About approval of the Procedure for declaring of change of wholesale selling prices on food products

The Cabinet of Ministers of Ukraine decides:

1. Approve the Procedure for declaring of change of wholesale selling prices on food products which is applied.

2. To Council of Ministers of the Autonomous Republic of Crimea, the regional, Kiev and Sevastopol city public administrations to take measures for ensuring steady accomplishment of the Procedure approved by this resolution.

3. And consumer protections to provide to public service on safety issues of foodstuff control of respect for the state discipline of the prices during realization of food products.

Procedure for declaring of change of wholesale selling prices on food products

1. This Procedure determines the mechanism of declaring by subjects of managing of change of wholesale selling prices on wheat flour of the highest, first and second-rate quality, peeling rye flour, buckwheat, beef, pork, fowl (carcass), sausages boiled, except the premium, the drinking cow's milk (pasteurized, which is packed up in film), cheese sour-milk with content of fat to 9 percent, sour cream with content of fat to 20 percent, butter with content of fat to percent 72,5, eggs, granulated sugar, sunflower oil.

2. Changes of wholesale selling prices on the food products noted in Item 1 of this Procedure are subject to declaring in case such prices increase within a month more than by 1 percent.

3. Subjects of managing which perform activities for production of food products in case of change of their wholesale selling prices file such documents to Gosprodpotrebsluzhby:

explanatory note concerning reasons for need of change of wholesale selling prices together with the certificate of results of the economic analysis of actual costs on production;

calculation of cost of production of food products with indication of amount of material and labor costs;

the certificate of production volumes of food products for last year and the corresponding period of the current year;

standards, standard rates, production schedules on production of food products;

copies of the agreements connected with production of the food products concluded with other subjects of managing;

the certificate of the actual and declared profitability from realization of food products.

The specified documents make sure the signature of the head of the subject of managing, sealed and move not later, than in 10 working days prior to implementation of wholesale selling prices on food products.

4. Subjects of managing which perform sales activity of food products in case of change of their wholesale selling prices file such documents to Gosprodpotrebsluzhby:

explanatory note concerning reasons for need of change of wholesale selling prices together with the certificate of results of the economic analysis of actual costs on realization;

costing on realization of food products;

copies of the agreements connected with realization of the food products concluded with other subjects of managing;

the copy of the declaration of change of wholesale selling prices on food products of the subject of managing which performs activities for production of food products (in case of its availability).

The specified documents make sure the signature of the head of the subject of managing, sealed and move not later, than in three working days prior to implementation of wholesale selling prices on food products.

5. By results of carrying out the analysis of the documents filed by the subject of managing, Gosprodpotrebsluzhba issues according to the procedure, the established Ministry of Economic Development, conclusions concerning calculations of economically reasonable planned expenses during forming of wholesale selling prices (further - conclusions), to subject of managing which carries out activities on:

to production of food products, - in seven-day time;

realization of food products, - in two-day time.

6. The basis for refusal in issue of conclusion is not giving by the subject of managing in full of the documents specified in Items 3 and 4 of this Procedure, their inadequate registration or groundlessness of need of change of wholesale selling prices.

7. For declaring of change of wholesale selling prices on food products subjects of managing which perform activities for production or realization of food products give to Council of Ministers of the Autonomous Republic of Crimea, the regional, Kiev and Sevastopol city state administrations (further authorized bodies) such documents:

the draft declaration of change of wholesale selling prices on food products for subjects of managing which perform activities for production of food products, for form according to appendix 1 for subjects of managing which perform sales activity of food products, in form according to appendix 2;

conclusion.

8. The declaration of change of wholesale selling prices on food products is approved by the head (deputy manager) of authorized body in two-day time.

In case of refusal in approval of the declaration the authorized body sends to the subject of managing the reasonable answer with indication of causes of failure.

Change of wholesale selling prices by subjects of managing who perform activities for production or realization of food products is performed from the date of approval of the declaration of change of wholesale selling prices by authorized body on food products.

9. Wholesale selling prices on food products are considered the powers conferred by the paragraph to the thirty eighth Item 12 of appendix to the resolution of the Cabinet of Ministers of Ukraine of December 25, 1996 N1548 "About Establishment of Powers of Executive Bodies and Executive Bodies of City Councils concerning Price Regulation (Rates)" declared on the date of entry into force of the order (decision) of authorized body concerning implementation (ZP of Ukraine, 1996, N 21, Art. 596; Official Bulletin of Ukraine, 2007, N 73, Art. 2718; 2008, N 25, Art. 795).

10. The subject of managing can appeal the conclusion and/or the decision of authorized body in the procedure established by the legislation.
