About procedure for the state accounting in the field of environmental protection

Based on article 70 of the Law of the Republic of Belarus of November 26, 1992 "About environmental protection" the Council of Ministers of the Republic of Belarus DECIDES: No. 1982-XII

1. Approve Regulations on procedure for the state accounting in the field of environmental protection it (is applied).

2. To the Ministry of Natural Resources and Environmental Protection and other republican state bodies according to their competence till January 1, 2008 to bring the regulatory legal acts into accord with this resolution.

3. Not apply the resolution of Council of Ministers of the USSR of August 12, 1982 No. 746 "About approval of the Regulations on the state accounting of harmful effects on atmospheric air".

4. This resolution becomes effective since January 1, 2008, except for Item 2, becoming effective from the date of its official publication.

Regulations on procedure for the state accounting in the field of environmental protection

1. This Provision determines procedure for the state accounting in the field of environmental protection (further - the state accounting).

2. The state account is kept for the purpose of:

ensuring integrated approach to prevention of pollution, degradation, damage, depletion, destruction, destruction and other harmful effects on the environment and control over it in case of placement, design, construction, reconstruction, operation and conclusion from operation of objects of economic and other activity which makes harmful effects on the environment, including on climate;

the organizations of state regulation of impact on the environment and rational use of natural resources;

developments of the state and other programs and actions for rational (steady) use of natural resources and environmental protection;

development and accomplishment of actions for environmental protection according to the international treaties existing for the Republic of Belarus;

providing state bodies, legal entities and citizens with information on state of environment and harmful effects on it, the taken measures for protection and improvement of the environment.

3. Are subject to the state accounting:

legal entities and individual entrepreneurs whose economic and other activity makes harmful effects on the environment, including ecologically dangerous activities, criteria of reference to which are determined by the Presidential decree of the Republic of Belarus of June 24, 2008 No. 349 "About criteria of reference of economic and other activity which makes harmful effects on the environment, to ecologically dangerous activities" (further – users of nature);

objects of economic and other activity which makes harmful effects on the environment (further – objects);

types of harmful effects on the environment.

4. The state accounting of legal entities and individual entrepreneurs whose economic and other activity has harmful cart effect on the environment is made based on complex assessment of the size of harmful effects rendered by these objects on the following components of the environment:

atmospheric air;

surface and underground water;

lands, including soils;

flora;

fauna.

5. Treat the types of harmful effects on the environment which are subject to the state accounting:

direct impacts - the impacts which are directly rendered by the main and accompanying types of economic and other activity on the environment around placement of object (emissions, dumpings of pollutants into the environment, harmful physical impacts on components of the environment and other impacts);

indirect impacts - the impacts on the environment caused by the mediated (secondary) factors arising owing to operation of object (change of biological diversity, transition of pollutants from one component of the environment in other components and other factors);

the total impacts called in paragraphs second or third this Item.

6. The state accounting is performed on the basis of the following principles:

efficiency of conducting the state accounting;

unity of methodical and information bases of creation and maintaining databases of the state accounting at the republican, regional, city and district levels;

objectivity, completeness and reliability of data;

complexity of information on impact on the environment;

access of state bodies, legal entities and citizens to information on state of environment and harmful effects on it.

7. The state account is kept by the Ministry of Natural Resources and Environmental Protection (further - Ministry for Protection of the Environment and Natural Resources) and its territorial authorities by means of accounting of users of nature in the database of the state accounting (further - the database).

The database is created in the form of the electronic document containing information on users of nature, the location, designing, construction, reconstruction, operation and conclusion from operation of objects of users of nature, their quantity and quality characteristic, assessment of harmful effects of economic and other activity on the environment and other data provided in structure of the database.

In case of statement on the state accounting accounting number is assigned to each user of nature.

The structure of the database and form of accounting number of the user of nature are approved by Ministry for Protection of the Environment and Natural Resources.

8. Ministry for Protection of the Environment and Natural Resources and its territorial authorities when maintaining the database perform:

data collection and processing about users of nature;

determination of types of economic and other activity on the level of harmful effects on the environment and entering of information into the database;

control of correctness of conducting primary accounting of harmful effects on the environment;

analytical data processing about harmful effects on the environment taking into account distribution of objects of users of nature within administrative and territorial units and the republic in general.

9. Inclusion of users of nature in the database is performed by Ministry for Protection of the Environment and Natural Resources and its territorial authorities based on criteria of reference of economic and other activity which makes harmful effects on the environment, to ecologically dangerous activities, No. determined by the Presidential decree of the Republic of Belarus of June 24, 2008 349, and the list of the types of economic and other activity which are subject to the state accounting in the field of environmental protection, the approved Ministry for Protection of the Environment and Natural Resources.
