Chapter 1 General provisions

Article 1. The main terms applied in this Law and their determinations

For the purposes of this Law the following main terms and their determinations are applied:

accident - the event which happened to dangerous goods in case of its transportation (explosion, ignition, leakage, prosypaniye) and entailed damnification of life or to health of physical person (physical persons) either property tort or the environment;

safety of transportation of dangerous goods - the security condition from emergence of accidents and incidents provided with complex of the organizational and technical actions established by this Law, rules on safety control of transportation of dangerous goods, other acts of the legislation in the field of transportation of dangerous goods;

incident - the event which happened to dangerous goods in case of its transportation (explosion, ignition, leakage, the prosypaniye) which did not entail damnification of life or to health of physical person (physical persons) either property torts or the environment;

classification of dangerous goods - reference of dangerous goods to class, subclass, category and group depending on type and degree of danger of load;

dangerous goods - the substances, materials and products having properties which manifestation in transit can serve as cause of explosion and (or) the fire to lead to death, disease, injuring, poisoning, radiation or burns of people and (or) animals, and also to cause damage of vehicles, communications, constructions, engineering devices and other property and (or) to do harm to the environment;

protection of dangerous goods - activities of state bodies and other organizations for protection of objects of transportation of dangerous goods from illegal encroachments, including on prevention of illegal access to them;

transportation of dangerous goods - set of organizational and technological transactions on movement of dangerous goods with use of the vehicles from the place of their departure to the destination which are carried out on contractual basis or other legal causes including loading (filling), unloading (draining), stops, parking and any dwell-time of dangerous goods in vehicles, tanks and containers which is required in accordance with the terms of transportations, and also intermediate temporary warehousing of dangerous goods for the purpose of change of mode of transport or the vehicle (overload, transfer);

the list of the dangerous goods allowed to transportation - the lists, indexes and other transfers of dangerous goods determined by rules by safety control of transportation of dangerous goods;

maintenance of dangerous goods - complex of actions for ensuring safe transportation of dangerous goods with use of vehicles of maintenance, and (or) allocation of attendants, and (or) ensuring protection;

the vehicle - the rail vehicle, the motorized vehicle, trail car or semitrailer truck to it, the ocean ship, the inland navigation vessel, the vessel mixed (the river - the sea) swimmings, the small size vessel, the air vehicle used in transit dangerous goods.

Article 2. Coverage of this Law

This Law governs the relations arising in transit dangerous goods, performed in the territory of the Republic of Belarus.

Operation of this Law does not extend to technological transportations of dangerous goods in the territories of the organizations performing their production, conversion, storage, application and (or) destruction if such transportations are performed without exit to highways public and railway tracks public.

Article 3. The legislation in the field of transportation of dangerous goods

The legislation in the field of transportation of dangerous goods is based on the Constitution of the Republic of Belarus and consists of regulatory legal acts of the President of the Republic of Belarus, the Civil code of the Republic of Belarus, this Law, other acts of the legislation regulating transportation of dangerous goods, including technical regulatory legal acts and international treaties of the Republic of Belarus.

If the international treaty of the Republic of Belarus establishes other rules, than those which contain in this Law then are applied rules of the international treaty.

Article 4. Subjects of transportation of dangerous goods
