This resolution becomes effective from the date of its signing, except for subitems 434-28), 434-39), 434-40), 434-41), 434-42), 434-43), 434-44) and 434-45) of Item 16 and the subitem 364) of Provision Item 17 which become effective since April 11, 2019 according to the laws of the Republic of Kazakhstan of October 5, 2018 "About standardization" and "About modification and amendments in some legal acts of the Republic of Kazakhstan concerning ensuring unity of measurements and standardization".

Regulations on the Ministry of Agriculture of the Republic of Kazakhstan

Chapter 1. General provisions

1. The Ministry of Agriculture of the Republic of Kazakhstan (further – the Ministry) is the state body of the Republic of Kazakhstan performing management in spheres:

1) agro-industrial complex;

2) the irrigated agriculture and agromelioration;

3) land resources;

4) protection, reproduction and use of fish resources and other water animals, and also aquaculture;

5) especially protected natural territories regarding preserving and reproduction of the rare and being under the threat of disappearance species of fish and other water animals;

6) in limits, stipulated by the legislation, cross-industry coordination of state bodies in the field of activity carried to its competence.

2. The ministry has departments:

1) republican public institution "Committee of veterinary control and supervision of the Ministry of Agriculture of the Republic of Kazakhstan";

2) public institution "Committee of the state inspection in agro-industrial complex of the Ministry of Agriculture of the Republic of Kazakhstan";

3) republican public institution "Management committee land resources of the Ministry of Agriculture of the Republic of Kazakhstan";

4) republican public institution "Committee of fishery of the Ministry of Agriculture of the Republic of Kazakhstan".

3. The ministry performs the activities according to the Constitution and the laws of the Republic of Kazakhstan, acts of the President and the Government of the Republic of Kazakhstan, other regulatory legal acts, and also this Provision.

4. The ministry is legal entity in form of business of public institution, has symbols and distinctions (in case of their availability), seals with the image of the State Emblem of the Republic of Kazakhstan and stamps with the name in the state and Russian languages, forms of the established sample, accounts in bodies of treasury according to the legislation of the Republic of Kazakhstan.

5. The ministry enters the civil relations from own name.

6. The ministry has the right to act as the party of the civil relations on behalf of the state if it is authorized on it according to the legislation of the Republic of Kazakhstan.

7. The ministry of questions of the competence of the procedure established by the legislation makes the decisions which are drawn up by orders of the head of the Ministry and other acts, stipulated by the legislation the Republic of Kazakhstan.

8. The structure and limit of the number of staff of the Ministry affirm according to the legislation of the Republic of Kazakhstan.

9. Ministry location: The Republic of Kazakhstan, the city of Astana, Esilsky district, Prospekt Mang_l_k ate 010000,, the house 8, the office building "The house of the ministries", entrance No. 3.

10. This Provision is the constituent document of the Ministry.

11. Financing of activities of the Ministry is performed from the republican budget according to the legislation of the Republic of Kazakhstan.

12. The ministry is forbidden to enter contractual relations with subjects of entrepreneurship regarding accomplishment of the obligations which are powers of the Ministry.

If the Ministry by legal acts is granted the right to perform the activities which are bringing in incomes, then the gained income goes to the government budget if other is not established by the legislation of the Republic of Kazakhstan.

Chapter 2. Tasks and powers of the Ministry of Agriculture of the Republic of Kazakhstan

13. Tasks:

1) forming of agrarian policy of the state, development plans, national projects in regulated spheres;

2) forming of bases of creation of competitive agricultural commodity production, ensuring food security and mobilization readiness of the Republic of Kazakhstan;

3) information and consulting providing agro-industrial complex;

4) implementation of cross-industry coordination and public administration in regulated spheres;

5) implementation of methodical management of activities of other state bodies within the competence;

6) forming of state policy in the sphere of ensuring rational and effective management of land resources;

7) forming and realization of state policy in the sphere of protection, reproduction and use of fish resources and other water animals, and also aquacultures;

8) implementation of other tasks assigned to the Ministry within the competence.

14. Powers:

1) rights:

request and receive in the procedure established by the legislation from state bodies, the organizations, their officials necessary information and materials;

make explanations and comments on application of the current legislation on the questions entering competence of the Ministry;

perform advanced training and training of staff of the Ministry;

encourage workers, impose authority punishments, bring workers to financial responsibility in the cases and procedure provided by the Labor code and the legislation on public service;

participate in limits of competence of project development of regulatory legal acts and international treaties of the Republic of Kazakhstan;

participate in activities of the international organizations in the field of activity carried to competence of the Ministry;

give instructions, obligatory for execution, to territorial subdivisions of departments;

take a legal action, make claims for the purpose of protection of the rights and interests of the Ministry according to the legislation of the Republic of Kazakhstan;

render assistance in limits of the competence to administrative authorities, officials in the cases provided by the Administrative procedural Procedure Code of the Republic of Kazakhstan;

refuse realization of the rights of the participant of ministerial procedure in cases and on the bases which are established by the Administrative procedural Procedure Code of the Republic of Kazakhstan;

perform other rights provided by the existing legal acts;

2) obligations:

adopt regulatory legal acts, obligatory for execution, within the competence;

consider appeals, applications and claims of physical persons and legal entities on the questions entering competence of the Ministry, according to the procedure, established by the legislation of the Republic of Kazakhstan;

accept and register addresses, promote their registration and the documents attached to them, give opportunity to eliminate formal errors and to supplement the enclosed documents;

explain to the participant of ministerial procedure of its right and obligation on the questions connected with implementation of ministerial procedure;

to beforehand notify the participant of ministerial procedure on the place and time of the spent hearing;

hear the participant of ministerial procedure before decision making on ministerial procedure, except as specified, provided by the Administrative procedural Procedure Code of the Republic of Kazakhstan;

bring the administrative act to the attention of the participant of ministerial procedure or their representatives according to the procedure, established by the Administrative procedural Procedure Code of the Republic of Kazakhstan;

exercise coordination and control of activities of departments, their territorial authorities, and also subordinated organizations of the Ministry;

provide timely and high-quality execution of orders of the Head of state, Administration of the President of the Republic of Kazakhstan and the Government of the Republic of Kazakhstan, and also plans of bill works of the Government of the Republic of Kazakhstan for the corresponding years;

perform other obligations provided by the existing legal acts.

15. Functions:

1) develops the main directions of state policy in the area:

state support of production of grain and organization of their implementation;

technical policy in the field of agro-industrial complex;

2) is performed by international cooperation in the area:

quarantine of plants;

protection of plants;

selections and seed farmings;

veterinary science;

beekeepings;

use and protection of pastures;

protection, reproduction and use of fish resources and other water animals, and also aquaculture;

2-1) provides development of relations of the Republic of Kazakhstan with foreign states in the field of quarantine of plants;

2-2) will organize international cooperation in the field of agro-industrial complex and the rural territories;

3-1) realizes state policy in the field of scientific providing agro-industrial complex and training, including will organize actions for development of subordinated higher educational institutions, the research and experienced and experimental organizations;

4-1) performs reception of citizens and representatives of legal entities, timely and complete examination, the analysis, monitoring and identification of the system problems lifted by the population in addresses, messages, responses, offers, requests, adoption of decisions on them;

Develops 5) and approves recommended schemes of specialization of regions in optimum use of agricultural holdings for production of specific types of agricultural products;

Develops 6) and approves standard forms of the agreement (memorandum) concerning diversification of the structure of sown areas of crops;

7) signs agreements (memorandums) concerning diversification of the structure of sown areas of crops;

8) develops and approves standard rules of pasture of farm animals;

9) develops the priority directions of interstate commercial ties in the field of agro-industrial complex, realizes the international projects in the field of development of agro-industrial complex within the competence;

10) will organize governmental activities on veterinary science, protection and quarantine of plants according to the laws of the Republic of Kazakhstan;

11) exercises the state veterinary health control and supervision, phytosanitary quarantine control and supervision, phytosanitary control according to the legislation of the Republic of Kazakhstan;

15-2) governs the land relations developing in agro-industrial complex and the rural territories according to the legislation of the Republic of Kazakhstan;

15-3) approves the list of the specialized organizations realizing price stabilization mechanisms on socially important food products, except for measures for ceiling establishment of prices for socially important food products;

15-4) approves instructions for use by property public in coordination with the central authorized body on state planning according to the laws of the Republic of Kazakhstan on separate types of property public;

15-5) performs state regulation in the field of quarantine of plants;

Develops 16) and approves rules of subsidizing of costs of processing enterprises for purchase of agricultural products for production of products of its deep conversion;

Develops 17) and approves the list of agricultural products on which are established the guaranteed purchase price and purchase price;

18) makes offers on enhancement of the regulatory legal base, price, technical, customs, tax, credit, insurance activity, and also in the sphere of technical regulation and policy of the state in the field of agro-industrial complex;

19) develops actions for hardware of subjects of agro-industrial complex and development of agricultural mechanical engineering;

Develops 20) and approves rules of subsidizing within guaranteeing and loans insurance of subjects of agro-industrial complex;

20-1) provides compensation of part of the commission when guaranteeing loans and part of insurance premiums in case of loans insurance of subjects of agro-industrial complex;

Develops 21) and approves rules of subsidizing on compensation of part of the expenses incurred by the subject of agro-industrial complex in case of investment investments;

21-1) develops and approves rules of subsidizing on compensation of part of the expenses incurred by the subject of fishery in case of investment investments;

Develops 28) and approves in coordination with the central authorized body on budgetary planning natural regulations of agrochemical servicing of agricultural production;

Develops 29) and claims in coordination with the central authorized body on budgetary planning:

natural regulations on carrying out monitoring and assessment of meliorative condition of the irrigated lands;

natural expense rates of materials for operating costs in case of performance of works according to meliorative condition of the irrigated lands;

30) approves rules of creation and maintaining information databank about agrochemical condition of lands of agricultural purpose;

Develops 31) and approves rates of natural loss, shrinkages, utryask, spoil of agricultural products and products of its conversion;

32) will be organized by information and marketing providing agro-industrial complex;

33) carries out within the competence vulnerability assessment to climate change;

34) determines priorities and measures for adaptation to climate change within the competence;

35) performs measures for adaptation to climate change within the competence;

36) performs monitoring and efficiency evaluation of the measures for adaptation to climate change determined within the competence and adjustment of these measures on the basis of results of monitoring and assessment;

Develops 37) and approves the list of positions of the specialists of agro-industrial complex involved to rural settlements;

38) performs coordination and methodical management of local executive bodies in regulated spheres;

39) makes in the Government of the Republic of Kazakhstan offers on release of material values from the state reserve for rendering the regulating impact on the market and according to the list of the organizations participating in release of material values from the state reserve, to amounts and the prices of the issued material values;

40) will organize system of merchandising of products of agro-industrial complex;

Develops 41) and approves industry system of encouragement;

Develops 42) and approves rules of carrying out the tender "The Best by Profession in Agro-industrial Complex";

43) will organize republican exhibitions, fairs of products of agro-industrial complex;

Develops 44) and approves form of the obligation of the receiver of subsidies;

45) will be organized by carrying out by specialized public institutions monitoring and assessment of meliorative condition of the irrigated lands;

Develops 52) and approves rules of subsidizing:

increases in productivity and product quality of livestock production;

developments of breeding livestock production;

increases in productivity and product quality of aquaculture (fish breeding), and also development of breeding fish breeding;
