Procedure for creation of the customs control zone

(as amended on 19-05-2015)

This Procedure is developed according to the Customs code of the Republic of Uzbekistan and determines procedure for creation and functioning of the customs control zone in places of customs clearance of goods, vehicles, passengers, their hand luggage, baggage, including separately the following, currency and the international mailings in the territory of the Republic of Uzbekistan.

1. The terms used in this Procedure:

the customs control zone - specially allocated and designated part of customs area of the Republic of Uzbekistan created by customs authority within which for the purpose of implementation of customs control maintenance of specific mode of movement of persons, goods and vehicles is necessary;

productive and other business activity in the customs control zone - the activities of state bodies and any business entities performed in the customs control zone with permission and under control of customs authority which are not interfering accomplishment of functions of customs authority;

the mode of the customs control zone - the procedure for movement of persons, goods and vehicles established by customs authority through borders of the customs control zone and in its limits, and also procedure of productive and other business activity;

the check point - the territories of the railway and automobile transitions, sea and river ports, airports and airfields open for the international messages (the international flights) which are on customs border, and also other specially equipped place where both other types of control and movement through customs border of the Republic of Uzbekistan of persons, goods and vehicles are performed customs.

2. Places of creation of customs control zones

Customs control zones are created along customs border of the Republic of Uzbekistan, in places of customs clearance, in zone of activities of customs authorities and in other places determined by customs authorities.

The customs control zone can be established for the period of carrying out customs clearance and control out of the places determined for this purpose. Its limits in these cases are determined by the official of customs authority designated for implementation of the specified procedures.

Customs control zones are created by the order of the chief of territorial administration of the State Customs Committee (specialized customs complex) or person replacing it in which region of activities there is created customs control zone.

In the order shall be specified:

basis and purpose of creation;

location;

limits and places of crossing of border of the customs control zone by persons, goods and vehicles;

the means used for designation of border of the customs control zone;

date of creation and term for which the customs control zone is created (in case of creation of the temporary customs control zone).

Graphical display of limits and the territories of the customs control zone in the form of plans or maps shall be given in appendix to the order.

The order on creation of the customs control zone is not required in the presence of license for activities of customs warehouse, free warehouse and duty-free shop according to the resolution of the Cabinet of Ministers of the Republic of Uzbekistan of November 20, 2003 to No. 523 "About approval of regulations on licensing of activities of customs warehouse, free warehouse and duty-free shop.

At the same time the customs warehouse, free warehouse and duty-free shop at the same time are the venue of customs clearance and customs control.

3. Borders of customs control zones

Limits of customs control zones are determined taking into account physiographic and local conditions, nature and intensity external economic and economic productive activity and other factors which directly influence maintenance in it the set mode. Customs control zones are designated by the corresponding signs. The area of the customs control zone shall be sufficient for accomplishment of all compulsory customs procedures in full.

Within the customs control zone customs authorities establish routes of movement of physical persons, goods and vehicles. In necessary cases routes will be approved with divisions of border troops and administration of the organization in the territory of which customs authorities of the Republic of Uzbekistan perform the functions. Routes are designated by indexes in the Uzbek, Russian and English languages performed on single sample.

4. Obligations of persons and transport drivers when crossing customs control zones

Persons and vehicles moving through borders of the customs control zone and in its limits shall:

- stop in the places determined by customs authority and resume movement only with their permission;

- move goods and vehicles only along the established routes, not to allow variations from them without the permission of officials of customs authority;

- show upon the demand of officials of customs authority goods and vehicles, and also documents and the data necessary for customs control;

- fulfill other requirements established by the legislation of the Republic of Uzbekistan.

5. Responsibility for violation of the mode of the customs control zone

Movement of persons, goods and vehicles without the permission of customs authority along routes, in addition to specified by customs authority, is violation of the mode of the customs control zone.

Perpetrators bear responsibility according to article 227 of the Code about the administrative responsibility of the Republic of Uzbekistan for violation of the mode of the customs control zone.

6. The rights and obligations of customs officers in the customs control zone

Officials of customs authorities have the right to demand from persons of movement by them of goods and vehicles through borders and within the customs control zone according to the mode of the customs control zone. Orders of officials of customs authority within the competence are obligatory for all persons moving goods and vehicles through borders of the customs control zone and in its limits.

Control of observance of the mode of the customs control zone is exercised by customs authorities.

The expenses connected with designation of customs control zones in places of customs clearance and arrangement of customs authority and designation of their mode bear customs authorities.

7. Final provisions

The order on creation of the customs control zone is repealed in cases:

changes of the location of customs authority;

closings of the check point;

changes of the storage location of the goods and vehicles which are under customs control.
