About approval of the Regulations on orphanage of family type

For the purpose of creation of proper conditions for education of the orphan children and children deprived of parent care in family environment the Cabinet of Ministers of Ukraine decides:

1. Approve Regulations on orphanage of family type it (is applied).

2. To the ministry of social policy to perform coordination and methodical ensuring activities of orphanages of family type.

3. To provide to Council of Ministers of the Autonomous Republic of Crimea, the regional, Kiev and Sevastopol city public administrations the help in creation and activities of orphanages of family type.

4. Recognize invalid:

the resolution of the Cabinet of Ministers of Ukraine of April 27, 1994 No. 267 "About approval of the Regulations on orphanage of family type" (the joint venture of Ukraine, 1994, No. 8, the Art. 208);

the resolution of the Cabinet of Ministers of Ukraine of March 17, 1998 No. 310 "About modification and amendments in Regulations on orphanage of family type" (The Official Bulletin of Ukraine, 1998, No. 11, the Art. 409).

Regulations on orphanage of family type

General questions

1. The purpose of creation of orphanage of family type is providing proper conditions for education in family environment of the orphan children and children deprived of parent care.

2. Orphanage of family type - separate family which is established at the request of spouses or the individual who is not married at least than 5 orphan children and children deprived of parent care accepting on education and cohabitation.

Parents tutors - persons who accept on education and cohabitation of the orphan children and children deprived of parent care (further - pupils).

During action in the territory of Ukraine of emergency or warlike situation in orphanage of family type the children who were left without parent guardianship on the terms of the temporary device within the provided extreme number of children can get a job in orphanage of family type.

Pupils live and are brought up in orphanage of family type before achievement of 18-year age. After achievement of 18-year age such persons in case of continuation of training in organizations of general average, professional (professional), professional prehigher and higher education can continue to live and be brought up at their choice in this orphanage of family type before the termination of the relevant educational institutions.

Persons from among the orphan children and children deprived of parent guardianship which establishes disability at their choice can continue to live and be brought up in orphanage of family type before achievement of 23-year age by them irrespective of whether they study in organizations of general average, professional (professional), professional prehigher, higher education.

The total quantity of children in orphanage of family type shall not exceed 10 people, considering the family.

Simultaneous application of various forms of the device in orphanage of family type of the orphan children and children deprived of parent guardianship except cases when parents tutors are with the ward in the family or related relations is not allowed.

Creation and termination of functioning of orphanage of family type

The decision on creation and ensuring functioning of orphanage of family type is accepted district, district in Kiev and Sevastopol by the state administration, to executive bodies of city councils (further - body which made the decision) based on the statement of the spouses or the individual who is not married, showed willingness to create such house, and the corresponding conclusion about availability of conditions for its creation provided by service for children taking into account the recommendation of the center of social services by results of passing of training course on education of the orphan children and children deprived of parent guardianship.
