About armed forces of the Republic of Belarus

This Law establishes purpose, tasks, structure, number, the principles of creation and activities of Armed Forces of the Republic of Belarus, completing and dislocation, management of Armed Forces of the Republic of Belarus, their interaction with other troops and military forming, paramilitary organizations.

Chapter 1. General provisions

Article 1. The main terms and concepts applied in this Law

In this Law the following main terms and concepts are applied:

Armed forces of the Republic of Belarus (further – Armed Forces) – the structural component of military organization of the state intended for ensuring military safety and the armed protection of the Republic of Belarus, its sovereignty, independence, territorial integrity and the constitutional system;

other troops and military forming – the state military organizations subordinated, as a rule, to state bodies in which the military service is provided. Transport troops, internal troops of the Ministry of Internal Affairs, the state security agencies, bodies of the border service, the Presidential Security Service of the Republic of Belarus, territorial troops and other state military organizations created according to the legislation treat other troops and military forming;

state bodies in which the military service is provided, – the state bodies performing special functions on the organization of protection of sovereignty of the state, its independence, territorial integrity, the constitutional system and citizens. The Ministry of Defence, the Ministry of Internal Affairs, Committee for State Security, the State boundary committee, the Presidential Security Service of the Republic of Belarus treat state bodies in which the military service is provided.

Article 2. Legal basis of activities of Armed Forces

Activities of Armed Forces are based on the Constitution of the Republic of Belarus, this Law, other regulatory legal acts regulating activities of Armed Forces and also on international treaties of the Republic of Belarus.

If the international treaty of the Republic of Belarus establishes other rules, than those which contain in this Law then are applied rules of the international treaty.

Chapter 2. Tasks, structure, number, principles of creation and activities, completing and dislocation of armed forces

Article 3. Tasks of Armed Forces

The main objectives of Armed Forces are:

in peace time:

maintenance of fighting potential, including combat and mobilization readiness, troops (forces) at the level providing reflection of attack of local scale including during increase of military threat;

ensuring information security of the activities;

anticipatory opening of any manifestations of preparation of attack on the Republic of Belarus;

protection of Frontier of the Republic of Belarus in airspace;

creation of multipurpose defensive systems for the purpose of the complex solution of tasks of ensuring military safety and the armed protection of the Republic of Belarus;

comprehensive preparation for carrying out army mobilization;

readiness for strategic expansion of Armed Forces (complete or partial) within transfer of the country into wartime conditions;

accomplishment of programs and plans of operational, combat and mobilization training, implementation in educational and fighting practice of troops (forces) of new forms and methods of conducting combat operations, new military technologies;

content of arms and military equipment in condition of permanent technical readiness for fighting application;

enhancement of air defense as single fighting defensive system of the Union State;

participation in permission of internal armed conflict;

providing in interaction with other troops and military forming, paramilitary organizations of warlike situation, emergency rule;

carrying out army mobilization and strategic expansion of Armed Forces (complete or partial);

maintenance at the high level of moral and psychological condition of staff;

in wartime:

the armed protection of the Republic of Belarus;

reflection of attack in any conditions of strategic situation as independently, and together with armed forces of allies;

defeat infliction to the opponent and creation of premises for the termination of military operations (conclusion of peace) on the conditions which are not contradicting national interests of the Republic of Belarus.

Article 4. Structure of Armed Forces

Armed forces constitute basis of military organization of the state.

Armed forces consist from:

central bodies of military management of Armed Forces;

types of Armed Forces;

types of military forces;

special troops;

arms of Armed Forces;

back of Armed Forces;

military educational institutions, military commissariats and organizations of Armed Forces.

The Ministry of Defence and the General Staff of Armed Forces treat the central bodies of military management of Armed Forces (further - the General Staff). The General Staff organizationally is part of the Ministry of Defence.

Types of Armed Forces are:

Land forces;

Air Force and troops of air defense.

Types of Armed Forces, type of military forces, special troops, arms of Armed Forces, the back of Armed Forces consist of bodies of military management, associations, connections, military units and the organizations of Armed Forces. Connections and military units have rights of the legal entity. Bodies of military management and organization of Armed Forces can have rights of the legal entity according to the documents determining their legal status and procedure for activities.

Military commissariats are local authorities of military management.

Article 5. Number of Armed Forces

The number of Armed Forces is determined by the Security Council of the Republic of Belarus and affirms the President of the Republic of Belarus.

Military personnel and civil personnel enter the number of Armed Forces.

Article 6. Principles of creation and activities of Armed Forces

The basic principles of creation and activities of Armed Forces are:

centralization of management;

one-man management;

permanent combat and mobilization readiness;

compliance of organizational and regular structure, fighting structure and number of troops (forces) to the tasks solved by them, the international obligations and economic opportunities of the Republic of Belarus;

legal and social protection of the military personnel, the citizens having the status of the military personnel, citizens to whom the separate social privileges, the rights and guarantees provided by legal acts for the military personnel, and civil personnel extend;

equality of all military personnel before the law;

publicity;

the openness for civil control providing participation of all citizens in strengthening of defense capability of the Republic of Belarus.
