About fundamentals of the state scientific and technical policy
This Law is fundamental in the scientific and technical sphere and provides complex of methods and means of participation of the state in management of scientific and scientific and technical activities. The law governs the relations arising between state bodies and subjects of scientific and scientific and technical activities in the course of forming and realization of the state scientific and technical policy.
The law determines that the science is under the care of the state and enjoys its support as the extremely important sphere for economic development, cultural development, the public relations, and provides economic and legal guarantees of scientific and scientific and technical activities.
For the purposes of this Law the terms provided below have the following value:
the state scientific and technical policy – the integral part of social and economic policy including the main objectives established by this Law, the principles, the directions and methods of impact of the state on subjects of scientific and scientific and technical activities, procedure for relations between them and the state and also between subjects of scientific and scientific and technical activities;
scientific and technical activities – the activities including carrying out applied researches and developments for the purpose of creation new or enhancements of the existing methods and policy tools of specific processes. Also works on scientific methodically, patent licensed, program, organizational methodically and to technical supply of direct carrying out research and development belong to scientific and technical activities;
scientific research (research works) – the creative activities directed to receipt of new knowledge and methods of their application. Scientific research can be fundamental and applied;
developmental works – complex of the works performed during creation or upgrade of products: development of design and technological documentation on prototypes (pilot batch), production and testing of prototypes (pilot batch);
experienced and technological works – complex of works on creation of new substances, materials and (or) engineering procedures and on production of technical documentation on them;
development – the activities directed to creation or enhancement of methods and policy tools of processes in the specific field of practical activities, in particular on creation of new products and technologies. New product development and technologies includes carrying out developmental (during creation of products) and experienced and technological (during creation of materials, substances, technologies) works.
The legislation on the state scientific and technical policy consists of this Law and other acts of the legislation.
Main objectives of the state scientific and technical policy are:
ensuring economic and social development of the republic due to effective use of intellectual resources of society;
enhancement of scientific and scientific and technical potentials as most important factors of social and economic progress;
achievement of the high intellectual and cultural levels of society directed to improvement of quality of the life of people.
Content of the state scientific and technical policy is creation by state bodies of necessary legal, economic, organizational and other conditions for scientific and scientific and technical activities.
The basic principles of forming and realization of the state scientific and technical policy are:
state support of basic and applied researches;
compliance of the state scientific and technical policy to the priority directions of scientific, scientific and technical and innovative activities determined and approved according to the procedure, established by the President of the Republic of Belarus, and first-priority state support of the research and development promoting the solution of the major problems of social and economic development of the republic;
concentration of resources on research and development in the priority directions of scientific, scientific and technical and innovative activities;
orientation of scientific and scientific and technical activities to preferential development in the republic knowledge-intensive resource-, power - and labor saving productions and technologies;
participation of local authorities and self-government in forming and realization of the state scientific and technical policy;
participation of scientists, their public organizations and associations in forming and realization of the state scientific and technical policy in the republic;
integration of science and education on the basis of different forms of participation in research and development of employees of the scientific organizations, pedagogical workers and students by means of creation of joint laboratories in institutions of higher education, structural divisions of organizations of education based on the scientific organizations;
state support of exceptional children, assistance to development of their creative capabilities;
ensuring freedom of scientific and scientific and technical activities, legal protection of intellectual property;
use is preferential economic methods of state regulation of scientific and scientific and technical activities;
equality of all subjects of scientific and scientific and technical activities, encouragement of konkursnost and competition between them;
increase in prestige of scientific work and technical creativity;
mutually beneficial cooperation with other states, creation of conditions for attraction of foreign investments on development of science and technology, development of the latest technologies and new types of products;
the openness of scientific and technical policy which is not bringing damage of homeland security, defense capability and to the vital interests of the Republic of Belarus.
Subjects of the state scientific and technical policy are:
the legal entities and physical persons performing scientific and scientific and technical activities in the territory of the Republic of Belarus.
The rights and obligations of subjects of the state scientific and technical policy in its forming and realization are regulated by the legislation.
Objects of the state scientific and technical policy are:
scientific and scientific and technical activities;
relations between participants of scientific and scientific and technical activities;
