art. 789; 2002, N 51, the Art. 2316), only for own treatment.

If for continuation of treatment until departure from the territory of Ukraine to the patient drugs are in addition appointed, psychotropic substances, the institution of health care issues the corresponding reference which is signed by the chief physician and his deputy and makes sure seal.

3. Import to the territory of Ukraine by patients of drugs and psychotropic substances is performed on condition of obligatory written declaring according to the procedure, established for citizens.

4. For implementation of customs control and customs clearance of drugs and psychotropic substances of the patient files such documents:

customs declaration;

the recipe issued by institution of health care or the doctor of foreign state addressed to the patient legalizirovanny consular establishment of Ukraine abroad;

the passport document which certifies face of the patient and grants the right to crossing of frontier of Ukraine.

For medicines which are registered in Ukraine the copy of the quality certificate of medicine issued by the producer is attached.

5. The patient can import on customs area of Ukraine or export out of its limits drugs and psychotropic substances in the quantity determined in the recipe or the certificate of provision of medical care in the territory of Ukraine, but no more than 10 ampoules of drug or psychotropic substance, 50 tablets of psychotropic substance, 10 transdermal systems.

6. Drugs and psychotropic substances which are not registered in Ukraine can be imported on the territory of Ukraine on condition of provision of data on registration of medicine in the territory of the state from which the patient moves.

7. Drugs and psychotropic substances which are exported out of limits of Ukraine are subject to obligatory written declaring according to the procedure, provided for citizens.

For implementation of customs control and customs clearance of such drugs and psychotropic substances the documents noted in item 4 of this Procedure and also the customs declaration which is drawn up during import of drugs and psychotropic substances are filed.

8. The patient has no right in any way to alienate drugs and psychotropic substances.

Consular establishments of Ukraine abroad shall during legalization of the recipe on drugs and psychotropic substances to warn in writing the patient about noted requirement.

9. Control of observance of requirements of this Procedure is exercised within the powers by State Customs Service, Administration of State frontier service, MZ.
