The parliament adopts this organic law.
Subject of this law are the legal basis of functioning of the sector of renewable energy, the social and economic relations arising in the course of development of renewable energy resources, methods of production organization and sale renewable energies and fuels.
This law regulates activities in the field of renewable energy resources, namely:
a) establishes the principles and the purposes of state policy in the field of development of renewable energy resources;
b) determines methods of integration of renewable energy resources in national power system;
c) provides correlation of activities in the field of production, accounting, transportation, distribution and energy use and fuel from renewable sources;
d) determines financial sources and the financial and economic mechanism of support of process of development of renewable energy resources;
e) determines methods of information support of activities in the field of renewable energy resources;
f) determines the economic and organizational measures directed to production incentive and energy uses from renewable sources;
g) specifies the main directions of cooperation in the field.
For the purpose of this law the following concepts are used in value:
renewable energy resources - power sources from category not fossil, the including solar, wind energy, energy of geothermal sources, hydraulic power, biomass, energy of waves, biogas, the gases received from decomposition of waste (warehouse gas), gas from decomposition of Ils in clearing installations of sewage;
renewable energy - the energy received by development of renewable energy resources including from renewable fuel;
biomass - biodegradable fraction of products, waste and remaining balance rural and forestry or adjacent industrial sectors, including materials of vegetable and animal origin, and also industrial and city wastes;
renewable fuel - the fuel received from renewable energy resources is preferential from biomass (biofuel). Renewable fuel also mix of renewable fuel with traditional fuel in the proportions provided in the existing regulations is considered;
the electric power made from renewable energy resources - the electric power made by the stations using only renewable energy resources, and also share of the electric power made from renewable energy resources at the stations with the mixed production using in fuel quality and traditional power sources;
development of renewable energy resources - set of the actions directed to transformation, accumulating, distribution and consumption renewable energies and fuels and also material logistics of these actions;
network (electric and/or thermal) - the technical tool of transportation and/or distribution of electrical or heat energy;
the electric power producer - the legal entity performing activities for production of electricity;
the operator of network - the operator of transportation power supply networks and the operator of distribution power supply networks;
the operator of system - the legal entity performing dispatching activities;
the certificate of conformity - the document issued on the basis of rules of certification, with reliability showing that the renewable fuel identified properly conforms to the standard or other regulating document;
origin guarantee - the document specifying the producer and renewable energy resource from which the electric power was made;
energy efficiency indicator - the absolute or specific value of consumption or losses of energy resources established by regulations;
the producer of renewable fuel which got permission to activities - the legal entity having the right to make and sell to operators of the market of oil products the renewable fuel made by it in accordance with the terms, established in legal and other regulations;
the established amount of renewable fuel - amount of liquid renewable fuel which the operator of the market of oil products from producer of the renewable fuel which got permission to activities shall acquire;
the established amount of electric power - amount of electric power which the electric power supplier performing activities in the domestic market shall buy.
(1) Activities for development of renewable energy resources are regulated by this law and other regulations in the field of power, and also the corresponding international treaties, one of the parties of which is the Republic of Moldova.
(2) If the international contracts and agreements, one of the parties of which is the Republic of Moldova, contain other provisions than provided by this law, the international standards are applied.
(1) the Purpose of state policy in the field of renewable energy resources consists in increase in energy security of the state and reduction of negative impact of the energy sector by the environment by annual increase in share made and used renewable energies and fuel.
(2) State policy in the field of renewable energy is implemented within the state, industry and local programs according to which monitoring by body of the public power to which duties this function belongs is performed.
(3) State policy in the field of renewable energy is based on the principles:
a) transparency of all activities and broad involvement of society, scientific and technical and technology potential in process of development of renewable energy resources;
b) competitive selection and promotion of the most effective programs;
c) reductions of the national regulatory base in compliance with standards of the European Union and international standards;
d) guaranteeing realization of renewable energy by non-discriminatory connection to centralized power and thermal networks, and also guaranteeing realization of renewable fuel by access to transportation and distribution networks;
e) promotions of production of electricity from renewable sources by means of obligatory purchase by suppliers of the established share of the electric power made from the specified sources and also by means of some administrative measures;
f) state performance monitoring of development of renewable energy resources;
g) economic and financial stimulation of process of development of renewable energy resources;
h) ensuring access of legal entities and physical persons to information on development of renewable energy resources;
i) education of the population in the spirit of development of renewable sources and use of their energy;
