1. Approve Regulations on the general database on illegal migrants and persons, entrance by which to the State Parties of the Agreement on cooperation of the State Parties of the CIS in fight against illegal migration it is closed according to their existing national legal system and procedure for exchange of information about illegal migration it (is applied).

2. This Decision becomes effective from the date of its signing

It is made in the city of Moscow on January 25, 2000 in one authentic copy in Russian. The authentic copy is stored in Executive committee of the Commonwealth of Independent States which will send to each state which signed this Decision, its verified copy.

1. The State Parties of the Agreement on cooperation of the State Parties of the Commonwealth of Independent States in fight against illegal migration of March 6, 1998 (further - the Parties) perform centralized maintaining and use in mutual interests of the general database on accounting of illegal migrants and persons, entrance by which in the territory of the Parties it is closed according to their existing national legal system.

2. The state responsible for functioning and filling of the general database about illegal migrants and persons, entrance by which in the territory of the Parties it is closed according to their existing national legal system (further - the general database) is the Russian Federation.

3. Exchange of information between the Parties concerning persons, entrance by which in the territory of the Parties it is closed and maintaining the general database on accounting of persons of the specified category (further - Accounting of Zapretnika) are performed through security service and special services of the Parties under mutual approval (appendix 1).

The specified departments establish procedure for exchange of information and coordinate actions of state bodies of the Parties performing operational and investigative activity on maintaining and use of Accounting of Zapretnika.

4. Creation of the general database about illegal migrants is performed on the basis of the international treaties on information questions signed by the State Parties of the Commonwealth of Independent States which participants they are.

5. When maintaining the general database, including with use of national information systems, the Parties determine the authorized bodies performing forming of the specified information, the list of subjects users and legal regime of information resources. Sources of information are the bodies of border and immigration control, law-enforcement bodies, special services and other departments exercising control of entrance, stay and departure of citizens of the third states and stateless persons.

6. The parties on a grant basis perform exchange of information about illegal migration within the List of types of information for mutual exchange between authorized bodies of the State Parties of the Commonwealth of Independent States (appendix 2).

The relevant departments of the Parties can be information users concerning persons, information on whom is included into competence of the requesting department.

7. Information exchange about illegal migration is performed by means of use of the approved structured forms of exchange of information on the available communication channels (post, cable or e-mail). One of exchange options the informatsiyeyperiodichesky edition of the bulletin with the direction in the interested ministries and departments of the Parties.

8. Under the organization of information exchange about illegal migration of the Party determine:

the authorized bodies which are engaged in information exchange (the name and the address);

the list of the officials having right to sign of information documents for exchange (position, surname, name, middle name);

methods of information exchange, types and means of communication.

9. Each of the Parties in three-months time after signing of the Decision on statement of this provision will report to depositary about the authorized bodies which are engaged in information exchange about illegal migration.
