About the state accreditation of the organizations performing activities in information technology field

In pursuance of the Tax Code of the Russian Federation the Government of the Russian Federation decides:

1. Approve the enclosed Regulations on the state accreditation of the organizations performing activities in information technology field.

2. Determine that the federal executive body authorized on implementation of the state accreditation of the organizations performing activities in information technology field is the Ministry of digital development, communication and mass communications of the Russian Federation.

Regulations on the state accreditation of the organizations performing activities in information technology field

1. This Provision establishes procedure for giving by the organizations performing activities in information technology field, documents for receipt of the state accreditation, procedure for their consideration, decision making about the state accreditation and issues of the statement from the register of the accredited organizations performing activities in information technology field (further - the register), and also the bases and procedure for cancellation of the state accreditation.

2. The state accreditation of the organizations performing activities in information technology field is carried out for the purpose of rendering measures of the state support to them.

3. The state accreditation of the organization performing activities in information technology field is carried out by the Ministry of digital development, communication and mass communications of the Russian Federation (further - authorized federal executive body).

4. The Russian organization performing activities in information technology field irrespective of legal form and pattern of ownership has the right to obtain the state accreditation provided that this organization performs development and program implementation for computer and databases on the material carrier or in electronic form on communication links irrespective of agreement type and (or) renders services (performs works) on adaptation and modification of the computer programs and databases (software and information products of computer facilities), to installation, testing and support of the computer programs and databases (daleeorganization).

5. For receipt of the state accreditation the organization represents to authorized federal executive body directly or by mail the registered mail (with the inventory of attachment) the following documents:

a) statement for provision of the state accreditation;

b) the help signed by the head of the organization, confirmatory that the organization performs the activities specified in item 4 of this provision;

c) ceased to be valid;

d) ceased to be valid.

5(1). The applicant has the right to provide together with the documents specified in Item 5 of this provision, the extract from the Unified State Register of Legal Entities.

5(2). In case of non-presentation by the applicant of the document specified in Item 5 (1) this provision, the authorized federal executive body requests by means of interdepartmental request, including electronically with use of single system of interdepartmental electronic interaction, the Federal Tax Service has data from the Unified State Register of Legal Entities concerning the applicant.

5(3). The authorized federal executive body has no right to demand from the applicant of submission of documents, not stipulated in Item the 5th this provision.

6. The authorized federal executive body makes the decision on the state accreditation (on failure in the state accreditation) the organizations no later than 30 working days from the date of receipt from it of the documents specified in Item 5 of this provision.

7. The decision on failure in the state accreditation is made by authorized federal executive body in case:

a) giving by the organization not of all documents specified in Item 5 of this provision;

b) establishments of mismatch of the organization activity specified in the help, the activities specified in item 4 of this provision.

8. The authorized federal executive body based on the decision on the state accreditation enters data on the organization in the register.

9. The authorized federal executive body sends to the organization the statement from the register in the form approved by the Ministry of digital development, communication and mass communications of the Russian Federation or the decision on failure in the state accreditation no later than 5 working days from acceptance date of the relevant decision.

The payment for accreditation, including for issue of the statement from the register, is not levied.

10. The organization has the right to submit repeatedly documents to authorized federal executive body after elimination of the reasons in connection with which to it it was refused the state accreditation.

11. The authorized federal executive body performs maintaining the register of the accredited organizations, including provides timely modification of the data containing in it, according to the procedure, approved by authorized federal executive body and also provides disclosure of the data containing in the register by their placement in accordance with the established procedure on the Internet.

12. The authorized federal executive body represents to the Federal Tax Service and the Ministry of digital development, communication and mass communications of the Russian Federation the copy of the decision on the state accreditation within 7 working days from acceptance date of the relevant decision.

13. Concerning the accredited organization it can be carried out according to the procedure, established by the legislation of the Russian Federation, check regarding compliance of the activities which are actually performed by this organization, the activities specified in item 4 of this provision.

14. The state accreditation is cancelled by authorized federal executive body in case:

a) voluntary failure of the organization from the state accreditation;

b) establishments of mismatch of the activities which are actually performed by this organization, the activities specified in item 4 of this provision.

15. In case of voluntary failure from the state accreditation the organization sends the corresponding statement which shall be considered within 5 working days from the date of receipt to authorized federal executive body.

16. In case of detection of mismatch of the activities which are actually performed by this organization, the activities specified in item 4 of this provision, the authorized federal executive body within 5 working days from the date of identification of the fact of such mismatch makes the decision on cancellation of the state accreditation of this organization.
