About approval of the Procedure of the state control of the international transfers of goods of double use

According to article 8 of the Law of Ukraine "About the state control of the international transfers of military goods and double use" the Cabinet of Ministers of Ukraine decides:

1. Approve the Procedure of the state control of the international transfers of goods of double use it (is applied).

2. Recognize invalid resolutions of the Cabinet of Ministers of Ukraine according to the list which is attached.

Procedure of the state control of the international transfers of goods of double use

General part

1. This Procedure determines procedures of implementation of the state control of the international transfers:

the goods of double use entered in the Single list of goods of double use according to appendix;

the goods which are not entered in the Single list of goods of double use in the cases determined by article 10 of the Law of Ukraine "About the state control of the international transfers of military goods and double use" (further - the Law).

2. In this Procedure terms are used in the value given in the Law.

3. The international transfer of the goods specified in Item of 1 this Procedure (further - goods), can be performed by the subject of implementation of the international transfers of goods, the central executive body, to military forming, law enforcement agencies, bodies and divisions of civil protection of Ukraine (further - subjects), to foreign subjects of economic or other activity (further - the foreign subject) in the presence at them the corresponding permission or Goseksportkontrol's conclusion specified in article 15 of the Law.

4. Permission or Goseksportkontrol's conclusion to the right of implementation of the international transfer of any product, the equipment or material grants the right to technology transfer which is minimum necessary for installation, operation of goods on purpose, including maintenance and repair, in the quantity and amounts determined by such permission or the conclusion. The quantity and amounts of such technology are limited to information provided in documentation (the passport, the form) which is specially developed for such goods by his developer or the producer and is delivered together with it.

5. The international transfers of goods which are material data carriers carried to the state secret, are performed with observance of requirements of the legislation concerning protection of the state secret.

6. In case of movement of goods through customs border of Ukraine, their customs control and customs clearance are performed according to the procedure, established by the customs legislation.
