Based on paragraphs of third and eighth Item 10 of the Regulations on procedure of lottery activities in the territory of the Republic of Belarus approved by the Presidential decree of the Republic of Belarus of May 4, 2007 No. 209, and Item 10 of the Regulations on the Ministry of Finance of the Republic of Belarus approved by the resolution of Council of Ministers of the Republic of Belarus of October 31, 2001 No. 1585, the Ministry of Finance of the Republic of Belarus DECIDES:

1. Approve the Instruction about procedure for carrying out lotteries in the Republic of Belarus and the receipts in the republican cash budget received from carrying out republican lotteries it (is applied).

2. Determine that lotteries which founders and organizers do not provide till November 12, 2007 reduction of agreements and conditions of their carrying out in compliance with the Presidential decree of the Republic of Belarus of May 4, 2007 to No. 209 "About lottery activities in the territory of the Republic of Belarus" are subject to exception of the state register of lotteries.

The termination of carrying out these lotteries is performed according to the procedure, the established Regulations on procedure of lottery activities in the territory of the Republic of Belarus and this resolution.

3. This resolution becomes effective from the date of its official publication, except for Item 1, which becomes effective since November 12, 2007.

Chapter 1. General provisions

1. This Instruction establishes requirements for carrying out lotteries, obligatory for the subjects of lottery activities, and also procedure for receipt in the republican cash budget received from carrying out republican lotteries.

2. For this Instruction terms and their determinations in the values established by Regulations on procedure of lottery activities in the territory of the Republic of Belarus and also the following term and its determination are used:

the lottery equipment – complex program, hardware-software, the hardware providing carrying out lottery.

Chapter 2. Instruction for carrying out lottery

3. The founder of lottery approves the instruction for carrying out lottery containing conditions of carrying out lottery.

4. The instruction for carrying out lottery shall contain:

4.1. name and type of lottery, name of her founder and organizer, their location;

4.2. the space (territory) and terms of carrying out lottery, frequency of carrying out circulations (for the production and combined lotteries).

Coincidence of the name of lottery with earlier registered in the state register of lotteries, except for lotteries which carrying out is stopped is not allowed;

4.3. the purposes of carrying out lottery with indication of specific actions or objects;

4.4. sources of financing of activities for carrying out lottery;

4.5. procedure for implementation of lottery tickets (for electronic lotteries – procedure for acceptance of lottery rates, terms of forming of databases about the accepted (unaccepted) lottery rates).

The following requirements shall be observed:

implementation of lottery tickets (acceptance of lottery rates) can be made for cash and clearing settlement in case of respect for the principle of voluntariness;

distribution of information on owners of advantageous lottery tickets (lottery rates) without their consent is not allowed;

the cost of the lottery ticket or fixed price of lottery rate (cost of the minimum game combination), the sizes of winnings and cost of property prizes are determined in official monetary unit of the Republic of Belarus;

lottery tickets of each separate lottery, circulation (series of instant lottery) of lottery are not subject to use for carrying out other lotteries, other circulations (series of instant lottery) of this lottery (except as specified, provided by rules of the game), and also transfer by the organizer of lottery to the third parties for any other purpose, except realization;

4.6. procedure for mutual calculations between the organizer of lottery and participants (introduction of payment for participation in lottery, issue of prize, procedure for use of the amounts of prizes in payment for lottery rates for participation in lottery);

4.7. procedure for forming of prize fund, its amount expressed as a percentage of the total amount of implementation of lottery tickets (the accepted lottery rates), procedure for forming and draw of the prize funds of lottery passing from circulation into circulation (in case of their availability);

4.8. rules of the game, procedure for holding draw of prize fund of lottery (for instant lottery - procedure for determination of prizes), including actions of the organizer of lottery in case of detection of mistake when holding draw, and also in case of approach of the force majeur circumstances or circumstances which are not allowing to finish draw of prize fund of circulation and to fix its results;

4.9. form of the act and official table of results of carrying out circulation (for the production and combined lotteries).
