About approval of the Procedure for sampling of products for determination of its qualitative indexes and form of the sampling report of products

According to articles 14 and 15 of the Law of Ukraine "About the basic principles of the state supervision (control) in the sphere of economic activity" the Cabinet of Ministers of Ukraine decides:

1. Approve applied:

Procedure for sampling of products for determination of its qualitative indexes;

form of the sampling report of products.

2. To the ministries and other central executive bodies to bring own acts into accord with this resolution.

3. This resolution becomes effective along with the Law of Ukraine "About the basic principles of the state supervision (the controlling sphere of economic activity").

Procedure for sampling of products for determination of its qualitative indexes

1. This Procedure determines the mechanism of implementation (control) of sampling of products by state supervision bodies at subjects of housekeeping for conducting examination (testing).

Features of sampling of separate types of products are determined by other regulatory legal acts.

2. Sampling of products is performed based on the written motivated decision of the head of state supervision body (control) or its deputy for the law of Ukraine "About the basic principles of the state supervision (control) in the sphere of economic activity".

In the decision on sampling of products the quantity of samples for each type (type) of products (at least two), necessary for conducting examination (testing), and also the place of its carrying out is noted. At the same time the quantity of product samples which are selected shall answer the quantity noted in the relevant decision of state supervision body (control).

3. Sampling of products is performed by the official of state supervision body (control) in the presence of the head of the legal entity, the physical person - the entrepreneur or person authorized by them which have the right to declare the petition concerning the actions connected with such selection about what record in the sampling report of products is made.

4. The official of state supervision body (control) prior to sampling of products shall show to the subject of housekeeping the relevant decision and acquaint him with procedure for sampling of products.

5. The selected product samples shall be completed, packed and sealed up (are sealed) by the official of state supervision body (control) and to remain and be transported in conditions which provide invariance of parameters in which expertize (testing) of such samples will be carried out.

The control product sample remains at the subject of housekeeping and is stored in conditions which provide preserving its quality and integrity, before acquaintance with results of examination (testing).

6. The official who selects product samples for conducting examination (testing) provides their preserving and timeliness of delivery to the venue of examination (testing).

7. The official of state supervision body (control) draws up the sampling report of products (further - the act) in triplicate.

In the act are noted:

place and date of its creation;

number and date of the decision of the head of state supervision body (control) based on which sampling of products, position, surname, name and middle name of the official who performed their selection is performed;

the name and the location of the legal entity and/or his separate division or surname, name and middle name of the physical person - the entrepreneur at which sampling of products is performed;

position, surname, name and middle name of the authorized person of the subject of housekeeping;

the list and quantity of the selected product samples with indication of the producer, date of production, series (number) of batch, total cost of samples;

additional data (taking into account specifics of product samples).

8. All copies of the act are signed by the official who selected product samples, and the head of the legal entity, the physical person - the entrepreneur or person authorized by them.

In case of refusal the head of the legal entity, the physical person - the entrepreneur or person authorized by them from signing of the act the official of state supervision body (control) makes in the act entry that the head of the legal entity, the physical person - the entrepreneur or is authorized by them person are informed of the act and refused the signature.

9. One copy of the act is transferred together with the sealed-up (sealed) product samples to the authorized and/or accredited organization (laboratory) which is intended for conducting examination (testing) and is noted in the decision on sampling of products, the second, - there is at the subject of housekeeping, third - at the official who performed sampling of products.
