Chapter 1. General provisions

Article 1. The main terms applied in this Law and their determinations

For the purposes of this Law the following main terms and their determinations are applied:

baggage - the things which are handed over by the passenger for the established payment for delivery by railway transport public in the destination specified in the travel document (ticket), and transported in the place which is specially equipped for these purposes;

traffic security and operation of rail transport - condition of security of process of movement of vehicles of rail transport, condition of vehicles of rail transport and infrastructure of rail transport public (further - infrastructure), and also railway tracks of uncommon use in case of which there is no unacceptable risk of emergence of the transport incidents and their effects involving damnification of life or to health of citizens, the environment, property of legal entities and physical persons;

the owner of infrastructure - the organization of rail transport public determined by this Law which possesses infrastructure on the right of economic maintaining;

the intra republican message - carriages of goods by railway transport public within the territory of the Republic of Belarus;

the city message (city lines) - public conveyances, baggage and cargo baggage railway transport public in city boundaries of Minsk, the regional center and out of their limits, but not further railway stations, stopping points located in satellite towns;

cargo baggage - the things which are handed over by legal entities or physical persons, not being passengers, for the established payment for delivery by railway transport public in destination according to the transportation agreement and transported in the place which is specially equipped for these purposes;

loads - the material values accepted for delivery by railway transport public in destination according to the transportation agreement;

access to services of infrastructure - possibility of receipt of the services rendered with use of infrastructure;

railway station - the railway Item having the traveling development allowing to perform transactions on acceptance, departure, crossing and overtaking of trains, technical transactions with trains and (or) shunting operation on disbandment and forming of trains, and also transaction on landing and disembarkation of passengers, their servicing, receiving and delivery of loads, baggage and cargo baggage;

railway tracks of uncommon use - the railroad side tracks adjoining directly or through other railroad side tracks railway tracks public and intended for servicing of certain consumers on contractual conditions or performance of works for own needs of their owner;

railway tracks public - the railway tracks located in the territory of railway stations and (or) connecting such stations intended for uninterrupted activities of rail transport public;

railway track - the complex of constructions including the upper structure of way, subgrade, drainage, water throughput, antideformation, protective and strengthening constructions of subgrade, located in right of way and also artificial features;

rail transport - the mode of transport providing transportations on railway tracks;

rail transport of uncommon use - the type of rail transport intended for ensuring requirements of legal entities and physical persons for services (works) rendered (carried out) in places of uncommon use on contractual conditions, or performance of works for own needs of these persons and including railway tracks of uncommon use, capital structures (buildings, constructions), vehicles of rail transport, and also other property. Places of uncommon use are understood as the railway tracks of uncommon use and also covered and the ground storages and sites which are not belonging to the owner of infrastructure or leased to them and used by certain consumers for implementation of transactions on loading, unloading, storage of loads;
