RESOLUTION OF COUNCIL OF MINISTERS OF THE REPUBLIC OF TAJIKISTAN

About social protection of persons participating in the armed actions (conflicts) for protection of the constitutional system of the Republic of Tajikistan and injured these conflicts and also which lost the supporter of members of the family of specified persons

For the purpose of social protection of persons participating in the armed actions (conflicts) for protection of the constitutional system of the Republic of Tajikistan and injured these conflicts, and also families of the specified persons who lost the supporter, the Council of Ministers of the Republic of Tajikistan decides:

1. Persons who were taking part in the armed actions (conflicts) for protection of the constitutional system of the Republic, Tajikistan the citizens of the Republic of Tajikistan included in structure of paramilitary forces are recognized.

2. Persons participating as a part of paramilitary forces in the armed actions (conflicts) for protection of the constitutional system of the Republic of Tajikistan have the right to the privileges provided by the current legislation for participants of war (except for privileges on payment for use of natural gas and the electric power).

3. The participants of paramilitary forces who became disabled people owing to wound contusions or mutilations received in case of protection of the constitutional system of the Republic of Tajikistan have the right to the privileges provided by the current legislation for disabled veterans.

4. Members of the family of person, the dead or the dead owing to wound, contusions or mutilations received in case of protection of the constitutional system of the Republic of Tajikistan have the right to the privileges provided by the current legislation for families of the military personnel, the dead on duty (except for privileges on payment for use of natural gas and the electric power).

5. The participants of paramilitary forces who became disabled people either the dead, or the dead owing to wound contusions or mutilations received in case of protection of the constitutional system of the Republic of Tajikistan and also members of their families have the right to provision of pensions according to the procedure and on the conditions provided by the current legislation for the military personnel of conscription service.

6. To executive committees of local councils of People's Deputies till July 10, 1993 to form headed by deputy chairmen of gorrayispolkom of the commission in which structure to include field commanders of paramilitary forces of this area or their representatives, representatives of financial bodies, social security, law enforcement agencies, military commissariats for creation and approval of lists of persons participating in the armed actions (conflicts) as a part of paramilitary forces on protection of the constitutional system of the Republic of Tajikistan.

Gorrayispolkomam to finish creation of these lists till September 1, 1993 and approval them in coordination with the Ministry of Defence, the Ministry of Internal Affairs and the State committee of the Republic of Tajikistan on homeland security till September 20, 1993.

7. To the Ministry of Labour and Social Protection of the population of the Republic of Tajikistan:

provide establishment of group of disability to the participants of paramilitary forces on protection of the constitutional system of the Republic of Tajikistan who became disabled people owing to wound, contusions or mutilations received as a result of the armed actions (conflicts);

register persons which became disabled people owing to the specified reasons and members of families of specified persons for provision to them the privileges provided acting with the legislation;

provide appointment and pension payment according to the procedure and on the conditions provided for the military personnel of conscription service;

provide certification about the right to privileges to the participants of paramilitary forces who became disabled people owing to wound, contusions or mutilations received in case of protection of the constitutional system of the Republic of Tajikistan;

develop till August 1, 1993 the instruction for application of this resolution with participation of the Ministry of Defence, Ministry of Internal Affairs, State committee of the Republic of Tajikistan on homeland security, the Ministries of Finance and the Ministries of Justice.

8. To the Ministry of Defence of the Republic of Tajikistan to prepare certificates of single sample for participants of paramilitary forces on protection of the constitutional system of the Republic of Tajikistan and through military commissariats at the place of residence of these persons to provide issue of certificates to them according to the lists constituted by the commission.

9. To the Ministry of Finance of the Republic of Tajikistan to dig up necessary resources and to provide financing of the established privileges and provision of pensions according to this resolution at the expense of the means provided by the current legislation.

10. Oblgorrayispolkomam to render every possible assistance to participants of the paramilitary forces on protection of the constitutional system of the Republic of Tajikistan which are engaged in business activity.

11. Recognize necessary to introduce to Presidium of the Supreme Council of the Republic of Tajikistan the draft of the Decree on provision to the participants of paramilitary forces on protection of the constitutional system of the Republic of Tajikistan who lost housing, property, soft credit on construction, acquisition of the apartment house, outdoor constructions, on recovery of the destroyed structures, property acquisition, the cattle and other purposes in the land of 120 thousand rubles for the term of 20 years with repayment, since fourth year after receipt of the credit.
