About enhancement of system of accounting of citizens at the place of residence and the place of stay

For the purpose of providing necessary conditions for realization by citizens of the rights to liberty of movement and the choice of the residence, stipulated in Article 30 Constitutions of the Republic of Belarus, and also enhancement of system of accounting of citizens at the place of residence and the place of stay:

1. Abolish system of registration grazhdan*.

* For the purposes of this Decree citizens of the Republic of Belarus, and also the foreign citizens and persons without citizenship who are constantly living in the Republic of Belarus treat citizens.

2. Approve Regulations on registration of citizens at the place of residence and the place of stay (further – the Provision) it (is applied).

3. Determine that:

3.1. each citizen shall be registered at the place of residence within the Republic of Belarus and in the cases and procedure provided by the Provision shall or has the right to be registered in the place of stay in limits of the Republic of Belarus;

3.2. on the date of entry into force of this Decree citizens are considered as registered:

at the place of residence - according to permanent registration. At the same time the stamp about registration at the place of residence in the identity document of the citizen, is not put down;

in the place of stay - according to temporary registration. At the same time the registration certificate in the place of stay is not granted.

The rights and obligations which arose in connection with permanent or temporary registration at the citizen registered at the place of residence or the place of stay remain;

3.5. within three years after entry into force of this Decree in the absence of the documents which are the basis for registration of citizens at the place of residence or the place of stay according to the paragraph the second subitem 4.2 of item 4 of the Provision (technical data sheet on premises, the room for temporary residence and the certificate (certificate) of state registration of origin or transition of the property right to premises, the placement for temporary residence, or technical data sheet on premises, the room for temporary residence and the statement from the registration book concerning premises, the placement for temporary residence, or the registration certificate on premises, the room for temporary residence), for the purposes of registration of citizens at the place of residence and the place of stay the documents which are the basis for ownership are equated to these documents orders and (or) uses of premises or room for temporary residence, according to the list approved by Council of Ministers of the Republic of Belarus;

3.6. expenses of the organizations performing operation of housing stock and (or) providing housing and communal services and the organizations performing accounting, calculation and charge of payment for the housing and communal services and payments for use of premises connected with registration of citizens at the place of residence and the place of stay are compensated from means of local budgets according to the procedure, determined by the Ministry of Housing and Public Utilities in coordination with the Ministry of Finance;

3.7. The Ministry of Internal Affairs for the purpose of accounting of citizens at the place of residence and the place of stay has the right on:

processing of personal data of physical person with observance of requirements of the legislation on personal data;

obtaining on a grant basis data by means of the nation-wide automated information system (further – OAIS) from information systems, information resources including containing personal data;

access, including remote, to information systems, information resources containing such data by the written request or based on the agreement (agreement) between the Ministry of Internal Affairs and state bodies (organizations).

4. Till December 1, 2007:

4.1. To Council of Ministers of the Republic of Belarus:

approve the list of documents specified in subitem 3.5 of Item 3 of this Decree;

provide preparation and acceptance of the regulatory legal act determining that removal of persons liable for call-up (recruits) from military accounting is performed without address of these citizens to military commissariats, local executive and administrative organs in the rural zone, and also in the cities and settlements where there are no military commissariats;

together with the National center of bill activities in case of the President of the Republic of Belarus to take measures for reduction of legal acts in compliance with this Decree;

provide reduction of other acts of the legislation in compliance with this Decree;

take other measures necessary for implementation of this Decree;

4.2. to local councils of deputies, executive and administrative organs:

provide reduction of the decisions in compliance with this Decree;

take other measures necessary for implementation of this Decree.

5. This Decree becomes effective since January 1, 2008, except for item 4 and this Item which are becoming effective from the date of official publication of this Decree.

Regulations on registration of citizens at the place of residence and the place of stay

Chapter 1. General provisions

1. This Provision determines order of registration of citizens and their removal from registration accounting by the place of residence and the place of stay in the Republic of Belarus.

2. Action of this provision extends to citizens of the Republic of Belarus, and also foreign citizens and stateless persons including to whom the status of the refugee or shelter in the Republic of Belarus are provided, constantly living in the Republic of Belarus (further if other is not determined, – citizens).

Action of this provision does not extend to the foreign citizens and persons without citizenship who are temporarily staying or temporarily living in the Republic of Belarus and also foreign citizens and stateless persons to which the status of the refugee or shelter in the Republic of Belarus, before receipt by them of permission to permanent residence in the Republic of Belarus which registration is performed according to other acts of the legislation are provided.

3. If the international treaty of the Republic of Belarus establishes other rules, than those which contain in this Provision then are applied rules of the international treaty.
