Approve the enclosed Regulations on implementation by federal executive bodies of functions and powers of the founder of federal autonomous institution.

Regulations on implementation by federal executive bodies of functions and powers of the founder of federal autonomous institution

1. This Provision regulates procedure federal executive bodies of functions and powers of the founder of the autonomous organization created based on the property which is in federal property (further - federal autonomous institution).

2. The decision on creation of federal autonomous institution is made by the Government of the Russian Federation based on offers of federal executive bodies.

The decision on creation of federal autonomous institution by change like the existing federal budget or state institution is accepted by the federal executive body performing functions and powers on development of state policy and normative legal regulation in the corresponding field of activity concerning the organization which is under authority of this body or Federal Service or the federal agency subordinated to this body.

Functions and powers of the founder of federal autonomous institution are performed by the federal executive body specified in the decision on creation of federal autonomous institution and in the charter of federal autonomous institution.

Functions and powers of the founder of the federal autonomous institution created by change of type of federal budgetary institution are performed by the federal executive body performing functions and powers of the founder of federal budgetary institution which type was changed.

3. The federal executive body performing functions and powers of the founder of federal autonomous institution if other is not established by the Federal Laws or other regulatory legal acts:

a) claims in coordination with federal executive body to which management of federal property, the charter of federal autonomous institution, and also the changes made to it is assigned;

b) creates and approves the state task to federal autonomous institution according to the types of activity carried to its main activities;

c) considers proposals of the head of federal autonomous institution on creation or liquidation of branches of federal autonomous institution, opening or closing of its representations;

d) submits for consideration of the supervisory board of federal autonomous institution of the offer:

about introduction of amendments to the charter of federal autonomous institution;

about creation or liquidation of branches of federal autonomous institution, opening or closing of its representations;

about reorganization or liquidation of federal autonomous institution;

about withdrawal of the property assigned to federal autonomous institution on the right of operational management;

e) makes decisions:

about creation or liquidation of branches of federal autonomous institution, opening or closing of its representations;

about reorganization or liquidation of federal autonomous institution;

e) determines the list of especially valuable personal estate;

g) gives to federal autonomous institution in coordination with federal executive body to which management of federal property, consent to the order by the real estate assigned to it the founder or acquired at the expense of the funds allocated by the founder for acquisition of this property is assigned and also agrees to the order especially valuable personal estate assigned to it the founder or acquired at the expense of the funds allocated by the founder for acquisition of this property;

h) agrees to entering by federal autonomous institution of money and other property into the authorized (share) capital of other legal entities or transfer of this property otherwise to other legal entities as their founder or the participant (regarding introduction of real estate - in coordination with federal executive body to which management of federal property is assigned);

i) brings in federal executive body to which management of federal property, offers on fixing to federal autonomous institution of real estate and on withdrawal of this property is assigned;

j) represents in accordance with the established procedure the offer on creation of federal budgetary institution by change like federal autonomous institution;

k) appoints the head of federal autonomous institution and stops its powers;

l) signs and stops the employment contract with the head of federal autonomous institution;

m) makes decisions on approval of the transaction with property of federal autonomous institution in which making there is interest if persons interested in its making constitute the majority in the supervisory board of organization, and also the transaction concerning real estate and especially valuable personal estate;

o) resolves other issues provided by the Federal Law "About Autonomous Organizations".

3(1). The federal executive body performing functions and powers of the founder of federal autonomous institution concerning the federal autonomous institutions included in the list approved by the Government of the Russian Federation appoints the head of organization to position, stops its powers and performs to it payment of remuneration following the results of work in year with the consent of Deputy Prime Ministers of Russia to whose duties coordination of work of the corresponding federal executive bodies belongs.

4. The federal executive body performing functions and powers of the founder of federal autonomous institution brings the decisions to federal autonomous institution in writing within 7 days from the date of their acceptance.

4(1). Decisions on the questions specified in subitems "a", "zh" and "z" of Item 3 this provision are accepted by the federal executive body performing functions and powers of the founder of federal autonomous institution in coordination with federal executive body to which management of federal property is assigned, except for of decision making concerning the federal autonomous institutions which are under authority of the Ministry of Defence of the Russian Federation, Presidential Property Management Department of the Russian Federation and Federal Agency for Sea and Inland Water Transport (concerning federal autonomous institutions subordinated to it behind which the property located in borders of seaports is fixed in operational management).
