of October 9, 2007 No. 1286

About approval of the Regulations on procedure for development, approval and implementation of schemes of complex use and protection of waters

(as amended on 02-11-2012)

According to article 93 of the Water code of the Republic of Belarus the Council of Ministers of the Republic of Belarus DECIDES:

1. Approve the enclosed Regulations on procedure for development, approval and implementation of schemes of complex use and protection of waters.

2. Declare invalid the resolution of Council of Ministers of BSSR of August 5, 1976 No. 228 "About procedure for development and approval of schemes of complex use and protection of waters" (SZ BSSR, 1976, No. 25, the Art. 402).

3. This resolution becomes effective from the date of its official publication.

Regulations on procedure for development, approval and implementation of schemes of complex use and protection of waters

1. This Provision determines procedure for development, approval and implementation of schemes of complex use and protection of waters.

2. Schemes of complex use and protection of waters (further - schemes) represent the systematized materials of researches and project developments about condition, perspective use and protection of surface and underground water and ensuring rational use and protection of waters, and also for prevention and liquidation of harmful effects of waters are developed for the purpose of determination of water management and other actions for satisfaction of perspective requirements of the population and economic activity in water resources.

3. Schemes are directed to the solution of the following tasks:

3.1. secured provision of requirements of the population and industries of economy in water resources, rational use of water in the industry, rural and utility farms;

3.2. decrease in anthropogenous loading and pollution of surface and underground water, improvement of their ecological condition;

3.3. protection of the population and subjects to economic and other appointment against floods and floodings, minimizing of the harm done to the environment, legal entities and physical persons as a result of harmful effects of waters;

3.4. development of network of monitoring of surface water and monitoring of underground waters.

4. Schemes are developed by the Ministry of Natural Resources and Environmental Protection together with the interested state bodies and the organizations for basins of the Dnieper Rivers, the Western Dvina, the Western Bug, Neman, Pripyat and reflect quantitative and qualitative indexes of condition of water resources and condition of water use on river basins and administrative and territorial units.

The priority of development of schemes is determined by the Ministry of Natural Resources and Environmental Protection proceeding from condition of surface and underground water and need of holding actions for rational use and protection of waters.

Developed schemes go to regional executive committees and the Minsk Gorispolkom in the territory of which the corresponding river basin is located.

5. Schemes are developed from five to ten years in two years prior to the beginning of the predicted period. In case of development of schemes the state forecasts of social and economic development of the Republic of Belarus for the long-term and medium term are considered.

6. Development of the scheme includes:

6.1. assessment and analysis:

6.1.1. water resources, their quantitative changes on perspective under the influence of anthropogenous activities and climatic changes;

6.1.2. qualities of water and condition of water objects, and also their changes in the long term;

6.1.3. the current state and perspectives of development of water management systems taking into account forecasts of social and economic development;

6.1.4. requirements for amount of water consumption and quality of water at the present stage and in the long term;

6.1.5. amounts of water disposal, pollution sources at the present stage and in the long term;

6.1.6. water management balances and water security of water users at the present stage and in the long term, the choice of the optimum mode of regulation of drain;

6.1.7. harmful effects of waters on the territory of river basin and their negative effects for the population, subjects to economic and other appointment and the environment;

6.1.8. networks of Items of observations of monitoring of surface water and monitoring of underground waters;

6.2. determination:

6.2.1. the list of the water management and other actions directed to preserving and recovery of surface and underground water, rational use of water resources, ensuring steady functioning of water management systems in borders of the river basin;

6.2.2. indicators of quality of water in the surface and underground water characterizing structure and concentration of chemicals and microbiological indicators which will be reached at the end of the water preserving and water management actions provided by schemes;

6.2.3. water management balances on river basins under different conditions of water content;

6.2.4.  No. 1008 is excluded according to the Order of the Government of the Republic of Belarus of 02.11.2012

6.2.5. the main indicators of reduction of negative effects of floods and other types of harmful effects of waters, including the actions directed to the prevention of floods and decrease in risk of emergence of emergency situations of natural nature in river basins.

7. Requirements to structure and contents of schemes are developed and affirm the Ministry of Natural Resources and Environmental Protection.

8. The Ministry of Natural Resources and Environmental Protection has the right to receive gratuitously from state bodies and the organizations the materials and results of researches necessary for development of schemes which composition and form of representation are determined by the Ministry of Natural Resources and Environmental Protection.

9. Schemes affirm regional executive committees, the Minsk Gorispolkom in the territory of which the corresponding river basin is located.

10.  No. 1008 is excluded according to the Order of the Government of the Republic of Belarus of 02.11.2012

11. Schemes are implemented by development on their basis of water management and other actions which join in state programs, action plans and other documents in the field of environmental protection and rational use of natural resources.

12. Control of implementation of schemes is exercised by the Ministry of Natural Resources and Environmental Protection, regional executive committees, the Minsk Gorispolkom.
